The Red Baron PUD PF1o3$,to include seven residential lots,was recorded on 6/21/2004. To date,three lots have been sold,one is scheduled for construction by the developer this summer, and three lots remain on the market for residential sales. Our desire at this time is to amend the original PUD zoning to include six residential lots and one commercial lot. I did discuss this project with Kim Ogle several months ago and was instructed to begin the amendment procecc with the Change of Zone phase. The C-2(General Commercial)zoning would be designated for Lot #7. This lot was purchased for the purpose of relocating the Vintage Aero Flying Museum from Platte Valley Airpark to a more suitable location_ Initially the collection of WWI memorabilia,uniforms and aircraft was housed at Platte Valley for storage purposes. When the collection became better known and popular it transitioned to a Museum showcase. Platte Valley Airpark is zoned commercially, but not specifically for the C-2 category. More importantly,the location at Platte valley did not allow for any future expansion: For this reason,the Lafayette Foundation,owner and operator of the collection, purchased Lot # 7 for continued development and expansion of the Vmtage Aero Flying Museum. This location allows adequate hangar space for both the WWI and WWII collection materials and aircraft and also affords future space for an additional Museum/Event facility. Appropriate research and engineering has been completed to confirm that an adequate water supply, etc., is available for this commercial operation. The Lafayette foundation is aware that a Use by Special Review Permit will be required for the Museum operation. At this time, I would like to request that a variance be approved by the Planning Department to combine the application and documentation required for the PUD Amendment and Use By Special Review into one process since many of the requirements are identical. The advantages of this proposal are considerable for all parties. It reduces the paperwork by half both in preparation and review by the County. It eliminates the need for two separate hearings with the Planning Commissioners and County Commissioners. Also,the variance would combine the necessary public notification and signage,mineral notification,etc.rather that duplicating the same project information. Both parties would meet with the Planning Department and review the application requirements to determine which ones would be combined into a joint Amendment/Special Use project. Finally,if this application protecs is allowed,the Lafayette Foundation and Red Baron Estates would still recognize the fee requirements for both permits. Thank you for your consideration. Environmental Impacts: Red Baron Estates has previously been developed with no environmental impact. The further development of Lot #7 to accommodate the Museum facility will create no additional impact as the build out and usage is similar to the adjoining residential usage with hangar construction and flying activity. As the development is a fly-in community, impact from aircraft noise will increase minimally in conjunction with the noise impact currently exhibited at the adjoining Platte Valley Airport. We do not foresee this as a negative impact due to the rural location and a history of positive reception from surrounding property owners. Waste materials from construction and commercial (Museum) activities shall be handled, stored and disposed in a manner that controls fugitive dust, blowing debris, odors, air pollution, and other potential nuisance conditions. • Exterior illumination of commercial buildings, homes, yards, accessory buildings, driveways, etc. shall be restricted as follows: a) Sources of light shall be shielded so that beams of light shall not shine directly onto adjacent properties. b) Neither the direct or reflected light from any light source may create a traffic hazard to operators of motor vehicles on public or private streets. Individual landscaping on the commercial site and adjoining home sites will enhance visual aesthetic impacts. There will be no electrical interference impact. Liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. Specifically, Lot #7 designated for commercial use as a Museum, will utilize a professionally designed waste water system. Attached is a copy of the Onsite Wastewater System (OWS) • design that has been reviewed and approved by the Weld County Department of Health and Environment. 1 Wetland removal, erosion, and sedimentation impact will be controlled with professionally engineered grading and drainage • guidelines. Specific drainage modification for Lot #7, to accommodate commercial usage, will be prepared by High Plains Engineering for approval from Weld County Public Works. In addition, natural vegetation maintenance will be in place on all undeveloped portions of the commercial site, individual home sites and agricultural out lot areas. Impacts from excavating, filling, grading, drilling, ditching, and dredging will be temporary during commercial and home site construction, and will be controlled accordingly. There will be little or no impact from wildlife and natural vegetation removal as the majority of acreage on the commercial and individual home sites and acreage in the Agricultural Out Lot A will remain in a natural state. There will be no impact from radiation/radioactive material. Water requirements for commercial and residential use will be satisfied by individual well service on each lot. All uses within the PUD shall maintain compliance at all times with the Colorado Division of Water Resources requirements/standards. • Traffic impacts from residential lots will be minimal due to a limited number of six residential sites and the nature of the fly-in community resulting in air traffic. Traffic impact from the commercial lot #7 will be minimal on a week day basis, with increased activity on weekends and with future special events. Increased traffic on WCR 39 accessing Red Baron Estates has been previously addressed with Public Works for the original PUD, resulting in a road improvement and dust mitigation plan proposed to commence after the residential lots are sold out. In addition, the completion of WCR 16 west to WCR 39 is scheduled in the coming months. Although the road is being built to provide a more convenient access to a different commercial operation, it will offer direct public access to Red Baron Estates and specifically to the Museum operation. B. Service Provision Impacts: 1 . Schools: Weld County School District Re-3J advised during the initial PUD process that no specific accommodations are required • for the proposed development in terms of future school bus activity. Rezoning Lot #7 for commercial use would not affect this determination. 2 2. Law Enforcement: Law enforcement services will be provided by • the Weld County Sheriffs office. The main access "Parks Lane" is properly identified by signage and on the Change of Zone plat. Road area has been designated to accommodate emergency access. 3. Fire Protection: A 20,000-gallon underground water cistern is in place enabling the Hudson fire Department to provide for fire emergencies. 4. Ambulance: Road access and individual lot identification will enable medical emergency vehicles to respond promptly. 5. Transportation: The external roadway bordering Red Baron Estates, WCR 39 to WCR 16, has been developed to county standards. In addition, the internal roadway and cul-de-sac-has been completed. As stated previously, additional access to Red Baron Estates and the Museum will be provided by the upcoming development of WCR 16 to the cul-de-sac on WCR 39. 6. Traffic: Impact for the residential development and the Museum operation will be minimal weekly with more activity on weekends and for special events. Access has been previously addressed. The • applicant is requesting a waiver from the Department of Public Works for the required traffic impact analysis at this time. 7. Storm Drainage: A report on drainage issues for Red Baron Estates as well as a storm drainage system design was prepared by High Plains Engineering and approved with the initial PUD. To accommodate the development of Lot #7 for commercial use, an appropriate grading and drainage exhibit specific to this lot will be prepared and submitted to Weld County Public Works for approval. 8. Utility Provisions: Electrical service for the subdivision has been provided by United Power of Brighton. A total of four (4) transformers with meter pedestals providing 200 amp service have been set in the recorded utility easements between lots 1 & 2, lots 3 & 4, lots 5 & 6, and lot 7. Telephone service has been provided by Qwest Communications and set at property lines in the recorded utility easements. Propane service is at the discretion of each individual lot owner. 9. Water Provisions: Each lot in Red Baron Estates is sold with a water decree for water supplied by the Denver Basin Laramie Fox- Hills formation, at a depth of approximately 770 feet. Lot #7 was • sold with a well permit. Appropriate water engineering research was completed by Red Baron Estates to assist the Museum in obtaining commercial well status. A copy of the water demand 3 study prepared by Leaf Engineering, Inc. will be included in the Change of Zone application with the well permit copy. • 10. Sewage Disposal: Each lot will have its own septic field designed per the I.S.D.S.R for Weld County. Specific to Lot #7, an Onsite wastewater system (OWS) has been designed and approved by Weld County Public Health. *See attached 1 1 . Structural Road Improvements Plan: Road right-of-way for possible future development of WCR 39 from the beginning of Red Baron Estates to State Highway 52 has been recorded with the Final Plat 1035. Direct road access to Red Baron Estates and specifically Lot #7 for rezoning has been addressed above in #5. C. Landscaping Elements: The Red Baron Estates development site, 43.5 acres, was previously a junkyard with no landscaping. Extensive cleanup resulted in a barren area with some natural vegetation returning. Lot size requirements, internal roadway and taxiways access prohibited any remaining open space that may have required public landscaping. Each individual lot owner is responsible for landscaping and maintenance. The development water plan allows for 5,000 square . feet of lawn and garden landscaping per lot. The remaining acreage on each site will remain in native vegetation to be maintained accordingly with mowing, weed control, etc. Landscaping maintenance requirements are outlined in the Protective Covenants. Commercial Lot #7 will be required to adhere to these same landscaping requirements and regulations. D. Site Design: The Red Baron Estates site is mostly flat land with a few minor elevation points, which will be used to complement home sites and enable better visibility of the runway and mountain view. The Museum site, Lot #7, had been prepared by the previous owner for hangar construction. Lot #7 is a corner lot ideal for commercial access without interfering with residential driveway access. The lot was already developed with a fully finished hangar when it was purchased by the Lafayette Foundation. There are three hangar buildings included in the proposed Museum complex project all of which will complement one another and blend aesthetically with Red Baron Estates. • No irrigation ditches are present on any portion of the property. 4 Red Baron Estates PUD PF 1035 and the proposed rezoning of Lot #7 is consistent with the goals and policies of Section 22-2-190 as • follows: Water well and septic, electricity, telephone, propane services, external and internal roadway access, signage, environmental impacts, public services such as postal, school, and health and safety issues have all been addressed and established accordingly. Red Baron Estates Protective Covenants will ensure a quality environment free of unsightly materials. Red Baron Estates will be compatible with surrounding land uses within the PUD Zone District. The six residential and the proposed commercial lot are bordered on the southeast and southwest by agricultural acreage. Red Baron Estates adjoins Platte Valley Airport on the north and is connected with taxiway accessibility to the airport runway, which runs parallel to the west property line. Red Baron Estates and specifically The Lafayette Foundation Museum (Lot #7) is being developed in conjunction with Platte Valley Airport, with each entity enhancing the other. Red Baron Estates and specifically Lot #7 are not located within a flood hazard zone per a review of Community Panels 900 and 1025. Additionally, the proposed development is not located within the geologic hazard or airport overlay district as identified by maps officially adapted by Weld County. As the proposed commercial and existing home sites adjoin Platte Valley Airpark, all development and building regulations, height restrictions, easements and setbacks from airport facilities have been established in the Protective Covenants per FAA regulations. E. Agricultural Out Lot Usage: Red Baron Estates is unique in its intent, that is to be a flying/fly-in community. The sole purpose for individuals purchasing one of the six residential lots will be for the pleasure and benefit of homeowners who wish to fly and enjoy their aircraft on a daily basis. Additionally, the establishment of a flight museum will provide recreational activities for residents and visitors alike. Due to the required acreage per lot to satisfy water and septic regulations, and land designated for road and taxiway requirements, there are no common open space areas directly within or accessible from the residential development. The • remaining 80 acres of undeveloped land in the PUD is located south of the residential development, running parallel with undeveloped WCR 39 and ending at State Highway 52. The unusual and narrow 5 • • configuration of the property, lack of irrigation water and public accessibility, renders it virtually impossible for any type of • recreational use. The most appropriate usage for the agricultural land will be animal grazing or non-irrigation farming. In lieu of these options, the agricultural out lot A will be maintained with weed control managed by Red Baron Development. Again, the low density and uniqueness of the flying/fly-in community and an on- site Museum presents little demand for additional recreational areas. The Red Baron Homeowners Association has been established. By- laws and Articles of Incorporation are available for review. The existing Red Baron Protective Covenants will be amended to reflect the change of zone for Lot#7, Estate to Commercial, and re- recorded with Weld County upon change of zone finalization. F. Signage: Signage for the Museum, Lot #7, will be minimal. An entrance sign will be located near the driveway entrance on the north lot line. Additional signage located directly on the hangar buildings will complete the advertising. All signage will be submitted to the Red Baron Estates HOA for approval prior to installation. • A single street sign pursuant to the Uniform Building Code is in place on the southeast corner of lot #1 in the designated easement locating "Parks Lane" and Weld County Road 39. A single stop sign, pursuant to the Uniform Building Code, is in place on the northeast corner of lot #7 in the designated easement. G. MUD Impact: N/A H.
