Dear Commissioners:
I am writing this letter on behalf of myself, Diane G.Wolfe and my sister Donna Wolfe to share our conrer'ns
with USR 1662. My property is located at 13292 WCR 38 1/2; Donna's is located at 13031 W' 1 38 [The
corner of SH 60 and CR 38). We are writing to object to USR 1662 being approved at this location for the
following reasons:
Referencing SECTION 22-1-50-CONTENT OF PLAN D3 b. industrial;SECTION 23-3-10-INTENT; SECTION
22-2-60 AGRICULTURAL GOALS AND POLICIES: Noble Energy is an industrial business. This is not an
industrial zone. It is Prime Farm Land in the agriculture zone. Agriculture is a valuable resource for our
community. Noble's business is not related to or dependent upon agriculture. This is not protecting prime
farm land.
Referencing SECTION 23-2-240-DESIGN STANDARDS AS; SECTION 23-2-160-SITE PLAN REVIEW:
The intersection at State Highway 60 and WCR 38 generates very high traffic volumes and a large number
of slow-accelerating vehicles - there are no acceleration and deceleration lanes to mitigate a potential traffic
hazard. Noble Energy indicates that CDOT and Public Works "believe they(Noble)will not have an impact on
the existing background traffic." Noble Energy's storage yard business will increase traffic. The application
states that CR 38 is primarily used by gravel trucks,farm vehicles, area residents and the sod farm. What
is not mentioned is the numerous dump trucks hauling dirt(in addition to the large gravel trucks),the dump
trucks/bobtail trucks hauling sludge/mud,water trucks,oil &gas equipment,just to name a few.

From CR 38 1/2 to CR 38 there is a very high traffic volume. It has increased over the past year. This goes
on all day - not just peak times, granted peak time traffic is much heavier,thus increasing the traffic hazard.
A&W Water's industrial business and Sand Platte and Gravel contribute to the heavy traffic (A&W operates
7 days a week. Sunday traffic is not as heavy as Monday-Saturday). It poses safety issues and is a traffic
hazard. Noble Energy's industrial business will contribute to these unsafe conditions. It isn't practical or
feasible to locate this Storage Yard in this area.
On many occasions we have seen trucks that don't stop at stop signs, or they"piggy back"to beat traffic.
That includes on A&W Water's property and at CR 38 and SH 60. For example, on July 21, 2008: 5 out of
8 sludge trucks did not stop at the stop sign exiting A&W Water's property; on September 18, 2008:4 out
of 5 water trucks did not stop at the sign exiting A&W Water's property. (PICTURE#2)
From February-July 2008 I documented, on 30 different occasions, a total of 736 trips in/out of A&W
Water's industrial site - counting only the water trucks and trucks dumping sludge on their property - I did
not count any other traffic going into/out of the site. Over the time documented,the average is 42.1 water
and sludge trucks per hour or 1 truck every 1.4 minutes. Of those 736 trips,613 entered or exited south
on SH 60. That is 83%of that traffic intersecting with CR 38 and SH 60. There are lulls at time, but not for
a lengthy time.Once they get into their rotation, it goes on all day. A CDOT traffic count conducted in 2007,
from Highway 256 to Highway 85 on SH 60 shows 3700 trips per day. The 2007 traffic count on CR 38,
from CR 251h to SH 60 is 377 trips per day. Noble Energy states "they were very conservative on their
estimation of 60 roundtrips per day." Those 60 roundtrips will have a major impact on the traffic at CR 38
and SH 60. If they only have 40 trucks one day,they could have 80 the next day to stay within their average.
This industrial business will add to the already unsafe and adverse conditions. Public Works indicates Noble
• drivers are to exit from their property onto CR 38 to SH 60 and continue north or south on SH 60". There is
no way to enforce or monitor that they are traveling north,south, east or west. There is no way to enforce
or monitor the number of trips per day.

Presently,there are a number of vehicles,approaching SH 60 from the west on CR 38. These vehicles turn
north or south onto SH 60, or continue east on CR 3B to Highway 85. (PICTURE#3)
• On SH 60, in order to alert the motoring public,there are no "heavy side road traffic", "caution: heavy truck
traffic"signage located anywhere near A&W Water's business(CR 38 1/2 and SH 60) or at CR 38 and
SH 60 where a large percentage of trucks and vehicles intersect. There are no signs on CR 38 or CR 38 1/2.
There are no acceleration or decelerations lanes,or turn lanes on SH 60 or CR 38 (west of SH 60). There
are no shoulders on SH 60 from Highway 256 to Highway 85. There is one spot on the west side of SH 60,
between CR 46 and CR 42 where someone could pullover if needed. Requirements from CDOT and the
COUNTY should be in place to comply with their standards for the type and amount of volume. There are
two large businesses currently causing adverse conditions - Sand Platte and Gravel and A&W Water.
When these large vehicles exit with a full load, it takes them a while to pick up speed,traffic gets backed up -
drivers get impatient and start swerving around to pass the trucks; or traffic gets backed up waiting for the
trucks to turn. This is not a safe environment and poses a risk for the safety and welfare of the motoring
public. (PICTURE#4)
Public works indicates they will recommend reducing the speed limit at the hill on CR 38,west of SH 60 plus
add signs indicating "trucks turning" and "blind hill". There is much concern for the safety of trucks, as well
as the safety of other vehicles at the intersection at CR 38 and SH 60 - in from all directions. Noble
Energy's industrial business will contribute to this traffic hazard area.
Referencing SECTION 22-4-40-AIR(CI: The dust is awful. The trucks that travel on CR 38 east to Highway
85 don't drive slowly. The bigger they are +the faster they drive = an enormous amount of dust. Visibility is
little to none. You can't open windows in the house for fresh air. Although Noble Energy will instruct their
drivers to utilize SH 60,there is no way to monitor that they will go north,south,east or west. Proceeding
east on CR 38 to Highway 85 will add to this nuisance condition. Additionally,the diesel fumes are present
on a regular basis throughout the day. (PICTURE#5)
• Referencing SECTION 23-2-250-OPERATIONS STANDARDS IA): The location, layout and design of this
USR will impact the noise in this area. Even with the attempt to minimize the noise, by placing their
tuboscope to the NE corner of the lot,with that type of equipment, loading and unloading will inevitably be
noisy. The trucks with their size and type, alone are noisy. You hear and feel them before you see them;the
windows rattle in the house;they back off their"fake brakes", honk the horns. Noble will add to the noise
with the additional trucks and loading/unloading the equipment.
Noble Energy is a large industrial business. They operate a large number of oil and gas wells and production
wells in the Denver-Julesburg DJ Basin area,with the vast majority in Weld County. Noble Energy's website
indicates that in 2008 the Company added 7000 additional acres. Weld County is approximately 4000
square miles in size and is second to Garfield County in drilling permits. With the newly acquired 7000
acres and the 4000 square miles in Weld County,there is a location better designed and suited for
industrial businesses where adverse conditions and traffic hazards are not present. This area is not
designed or zoned for industrial businesses.
There may be a need for them to have a storage yard, or to relocate a current facility, but not at this
location, on prime farm land or at this location which currently has a large industry in A&W Water and Sand
Platte and Gravel that contribute to these adverse traffic conditions and traffic hazards.
The Traffic Impact Summary Memo to Public Works concludes: "Based on the existing utilization of CR 38
and SH 60 and the limited additional daily trips,that the proposed activities will generate, it does not appear
that approving the proposed use would be detrimental to the safety or welfare of the motoring public in Weld
County." We have already seen the detriment to the safety and welfare of the motoring public in Weld
County at CR 38 and SH 60 - The daily additional trips for Noble Energy's industrial business will contribute
to these unsafe conditions.

We depend upon our Board of Commissioners to protect the health,safety and welfare of the COUNTY and
• help preserve prime farm land. We depend upon you to insure there is a safe environment for the residents
of the COUNTY. Approving USR 1662 for Noble Energy's Storage Yard for oil and gas support,would allow
this large industry to:
1) Be located in an agricultural zone, on prime farm land;
2) Be located in an area that is not designed or zoned for industrial uses;
3]Affect the safety and welfare of the motoring public;
4) Decrease the air and noise quality
5) Have a business that is not compatible with the area
We conclude by saying, unless a person is in this area day after day,they may not understand the reason for
our concerns. We see it,we hear it every day. It is a very serious situation that is affecting the health, safety
and welfare of the motoring public.
We object to USR 1662 being approved at this location.
