Weld County Public Works Department has reviewed this change to the CODE of Section 22-1-150 for the SE MUD
subparagraph 5). Comments made during this phase of the process may not be all-inclusive, as other concerns or
issues may arise during the remaining process.

analysis is to determine the project's cumulative development impacts, appropriate project mitigation and

Location: In the vicinity of CR 22 and CR 49.
Prior to the start of any construction, alterations, or change of occupancy;
1 A building permit application must be completed for each lot and two complete sets of
plans including engineered foundation plans bearing the wet stamp of a Colorado registered
architect or engineer must be submitted for review. A geotechnical engineering report preformed
by a registered State of Colorado engineer shall be required. A plan review shall be approved
and a permit issued prior to the start of construction on any of the planned lots.
2 The new structures shall conform to the requirements of the 2006 International Building
Codes, ICC/ANSI A117.1-2003 (Accessibility), 2005 National Electrical Code and Chapter29 of
the Weld County Code.
3 Setback and offset distances shall be determined by the 2006 International Building Code and
Chapter 23 of the Weld County Code (Offset and setback distances are measured from the
farthest projection from the structure).
4 Buildings located within a 100 year flood plane require a Flood Hazard Development plan.
6 An approval letter from the Fire District is required prior to issuing the permit.

Environmental Health Services has reviewed this proposal to create an amendment
procedure for the Southeast Weld Mixed Use Development Area Structural Plan, Map
2.1 Structural Land Use Plan.
Based upon a conversation, 3/13/08, with Brad Mueller of the Department of Planning
Services this amendment is a very large overview of the process to incorporate adjacent
lands into the SE MUD. As this amendment does require the applicant to demonstrate
that the site can be served by public water and sanitary sewer service, the Weld County
Department of Public Health and Environment has no objections to the proposal.

Dear Ms. Martin:
This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to
county planning directors, this office will only perform a cursory review of the referral information and
provide comments. The comments do not address the adequacy of the water supply plan for this
project or the ability of the water supply plan to satisfy any County regulations or requirements. In
addition,the comments provided herein cannot be used to guarantee a viable water supply
plan or infrastructure,the issuance of a well permit, or the physical availability of water.
Our office has no comments regarding the proposed Comprehensive Plan Amendment.

Dear Michelle:
Thank you for taking the time yesterday to discuss with me the proposed amendment
procedure for the Southeast Weld Mixed Use Development Area and the referral letter for the
application that was filed with Weld County by Pioneer Communities Inc. and HP Farms LLC
("Applicants").
I understand that the property that is known as Pioneer Farms includes an area known as
the Southeast Weld Mixed Use Development Area ("MUD") and that the Applicants have
proposed a procedure pursuant to which they could request amendments to either change land
use classifications within the MUD or expand the MUD to include additional lands, among other
things_
As you know, Anadarko E&P Company LP ("Anadarko E&P"), Anadarko Land Corp.
("Anadarko Land") and Kerr-McGee Oil & Gas Onshore LP, a wholly owned subsidiary of
Anadarko Petroleum Corporation (collectively the "Anadarko entities"), filed an objection letter
with the County dated October 23, 2006, concerning the application for PUD zoning for Pioneer
Farms. The Anadarko entities together own all of the minerals that underlie portions of the
property included within Pioneer Farms, and Kerr-McGee owns oil and gas leasehold interests
for lands within Pioneer Farms. The Board of County Commissioners approved the PUD zoning
application with the condition that the Applicants and the mineral interest owners either enter
into a surface use agreement or that certain default oil and gas operations areas under Colorado
statutes be identified.

The Anadarko entities note that the County recommends in its letter dated January 15,
2008, to Jack Reutzel, attorney for the Applicants, that the Applicants include in their proposed
procedure that applicants provide a certified list of owners of the surface estate that are within a
specified radius of the property. Presumably the County would use such a list to send out referral
requests and notices of hearings related to proposed amendments to the Southeast Weld MUD.
The Anadarko entities request that the County also require applicants to submit a list of
the applicable mineral interests owners and that either the County or the applicant provide notice
to mineral interest owners of hearings on applications. This is especially important in cases
where the proposed amendment is to either: i) change land uses within the Southeast Weld
MUD; or ii) add lands to the Southeast Weld MUD.
Note that in cases in which the application is to propose changes in land uses within the
Southeast Weld MUD, oil and gas operations areas and specified surface uses in a surface use
agreement that has been entered into between the Applicants and the relevant oil companies may
be impacted such that the oil companies would wish to make comments to the County. In cases
in which additional lands are proposed to be added to the Southeast Weld MUD, there may are
may not be a negotiated surface use agreement between the Applicants and the applicable oil
companies, and, in such cases, the relevant mineral interest owners would like to have the
opportunity to provide comments to the County.
Please send notices of future hearings on applications filed in connection with Pioneer
Farms pursuant to C.R.S. §31-23-215, C.R.S. § 24-6-402 (7) and C.R.S. § 24-65.5-101, et. seq.

EnCana Oil & Gas (USA) Inc. is in receipt of a Weld County Comprehensive Plan
Amendment document as it applies to the Southeast Weld Mixed Use Development Area
the vicinity of CR 22 and CR 49.
Please be advised that EnCana is in the process of conducting negotiations as to future
surface access/use with the representative of Pioneer Communities, the developer.
However, absent a Compatible Development and Surface Use Agreement, EnCana must
object to the planned development and/or amendment which may affect this surface.
Please place this letter of objection for the record with the Department of Planning
Services.
It is EnCana's desire and intent to continue and complete negotiations with Pioneer
Communities for the mutual benefit and compatible use of the surface for both parties.

I wish to submit the following information regarding the above referenced project.
X The concerns of Farmers Reservoir and Irrigation Company are in the area of
encroachment to the Right of Way of the canal. FRICO requires a minimum of 22' on
each side of the canal for a maintenance road plus the distance to the toe of the ditch
embankment. The boundaries of the Right of Way must be agreed upon.

developed storm flow into our canals.
