WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Amendment to the Lease Agreement between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, and Vineyard Christian Fellowship of Greeley, Inc.,commencing October 1,2008,and ending November 1,2009, with further terms and conditions being as stated in said amendment, and WHEREAS,after review,the Board deems it advisable to approve said amendment,a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Amendment to the Lease Agreement between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, and Vineyard Christian Fellowship of Greeley, Inc., be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said amendment. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 29th day of September, A.D., 2008. Griego, Director, Human Servic/ Depar l/m��ent iiiig • COLORADO RE: Amendments to the Lease Agreement between the Weld County Department of Human Services and Vineyard Christian Fellowship of Greeley, Inc. Enclosed for Board approval is an Amendment to the Lease Agreement between the Weld County Department of Human Services and Vineyard Christian Fellowship of Greeley, Inc. This Agreement was presented at the Board's September 8, 2008, Work Session. The major provisions of this Agreement are: 1. The Amendment to the Lease provides for the Department's Building Healthy Marriages Program at the Vineyard Church. 2. The location of the space for lease is at 1011 9`h Avenue, Greeley, Colorado. 3. The rent shall remain the same at a rate of$1,331.67 per month;however,Vineyard Church is allowing additional space of 1,627 square feet. For the additional space,the Department agreed to replace carpet and make minor alterations. 4. The term of this Amendment to our Lease is effective October 1,2008 through November 1, 2009. The original Lease was from November 1, 2006 through November 1, 2009. If you have questions please give me a call at extension 6510. 2008-2619 Amendments to Lease Agreement This is an Agreement to amend certain provisions of a Lease Agreement dated October 3, 2005, between Vineyard Christian Fellowship of Greeley, Inc. , a Colorado non-profit corporation, and Board of Weld County Commissioners. WHEREAS, the parties to this Agreement, Vineyard Christian Fellowship of Greeley, Inc. , a Colorado non-profit corporation, (hereinafter "Landlord") and Board of Weld County Commissioners, hereinafter "Tenant" , desire to extend the term of the Lease Agreement entered into by the parties on November 1, 2006, (hereinafter "2006 Agreement") , and WHEREAS, the parties desire to amend the 2006 Agreement in certain respects, while leaving all of the non-amended original provisions of the 2006 Agreement in full force and effect; NOW, THEREFORE, in consideration of the mutual covenants and agreements made under the terms of the 2006 Agreement, (which is incorporated herein, except as amended) and under the terms of this Amendment, the sufficiency of which is hereby acknowledged, the parties hereto agree as follows: 1. RECITALS. The above set forth recitals are incorporated herein by reference as though fully set forth. 2 . PROPERTY - LEASED PREMISES. The parties agree that paragraph 1 entitled PROPERTY - LEASED PREMISES, shall be amended to state that Tenant shall lease an additional 1627 square feet from Landlord. The location of the additional square footage is located at 1011 9th Avenue, Greeley, Colorado. 3 . RENT. The parties agree that Tenant shall pay rent to Landlord in the amount of $1331.67, as set forth in paragraph 3 titled RENT DURING ORIGINAL TERM, of the 2006 Agreement. In addition, in lieu of paying rent to Landlord for the lease of the additional square feet, Tenant shall provide the following improvements to the 1627 square feet: a. New carpet shall be installed; b. A new baseboard shall be installed; c. The walls of the newly leased space shall be painted. The parties agree that the foregoing improvements shall be made only to the 1627 square feet and not to the 1880 square feet which was defined as the "leased premises" under the 2006 Agreement. The parties further agree that Tenant shall complete these improvements at any time prior to October 31, 2009. 4 . WIRELESS COMMUNICATIONS. Tenant will install at the leased premises and at Tenant' s cost, dedicated telephone line and/or data connections, and any additional communications link as Tenant may determine to be necessary. Tenant agrees to purchase, install and maintain any LAN/WAN equipment required for County employees. Tenant will be responsible for any modifications necessary for County employees at the leased premises, to acquire secure access for data/voice on the Weld County Network. Tenant may use existing hole in Northeast corner of building to pull data connection from roof. Tenant will be permitted to mount an antenna on the Northwest corner of the building for data connectivity.
