HomeMy WebLinkAbout20083173.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST DOUBLE B DEVELOPMENT CORP FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Double B Development Corp, ZCV#0800203, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 9th day of December, 2008, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Robert and Sharon Baumgartner, property owners, were present at said hearing, and WHEREAS,the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until February 9, 2009, to allow adequate time for the property owners to complete the Amended Site Plan Review application to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. Also, a portion of the fee is waived, reducing the fee to $500.00 to be paid by the property owners. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that ZCV#0800203 be, and hereby is, referred to the Weld County Attorney's Office for legal action against Double B Development Corp to remedy the violation of the Weld County Code, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties, with an instruction for delay of action upon such referral until February 9, 2009, to allow adequate time for the property owners to submit an Amended Site Plan Review to bring the subject property into compliance. They had received my Violation letter. Michelle Martin and I met with them. They said that this all started because one of their tenants is a wood cutting business and the fire department(during an annual review) indicated they needed to sprinkle the building. Michelle and I explained that anytime a use substantially changes or a new structure is constructed an amendment to the SPR is necessary (in most cases). The SPR of records is SPR-120 and strictly permits the manufacturing and fabrication of steel drums. They said that was the business that existed before they bought the property. They indicated that currently they have several tenants who do minimal repair work. Michelle walked them through the requirments for a Pre-Application meeting. We even filled out most of the front page for them while they were here at the office. They indicated that the would prefer to have the Pre-Application meeting here in Greeley and continue to work with Kim Ogle. 08/21/2008 Office Visit Pre-Application meeting. The building was constructed in 1962 and Double B Enterprises has owned the property since 1994. Prior to Double B ownership, a barrel manufacturing company or barrel washing and sterilizing occupied the building. The current buildings remain the same since 1988 except the batch plant has been removed. The current uses for each tenant will show on a site plan which Joel Crowe with Alpha Engineering has been retained to complete. The site plan will indicate the square footage of each building, hard surface area for parking, landscaping, sewer, and easements etc. The current tenants are industrial uses and are compatible with the Weld County Industrial Regulations except for the wood pallet company. The wood pallet company was evicted in September and is in the process of removing the material stored in the yard. It is our request the plan review fee in the amount $1000.00 be waived since the site has remained industrial uses on the property and has not been vacant for twenty-five years. The site plan and floor plan square footage will be submitted once it is completed by Alpha Engineering. The 24 x 60-foot retention pond in the NW4 of the site shall be indicated on the site plan map. A variance will be required from the Department of Public Works for the retention pond. Pre-application reviews are required prior to beginning the application process; however, this review is not an application. • Pre-application reviews are held with the Weld County Departments of Public Works and the Public Health and and Environment. The second and fourth Friday of any given month pre-applicant reviews are held in the Southwest Service Center office at 10:30 a.m., 11.30 a.m., 1:00 p.m., 2:00 p.m. and 3:00 p.m. Pre-Application reviews are held Thursday of any given week in the Greeley office. The Weld County Code is available on-line at http://www.co.weldco.us. (Quick Links-Policies and Ordinances) One.complete original application form (Page 3), plus fourteen copies of the original application and all required documents or information outlined in Sections 23-2-160.A. through 23-2-160.V. , Y. and Z. of the Weld County Code for a total of fifteen application packets.
