RE: HEARING FOR CONSIDERATION OF GRANTING THE FRANCHISE APPLICATION OF
K-2 COMMUNICATIONS, LLC
A public hearing was conducted on February 13, 2008, at 9:00 a.m., with the following present:
Commissioner William H. Jerke, Chair
Commissioner Robert D. Masden, Pro-Tem - EXCUSED
Commissioner William F. Garcia
Commissioner David E. Long
Commissioner Douglas Rademacher
Also present:
Acting Clerk to the Board, Jennifer VanEgdom
County Attorney, Bruce Barker
Assistant County Attorney, Cyndy Giauque
The following business was transacted:
I hereby certify that pursuant to a notice dated January 25, 2008, and duly published January 30,
2008, a public hearing was conducted on February 11, 2008, to consider granting the franchise
application of K-2 Communications, LLC, including,but not limited to,non-exclusive rights to further
construct or update a cable television system along the streets, alleys, and public right-of-way of
the County; however, said notice was not adequately published. At said hearing, the Board
deemed it advisable to continue the matter to February 13, 2008, to allow input from Cyndy
Giauque, Assistant County Attorney. At said hearing on February 13, 2008, Cyndy Giauque,
Assistant County Attorney, made this a matter of record and stated the Board granted the franchise
application in October, 2007, and held the required hearing; however,the notice of the hearing was
not physically published within the Fort Lupton Press, although it was intended to be. She
explained the matter has been republished, in order for public comment to be received from any
citizens who were not aware of the matter previously.
No public testimony was offered concerning this matter.
Mr. Barker indicated no further action is necessary, and there being no further discussion, the
hearing was completed at 9:55 a.m.

Bruce,
There really is nothing to scan. This is the item Cyndy and I discussed with you which
was previously approved on October 8, 2007 (#2007-3173) , but was later discovered that the
notice had not been published. We republished the matter for yesterday's hearing solely
for the purpose of allowing any public testimony from those who should have been notified
via the County legal newspaper. No action is necessary other than to make record that the
matter has been properly published and opened to the public for public testimony. To
satisfy the Board, I' ll scan in the notice and evidence of legal affidavit.
