Comments made during this phase of the process may not be all-inclusive, as other concerns or issues may arise during the remaining process. All traffic analysis information and reports shall be prepared and certified by a Colorado resisted professional engineer competent in the traffic engineering and shall address impacts to on-site and off-site roadways including strategic roadways, within Weld County, State Highways and Interstate Highways if applicable. The intent of this analysis is to determine the project's cumulative development impacts, appropriate project mitigation and improvements necessary to offset a specific projects impacts. I understand that the property that is known as Pioneer Farms includes an area known as the Southeast Weld Mixed Use Development Area ("MUD") and that the Applicants have proposed a procedure pursuant to which they could request amendments to either change land use classifications within the MUD or expand the MUD to include additional lands, among other things_ As you know, Anadarko E&P Company LP ("Anadarko E&P"), Anadarko Land Corp. ("Anadarko Land") and Kerr-McGee Oil & Gas Onshore LP, a wholly owned subsidiary of Anadarko Petroleum Corporation (collectively the "Anadarko entities"), filed an objection letter with the County dated October 23, 2006, concerning the application for PUD zoning for Pioneer Farms. The Anadarko entities together own all of the minerals that underlie portions of the property included within Pioneer Farms, and Kerr-McGee owns oil and gas leasehold interests for lands within Pioneer Farms. The Board of County Commissioners approved the PUD zoning application with the condition that the Applicants and the mineral interest owners either enter into a surface use agreement or that certain default oil and gas operations areas under Colorado statutes be identified. Michelle Martin March 13, 2008 Page 2 The Anadarko entities note that the County recommends in its letter dated January 15, 2008, to Jack Reutzel, attorney for the Applicants, that the Applicants include in their proposed procedure that applicants provide a certified list of owners of the surface estate that are within a specified radius of the property. Presumably the County would use such a list to send out referral requests and notices of hearings related to proposed amendments to the Southeast Weld MUD. The Anadarko entities request that the County also require applicants to submit a list of the applicable mineral interests owners and that either the County or the applicant provide notice to mineral interest owners of hearings on applications. This is especially important in cases where the proposed amendment is to either: i) change land uses within the Southeast Weld MUD; or ii) add lands to the Southeast Weld MUD. Note that in cases in which the application is to propose changes in land uses within the Southeast Weld MUD, oil and gas operations areas and specified surface uses in a surface use agreement that has been entered into between the Applicants and the relevant oil companies may be impacted such that the oil companies would wish to make comments to the County. In cases in which additional lands are proposed to be added to the Southeast Weld MUD, there may are may not be a negotiated surface use agreement between the Applicants and the applicable oil companies, and, in such cases, the relevant mineral interest owners would like to have the opportunity to provide comments to the County.
