A public hearing was conducted on April 21, 2008, at 9:00 a.m., with the following present: Commissioner William H. Jerke, Chair - EXCUSED Commissioner Robert D. Masden, Pro-Tem Commissioner William F. Garcia Commissioner David E. Long Commissioner Douglas Rademacher Also present: Acting Clerk to the Board, Jennifer VanEgdom County Attorney, Bruce Barker The following business was transacted: I hereby certify that pursuant to a notice dated April 4, 2008, and duly published April 9, 2008, a public hearing was conducted on April 21, 2008, to consider granting the franchise application of Comcast of Colorado IV, LLC, Comcast of Colorado I, LLC, and Comcast of California/Colorado/Washington I, Inc., including, but not limited to, non-exclusive rights to further construct or update a cable television system along the streets, alleys, and public right-of-way of the County. Bruce Barker, County Attorney, made this a matter of record, and stated pursuant to the Weld County Code, a public hearing must be conducted regarding the granting of a cable television franchise. He stated Comcast has held franchises within Weld County for a number of years, within a variety of areas, and this new franchise will consolidate three franchises into one. He indicated he has been working with Janet Rinaldi of Comcast in order to provide a similar format to the franchise agreement approved by the City of Greeley. He stated Comcast mainly provides service within the area immediately adjacent to the City of Greeley, as well as within the municipal limits of the City. He further stated Comcast has met all of the requirements, therefore, he recommended approval. In response to Chair Pro-Tem Masden, Mr. Barker indicated the agreement is exclusive with respect to the cable franchise within the contracted area. Further responding to Chair Pro-Tem Masden, Janet Rinaldi, Director of Government Affairs for Comcast Cable, clarified the agreements are non-exclusive, since the company is not allowed to obtain exclusive agreements; therefore, any other operator may also build the necessary infrastructure to serve the area. She stated the franchise fees are in the amount of five percent of the gross revenues received from subscribers, and this franchise will combine three separate franchises into one franchise. She clarified there were originally three separate franchises due to the three separate providers which serve the Cities of Longmont, Loveland, and Brighton. In response to Chair Pro-Tern Masden, Ms. Rinaldi indicated the length of the franchise agreement is ten years, and the County has historically received less than $50,000.00 per year in franchise fees from a subscriber base of approximately 1,600. 2008-1160 ORD94 HEARING CERTIFICATION - FRANCHISE APPLICATION FOR COMCAST OF COLORADO PAGE 2 No public testimony was offered concerning this matter. Commissioner Rademacher moved to grant the cable television franchise to, and approve the Cable Franchise Agreement with, Comcast of Colorado IV, LLC, Comcast of Colorado I, LLC, and Comcast of California/Colorado/Washington I, Inc., and authorize the Chair to sign. Seconded by Commissioner Garcia, the motion carried unanimously. There being no further discussion, the hearing was completed at 10:15 a.m. This Certification was approved on the 23rd day of April, 2008.
