We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit a dust abatement plan for parking and driving areas onsite for review and approval, to the Environmental Health Services, Weld • County Department of Public Health & Environment. 2. Sewage disposal for the rodeo arena shall be by septic system, however, the property lies within the boundary of the 100 year flood plain. Lone Tree Creek and Owl Creek lie within this flood boundary. No septic systems are permitted to be installed within the flood way as stated in Colorado Department of Public Health and Environment ISDS Guidelines Section VIII (17) and in Section 30-5- 20 of the Weld County Code pertaining to septic systems. The floodway has not been delineated on the plat map: therefore the Department recommends that the applicant determine and delineate the flood way boundary on the plat map and locate the septic system outside the designated flood way boundary. The septic system is required for the proposed arena and shall be designed by a Colorado Registered Professional Engineer and the installation shall be performed according to the Weld County Individual Sewage Disposal Regulations. 3. In the event the septic system requires a design capacity of over 2,000 gallons of sewage per day the applicants shall provide evidence that all requirements of the Water Quality Control Division (WQCD) of the Colorado Department of Public Health and Environment (specifically Policies WQSA-6 and WQSA-8 ) have been satisfied. Evidence of compliance shall be provided to the Weld County • EXHIBIT 2008-1893 1 /„ . Department of Public Health and Environment. Alternately, the applicant can provide evidence from the WQCD that they are not subject to these requirements 4. The applicant shall submit evidence of an Underground Injection Control (UIC) Class V Injection Well permit from the Environmental Protection Agency (EPA) for any large-capacity septic system (a septic system with the capacity to serve 20 or more persons per day). Alternately, the applicant can provide evidence from the EPA that they are not subject to the Class V requirements 5. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). • We recommend that the following requirements be incorporated into the permit as development standards: 1. Animal and feed wastes, bedding, debris and other organic wastes shall be disposed of so that vermin infestation, odors, disease hazards, and nuisances are minimized. Such wastes shall be removed at least weekly from the facility and disposed by a commercial hauler. 2. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 3. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 4. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. • 2 • 5. The applicant shall operate in accordance with the approved "waste handling plan". 6. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved dust abatement plan at all times. 7. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in 25-12-103 C.R.S., as amended. 8. Adequate handwashing and toilet facilities shall be provided for patrons of the facility. 9. Sewage disposal for the facility shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 10.The installation of the septic system shall comply with the Weld County I.S.D.S. flood plain policy. 11.The facility shall utilize the existing public water supply. Our comments and requirements are as follows: COMMENTS: WCR 43 is a paved collector road and requires an 80-foot right-of-way at full build out. There is presently a 60- foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. Our most current average daily traffic count (ADT) reflects 510 vehicles taken in a 24-hour period in 2005 on WCR 43 just north of this location. This USR application will add an additional 150 vehicle trips during events. EQUIREMENTS: Storm Water Drainage: The current steel building 198' x 325' (roping arena and stalls), 8" wide x 3' deep grade beam around all exterior walls, the building sits on piers and footers at a depth of 53" below the finished floor elevation of 4807.0' with a dirt interior floor, and compacted fill all around the building tapered down at a 10% slope, within the Lone Tree Creek 100-yr Federal Emergency Management Agency (FEMA) regulated floodplain. The building has a Flood Hazard Development Permit (FHDP) #399 dated April 13, 2001, along with a FEMA Elevation Certificate stamped by Kenneth R. Alles Professional Land Surveyor (PLS) #9644, dated December 12, 2001 the Base Flood Elevation per the certificate is 4806'. The applicant will need to apply for another Flood Hazard Development Permit (FHDP) for any future structures or fill to be located in the 100-year floodplain shown on FEMA's FIRM map(s) that include the site. If they propose any fill in the floodplain (for structures, driveways, other construction), they will need to provide evidence in the form of a hydraulic analysis to ensure no construction is within the floodway and that the fill does not block flow and cause any flooding impacts on adjacent properties or roadways. All storm water detention facilities shall be designed to detain the storm water runoff from the fully developed USR from a one-hundred-year storm and release the detained water at a rate not to exceed the rate of a five- year storm falling on the undeveloped site. (Weld County Code Ordinances 2001-1; 2003-10, and 2006-7). All storm water must be detained on site and follow the requirements per Weld County Code 24-7-130 D and Ordinance 2006-7. Since this entire USR site is within the 100-yr floodplain Public Works will waive the above requirement and require the applicant to detain the fully developed USR from a ten-year storm and release the detained water at a rate not to exceed the rate of a five-year storm falling on the undeveloped site. The ,pplicant shall also provide Water Quality Capture Volume in addition to the detention requirement. The etention pond shall capture the roping arena, stalls, parking lot, and area delineated as part of this USR stormwater runoff. It shall be located to gravity flow into the Lone Tree Creek thalweg, it shall be outside the 10-yr storm floodplain limits and any overtopping shall be properly protected to prevent erosion and failure. • • No berming will be allowed to create the detention pond. A drainage report will be required with supporting •ata and calculations for these requirements. Public Works strongly suggests that the existing arena building install flood vents per the following: 1. Per guidelines published in Title 44 of the Code of Federal Regulations, Section 60.3, Section C, Part 5 (44 CFR 60.3.c.5): a. There shall be a minimum of 2 openings on at least 2 walls. b. Flood vents shall have a total net area of no less than 1 square inch of venting for every 1 square foot of enclosed area. c. The bottom of the opening shall be no higher than 1.0 ft above the adjacent grade. d. The final (as-built) flood venting design shall be certified by a registered professional engineer (P.E.). e. Openings may have screens, valves, or other covers that permit automatic entry and exit of floodwaters. Signs shall be placed around the detention pond to notify drivers of its location. A stop sign shall be placed at the intersection of WCR 43 and the driveway into the Arena to stop westbound traffic to help safe entry on the WCR 43 which has a posted speed limit of 55 mph. Place signs to indicate where the trucks and trailers are to park. is recommended that the applicant wet down the driveway with a water truck before, during and after events o prevent excessive dust in the air and blowing onto neighboring properties. Alternative scales shall be approved by the Department of Planning Services. Minimum font for all lettering is 8 pt. Capital lettering, 10 pt. is better suited for upper and lower case. Section 23-3-50.B and Section 23-3-50.C of the Weld County Code addresses the required setbacks and offset bulk requirements. • Improvements adjacent to the North property line appear to encroach onto lands under the ownership of Craig and Cami Weidel. The applicant shall provide evidence that the associated improvements meet or exceed the minimum offsets per the Weld County Code. Section 23-3-250.A.1 Stormwater Management. All users of land shall provide and maintain stormwater detention facilities designed to retain the stormwater runoff in excess of historic flow from the developed site. The stormwater retention facility on a developed site shall be designed for a one-hundred- year storm. The stormwater retention facility shall be designed and operated to release the retained water at a quantity and rate not to exceed the quantity and rate of a five-year storm falling on the undeveloped site. The application materials do not specifically address this issue, stating that the surface water flows east into the adjacent borrow ditch where it is piped for discharge into an adjacent field. The applicant shall contact the Storm Water Engineering Staff of the Weld County Department of Public Works, to further discuss this issue. Written evidence of compliance shall be submitted to the Department of Planning Services. This facility also is within the Floodplain/ Floodway zone of the Lone Tree Creek. Additional information may be required from the Floodplain Administrator for the County. The applicant shall contact the Floodplain Engineering Staff of the Weld County Department of Public Works, to further discuss this issue. At a minimum, the applicant will need to apply for a Flood Hazard Development Permit(FHDP)for any structures to be located in the 100-year floodplain shown on FEMA's FIRM map(s)that include the site. If fill is proposed in the floodplain (for structures, driveways, other construction), the applicant will need to provide evidence that the fill does not block flow and cause any flooding impacts on adjacent properties or roadways. Written evidence of compliance and/or • mitigation shall be submitted to the Department of Planning Services. • • The application states that there may be approximately one hundred fifty (150) people and approximately two hundred ten (210) animals of which 10-15 horses are on premises each day. • (An additional 120 steers in holding pens and 75 event horses) are on site for the events. Both people and animals arrive on site via pick-ups with trailers and personal vehicles. Section 23-2-240.A.6 and Section 23-3-250.A.2 of the Weld County Code address the issue of parking. Section 23-3-250.A.2 states "Parking. Sufficient screened, off-street, paved parking areas shall be provided in the Commercial Zone Districts to meet the requirements of employees, company vehicles, visitors and customers of the Uses Allowed by Right and accessory uses." Appendix 23-B addresses the parking requirement. For the Indoor Roping Arena, of approximately 68,000 square feet, the required parking for this facility shall be one parking stall for each five hundred (500) square feet of facility. In this situation, total parking shall be one hundred thirty-six (136) spaces, of which thirty-four (34) spaces shall be for trailers. The minimum dimension shall be ten (10) feet in width and thirty-five (35) feet in length and shall be unobstructed from the surface to a height of at least fifteen (15) feet. For the Outdoor Roping Arena, of approximately 45,000 square feet, the required parking for this facility shall be one parking stall for each five hundred (500) square feet of facility. In this situation, total parking shall be ninety (90) spaces, of which twenty-two (22) spaces shall be for trailers. Total parking for the indoor and outdoor arena's and the associated trailers shall be 282 combined trailer and vehicle parking spaces. The applicant shall submit a parking layout plan for review by the Departments of Planning Services, Public Works and the Emergency responder for this area. Written evidence of approval shall be submitted to the Department of Planning Services. The applicant shall adhere to the minimum requirements design standards of the Americans with Disabilities Act specific to accessible sites and exterior facilities: new construction. • The single point of ingress and egress and storm drainage shall be addressed by the Department of Public Works. The Eaton Fire Protection District may have concerns with the single point of access and may require secondary and tertiary access points for emergency responses. Should the employee numbers increase, the parking requirement shall be structured according to Appendix 23-B of the County Code. Written evidence of compliance shall be submitted to the Department of Planning Services. The applicant is not proposing any landscaping for the facility. Section 23-3-250.A.5.a states "No more than eighty-five percent (85%) of the total area of a Lot shall be covered. Land shall not be deemed covered if it is used for growing grass, shrubs, trees, plants or flowers or if covered by decorative gravel or wood chips, or if it is otherwise suitably landscaped. It is unclear from the applicant's drawing whether the property is landscaped. Section 23-3-250.A.5.b states "That portion of a lot which abuts a public or private street right- of-way shall be landscaped for a distance of ten (10) feet, measured at a right angle from the lot line towards the interior of the lot. Sidewalks and driveways may pass through the required landscaped areas. It is unclear from the applicant's drawing whether the property is landscaped as noted. Written and /or graphic evidence shall be submitted to the Department of Planning Services for review and approval. Section 23-3-250.A.6 states "Areas used for trash collection shall be screened from public • rights-of-way and all adjacent properties. These areas shall be designed and used in a manner that will prevent wind- or animal-scattered trash." It is unclear from the applicant's drawing • • whether the trash collection area is screened from the public rights-of-way and adjacent properties. Written and /or graphic evidence shall be submitted to the Department of Planning • Services for review and approval. Section 23-3-250.A.7 Water Supply. Uses shall have an adequate source of potable water. The application materials state that water is provided via a North Weld County Water District water tap. The applicant shall meet the requirements of the Weld County Department of Public Health and Environment at all times. Written evidence of compliance shall be submitted to the Department of Planning Services. Section 23-3-250.A.8 Sewage Disposal. Uses shall have adequate sewage disposal facilities. The application materials state that individual sewage disposal systems (ISDS) will handle the effluent flow for the residence and that portable toilets are to be used for the two roping arenas. The use of portable toilets is limited to periods of 6 months or less in time and given the permanency of this facility, alternative disposal options should be fully investigated. Further, the applicant shall meet the requirements of the Weld County Department of Public Health and Environment. Written evidence of compliance shall be submitted to the Department of Planning Services. Section 23-3-250.A.9 addresses "Outside storage. Uses involving outdoor storage of vehicles, equipment or materials when permitted shall be screened from public rights-of-way and all adjacent properties." It is unclear from the applicant's drawing whether there is an area for outdoor storage. Written and /or graphic evidence shall be submitted to the Department of Planning Services for review and approval. • The applicant shall prepare a waste management and manure management plan to the Weld County Department of Public Health and Environment for review and approval prior to the Board hearings. Section 23-3-250.B addresses Operation Standards. The hours of operation will vary as stated in the application materials. For evening events, activities begin at 6P and will be over by 11P, with the day events commencing at 7P and be over by 9P. Staff requests clarification on the hours of operation, including the set-up for operations, tear down of event operations, clean-up, acceptance of material delivery and the days per week or month that the facility will operate. Substantial additional information is requested on the physical operations of this facility, thereby enabling staff to accurately assess the impacts and uses of the facility. Section 23-3-350.B.1 Noise. Uses and structures shall be located, designed and operated in accordance with the noise standards as established in Section 25-12-101 C.R.S. The applicant shall meet the established standards set by the Weld County Department of Public Health and Environment. Section 23-3-250.B.6 addresses the issues of Light. "Any lighting, including light from high temperature processes such as welding or combustion, shall be designed, located and operated in such as manner as to meet the following standards: sources of light shall be shielded so that beams or rays of light will not shine directly onto adjacent properties; neither the direct nor reflected light from any light source may create a traffic hazard to operators of motor vehicles on public or private streets; and no colored lights may be used which may be • confused with or construed as traffic control devices." It is unclear from the applicant's drawing whether there is an any exterior lighting. The applicant shall provided written and /or • • graphic evidence to the Department of Planning Services for review and approval. A Lighting Plan may be required. • Section 23-3-250.B.7 states "Property shall be maintained in such a manner that grasses and weeds are not permitted to grow taller than twelve (12) inches. In no event shall the property owners allow the growth of noxious weeds. (Weld County Codification Ordinance 2000-1) The applicant has delineated any on-site sign. The property identification sign shall adhere to Section 23-4-90.A and Section 23-4-90.6 of the Weld County Code. One identification sign per principal use shall be allowed, provided that the sign does not exceed sixteen (16) square feet in area per face. Further, the location of the sign, shall be delineated on the Use by Special Review Permit Plan Map. All structures, including signs, on site must obtain the appropriate building permits and meet the appropriate zone district setbacks. The applicant shall enter into an Improvements Agreement according to policy regarding collateral for improvements and post adequate collateral for all transportation (access drive, parking areas, etcetera) and non-transportation (plant materials, fencing, screening, etcetera). A building permit shall be obtained prior to the change of use. • 2. A plan review is required for each building for which a building permit is required. Plans shall include a floor plan. Building plans shall also be submitted to Eaton Fire Protection District. 3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County: 2006 International Building Code; 2006 International Mechanical Code; 2006 International Plumbing Code; 2006 International Fuel Gas Code; and the 2005 National Electrical Code and Chapter 29 of the Weld County Code. 4. The buildings will probably be classified as follows: A-3/U Occupancy There are no occupancy separation .The U occupancy arena and horse stalls is approximately 60,000 sq ft, and mezzanine and lower floor is approximately is 10,000 sq ft is A-3 Occupancy. The structure was built in 2001 under Permit BC-01000217, 65,000 structural steel building used for personal roping area. Plans should include detailed drawings showing the exiting and how accessibility will be maintained through out the facility. 6. Building height shall be measured in accordance with the 2006 International Building Code for the purpose of determining the maximum building size and height for various uses and types of construction and to determine compliance with 2006 International Building Code. After preliminary review and site inspection. The structure will probably be required to adhere to Chapter 9, Sec 903.2.1.3 of the 2006 International Building Code for Fire Suppression .The structure would be required to have a sprinkler system. A sprinkler system will not be required and unlimited size is permitted per section 507.3 of the 2006 International Building Code based on the information given in the land use application.The occupant load in the mezzanine needs to be posted addressing a maximum load of 150 occupants and have two exits.
