CODE ORDINANCE 2008-2
IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 29
BUILDING REGULATIONS, OF THE WELD COUNTY CODE
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF
WELD, STATE OF COLORADO:
WHEREAS, the Board of County Commissioners of the County of Weld , State of Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority
of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, on December 28, 2000, adopted Weld
County Code Ordinance 2000-1 , enacting a comprehensive Code for the County of Weld, including
the codification of all previously adopted ordinances of a general and permanent nature enacted
on or before said date of adoption, and
WHEREAS, the Weld County Code is in need of revision and clarification with regard to
procedures, terms, and requirements therein.
NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of the
County of Weld , State of Colorado, that certain existing Chapters of the Weld County Code be, and
hereby are, repealed and re-enacted , with amendments, and the various Chapters are revised to
read as follows.

Amend Sec. 29-2-70. National Electrical Code.
The publication of the National Fire Protection Association, known as the National Electrical
Code, 2000"'.`*6 Edition , NFPA No. 70-20052008, is incorporated by this reference as a part of this
Building Code for the purpose of establishing standards for the inspection of electrical installations
and issuance of electrical permits in the County, with the following amendments:

Residential standards:
1 . Definitions.
Residential structures means any buildings which are Group R Occupancies as

Occupancies as ce9nec in the BC are exempt from the requirements of his

sheds, agricultural buildings, tanks and towers.
R-Value means the reciprocal of the average-overall coefficient of heat transmission
in British Therma knits (BTUs) per hour. The term is app iec to usua combinations

2. Insulation requirements.

f. Crawl spaces may be insulated by different methods as described below:
1 ) If a furnace is installed in the crawlspace, the foundation walls may

2) In an unheated crawlspace either the subfloor or the walls of the
crawlspace can be insulated. If the crawlspace walls are insulated,

The publication of the International Code Council, Inc. , known as the International Energy
Conservation Code, 2006 Edition, is incorporated by this reference as a part of this Building Code,
with the following amendments:
A. Amend Section 201 .3 by substituting "adopted Electrical Code" for the "ICC
Electrical Code" in all sections throughout this Code.
B. Amend Section 401 .3, first sentence as follows, "A permanent certificate shall be
posted in a conspicuous location on the job site."

Amend Sec. 29-3-70. Moved buildings.
A - No change.
B. In addition , the following items are required for moved buildings of Group R
Occupancies:
1 . Building/structural:
a. Egress windows and window wells shall be installed according to the
IRC and to the adopted Energy Code.
b through d - No change.
2. Insulation. Ceilings shall be insulated to R-191 -38. Walls that are opened
shall be insulated to R-11 have the cavity completely filled with insulation or
be insulated to R-19. Subfloors over unheated crawlspaces or side walls of
foundation stem walls shall be insulatedFoundations systems shall be
insulated according to Section 29-2-90 .A.2.f of this Chapter.
3. Mechanical. Mechanical systems and equipment serving the building,
heating , cooling, or ventilation needs shall comply with Section 403 of the
International Energy Conservation Code. Gas appliances must meet IMC
requirements for combustion air, venting , and required shutoff valves.
4. Glazing . Double-pane or storm windows shall be installedpresent
throughout the dwellings with safety glazing installed where required by the
IRC.
5. Electrical
a through c - No change.
d . Receptacles , as specified, shall be spaced and installed at locations
required by NEC.
e and f - No change.

g. Arc-fault circuit interrupter protection must be installed, as required
by the Electrical Code.
h. Electrical devices, fixtures, and penetrations shall be durably sealed
to limit infiltration , according to adopted Energy Code.

BE IT FURTHER ORDAINED by the Board that the Clerk to the Board be, and hereby is,
directed to arrange for Colorado Code Publishing to supplement the Weld County Code with the
amendments contained herein, to coincide with chapters, articles, divisions, sections, and
sub sections as they currently exist within said Code; and to resolve any inconsistencies regarding
capitalization , grammar, and numbering or placement of chapters, articles, divisions, sections, and
sub-sections in said Code.
BE IT FURTHER ORDAINED by the Board if any section, subsection, paragraph, sentence,
clause, or phrase of this Ordinance is for any reason held or decided to be unconstitutional, such
decision shall not affect the validity of the remaining portions hereof. The Board of County
Commissioners hereby declares that it would have enacted this Ordinance in each and every
section , subsection, paragraph , sentence, clause, and phrase thereof irrespective of the fact that
any one or more sections, subsections, paragraphs, sentences, clauses, or phrases might be
declared to be unconstitutional or invalid .
The above and foregoing Ordinance Number 2008-2 was, on motion duly made and
seconded , adopted by the following vote on the 12th day of May, A. D. , 2008.
