WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public meeting
held on the 10th day of June, 1981 in the Chambers of the
Board of County Commissioners of Weld County, Colorado, that
the division into two parcels of land, as shown on the plat
known as Recorded Exemption No. 505, being the property of
John O. P. Miller and Kathryn L. Miller, described as part
of the SW4 of Section 10, Township 6 North, Range 67 West of
the 6th P.M. , Weld County, Colorado, being more particularly
described as follows:

within the purposes of the Weld County Subdivision Regulations
and the Board desires to exempt this particular division of
land from the definitions of "subdivision" and "subdivided
land" pursuant to its authority under Section 30-28-101 (10) (d) ,
CRS 1973, as amended, and Section 2-1A(3) of the Weld County
Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado that the hereinabove
described parcel of land owned by John O. P. Miller and
Kathryn L. Miller be, and hereby is, exempt from the definition
of the terms "subdivision" and "subdivided land" pursuant
to its authority under section 30-28-101 (10) (d) , CRS 1973,
as amended.
The above and foregoing Resolution was, on motion duly
made and seconded, adopted by the following vote on the 10th

Dear Commissioners:
The attached application, plat, and related items are in reference to a
request from John Miller for a recorded exemption. The parcel of land
on which this request has been made is described as part of the SW1 ,
Section 10, T6N, R67W of the 6th P.M. , Weld County, Colorado. This
property is located 14 mile east of the northern boundary of the town of
Windsor at 9195 Weld County Road 70. The property contains approximately
3.90 acres of Class IV nonirrigated soils. The request is to split the
property into parcels of 1.94 acres and 1.96 acres.
The applicant has submitted a letter which sets forth the reasons why
this request has been made. There is an existing residence located
on the proposed Lot A. No improvements are located on the proposed
Lot B at the present time.
On April 19, 1981 the Department of Planning Service's staff submitted
a recommendation to the Board for a previous request on this property.
Nothing has been submitted which would cause the staff to change its
recommendation for approval.

Dear Members,
My application for a lot split by Recorded Exemption was denied on April 22nd,
1981 by a 2-2 vote of the Board of County Commissioners. On May 11th, 1981 a
request for reconsideration was denied.
I still believe that my request is valid and reasonable for the reasons enumerated
below and I therefore respectfully resubmit my request.
1. The full Board was not present at the initial hearing and I therefore believe
that this factor denied me a fair hearing.
2. The property is located approximately 1000 yards from a point contact with
the city limits of the Town of Windsor. At their April, 1981 meeting the
Town of Windsor Planning Board considered the requested land split and
unanimously gave their approval in support of the proposed land split as
the additional lot formation would not cause the Town any problems from the
standpoints of growth and or other considerations.
3. The major objection as stated by some of the Commissioners appears to be
based iron considerations of whether the use of the Recorded Exemption was in
this case an effort to circumvent the subdivision regulations. I should
like to make the following observations in this regard:
a) The proposed split would yield 2, two acre parcels, which, due to their
shape and size, have only 250 feet of road frontage on County Road 70
for each lot, a further split of a later date would not be possible due
to the requirement that a building site must have 180 feet of road
frontage.
b) Although an argument can be developed that the original 10 acre parcel
of land of which this subject property is a part, should have been
subdivided in 1976 rather than divided by Recorded Exemption, the
reasoningin 1976 was valid for creating the two smaller parcels, namely
the 6 and subject 4 acre lots, and therefore RE 191 was approved.
Subsequently several changes have come about which necessitate a
reconsideration of the original plans and intentions.
i) As argued by Mr. Kruger in January of this year when RE471 came
before the Board (the same argument applies in my case) the loss of
the ability to run irrigation water by court decree made the ability
to maintain 6 acres, or four in my case, financially impractical.
ii) In 1976, the size of the two parcels was ideal for the raising of
Livestock. With the loss of water rights the additional 2 or 3 acres
of unirrigated land is non productive as pasture and if not utilized
as a sigle family residence this land will simply become acres of
unattended land.
c) There is no reasonable way in which the subject 4 acres can be subdivided
to yield more than the proposed two lots.
d) Access to the property is via County Road 70, and as previously
determined in Mr. Krugers' case, the local farmers using this road have
stated no objections.
e) The land immediately to the north of the entire original 10 acre parcel
would remain unaffected by my proposed split as future subdivision or
expansion of the Town of Windsor would not be inhibited as the logical
access to the northerly propertyis onto County Road 19. Land to the
east of my property would by virtue of natural barriers, have to have
access several hundred yards further east on County Road 70.
4. The split of my four acres into 2, two acre parcels is logical and reasonable
and should be viewed in the light of the current sityation. I should not be
asked to bear the brunt for actions taken in the past by other parties.
5. I accept that there is a feeling amoung some Board members that the use of
the Recorded Exemption as a means of establishing new lots in this area must
at some point come to an end. This is the last possible split in this
particular area anyway:
6. The Board has already set the trend, especially in this 10 acre area by
allowing RE 471, which was by the way accented by a 4-1 vote. Again I
feel that I have been descriminated against and made to bear the brunt and
to suffer the consequences for the actions of others.

7. Electricity, Water and Telephone lines are currently servicing the homes
located along County Road 70. The only missing service is that of sewer
lines which if installed at some future date would cause no serious problems
for the residents who could simply tie into such lines at that time.
8. The Board requested the opinions of both the Planning Boards of Windsor and
Weld County. Both Boards have given the matter careful consideration and
both have recommended approval. Why waste everyones time and money if you
do not plan to take their conclusions into account?
In conclusion I ask that the County Board of Commissioners give this matter
their careful consideration.

of land on which this request has been made is described as part of the
SW1S, Secion 10, T6N, R67W of the 6th P.M. , Weld County, Colorado. This
property is located lz mile east of the northern boundary of the town of
Windsor at 9195 Weld County Road 70. The property contains approximately
3.90 acres of Class IV nonirrigated soils. The request is to split the
property into parcels of 1.94 acres and 1.96 acres.
The applicant has submitted a letter dated March 27, 1981, which sets
forth the reasons why this request has been made. There is an existing
residence located on the proposed Lot A. No improvements are located
on the proposed Lot B at the present time.
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services staff recommends this request
be approved for the following reasons:
1. The request is in compliance with the policies of the
Weld County Comprehensive Plan in that to minimize con-
flicting land uses, residential development will be en-
couraged to locate adjacent to existing towns and in
accordance with the comprehensive plans and stated wishes
of each community. The parcel of land is located adjacent
to the incorporated boundaries of the Town of Windsor and
is located in the Comprehensive Plan Area of Windsor. The
Windsor Planning Commission has set forth no objections to
this request.

2. The request conforms with Section 9-2 of the Weld County
Subdivision Regulations (intent clause of the recorded
exemption procedure) , and Section 3.3.A. of the Weld
County Zoning Resolution (intent clause of the Agricultural
Zone District) , in that the use will be compatible with
surrounding agricultural uses. The parcel has a low utility
for agricultural use due to the small size of the parcel and
lack of irrigation.
3. The request complies with the provisions of Section 9-4 A.
of the Weld County Subdivision Regulations.
The Department of Planning Services Staff has concerns regarding the issue
of evading the intent and purpose of the Weld County Subdivision Regula-
tions through the use of the Recorded Exemption Procedure. On December
17, 1975 Mr. Kruger obtained approval of a recorded Exemption on 10.88
acres to divide the property into parcels of 6.293 acres and 3.9 acres. ,
On February 4, 1981, the Board of County Commissioners approved a request
by Mr. Kruger to divide the 6.293 acre parcel into two parcels of 3.29
acres and 3.0 acres. The request under consideration today is whether
or not to allow further subdivision of the 3.9 acre parcel. It is the
opinion of the Department of Planning Services Staff that before approval
of the recorded exemption is granted, the issue of evading the intent and
purpose of the Weld County Subdivision Regulations should be dealt with
to the satisfaction of the Board of County Commissioners.

Dear Sirs:
I am enclosing my application to divide Lot B of recorded exemption number
087-10-3-RE109, which was approved on December 17, 1975. The Lot B parcel
(Lot Aj6 acres subsequently broken down to 2 - 3 acres lots) comprises of
just under four acres and is zoned agricultural. It is, however, totally
' unfeasable to use this property as farm ground. In a Weld County District
Court hearing, civil action number 30225, the right to convey irrigation
water to the property across adjacent land was denied. There is , there-
fore, no method to convey irrigation water to the property. The property
is located on the edge of the town of Windsor.
The original ten acre property would, with the approval of this application,
result in there being four rural agricultural lots on the original ten
acres. ie. 2 x 3 acre lots and 2 x 2 acre lots requested here.
The entire area is served domestic water by the North Weld County Conservancy
District. It is prohibitavily expensive for an individual home owner to
maintain four acres of property in a decent state of landscaping when paying
domestic water prices for such land, as two 2 acre sites the quality of the
area can be maintained.
It is my opinion that should this request be denied the adjacent two acres
on the proposed Lot B will become vacant ground. By spliting into two 2
acre parcels I believe the area will be maintained in a reasonable manner
and will not cause any problem for the surrounding farming community.
