• This prosesdirg arises from the application of the Union Pacific
Railroad Conpaayi in oowpliares with 9setion 29 of the Public) Utilities Act
7 •oi Colorado, as asmied April i8, 1917. -for the abandoimeik of a=pnblia high-
way crossing-on, the section line- between Sections Twentp-four (24) and Twenty
fite (25), Township live (6) North, Range Sixty-fair (64) West where it inter-
sects the line of said railroad, which point is at Mile Post 145.29, Sterling
ISubditilion of Union Pacific Railroad, and for relocating the public higtmey .
at said crossing so u to connect with the public highway crossing over said
rai]road on the section lime between Sections Twenty-four (24) and Nineteen
(19), Ttemship Five (5) 'forth, Range Sixty-four (641 West. in accordance with
plain submitted with application. . This abardomsnt of said bruising and
Osage of location is alleged to be in amplitude with the Camission's-order
Ina Improrament of Grade: Crosling', in Colorado, 2 Colo. P.U.O. 128.

• the highway at the crossing that applicant desires to abandon is not a state
highway and, therefore, the State Highway Department is net involved in the
natter.
Attached to the application is a statement from the County Commis-
stoner. of Weld County, who have jurisdiction over said highway at crossing

'limb. it is desired'to abaadon'at Mile Toil 145.29, giving their consent to '
the abandonment of the crossing and rearranging the highway, as indicated in
the plan attached to the application designated as Inhibit l: ' • •
The•Cosmission`s engineer investigated the site of the crossing in
question on July. 29. 1925, and is of the opinion that the abandonment of the • •
missing and things of road to the other crossing referred to in the applies-
tion will be to the improvement. of the public safety and crossing facilities
at this point. Thee crossing proposed to be abandoned is at inch an angle with
- : the railroad as to add to. its dangerous features. while the proposed road to •
the other crossing will increase its safety, and this road arousing is at such .
an angle with the railroad as to be safer. Also a good'road can be oonotract-
ed, as shown on plan, with good visibility. The nearest ranch house. occupied '
by a Kr. Henry, is about one-fourth rile from this crossing, and he said he ,
had no objection to the change and did not ]mow of anyone like would have any
objections to the ohznge. -
• Since the change proposed in the application will be for the benefit
of the public and has the approval of all parties concerned therein, the Com-
. mission will, therefore, issue its order granting the abandonmment of the cross-
ing as herein requested.

that permission is hereby granted to ebaadon. the present crossing over the
track and night-ef-ny of the Union Pacific Railroad Company located at. a
point-on the section line between Sections Twenty-lour (24) and-Twenty-,4 n— -
• (25), township Dive (5) North, Range Sixty-four (64) West *here it inter •
sects said railroad at Mile Post 145.29, Sterling Subdivision of the Union
Pacific Railroad, and to change the crossing of aforesaid pablio highway to
a broiling of this public highway oar said railroad at a point where the

We therefore petition your honorable body to cause to be laid out and opened a County road as above
described, and we, the owners of the land through which said road is sought to be laid out, in consiieration
of the sum of one dollar to us each and severally in hand paid by the said County of Weld, the receipt of
which is hereby acknowledged, and of the laying out and opening of said road, hereby agree to give the right
of way through our lands as shown by the plat accompanying this petition, and relinquish all claims for
