HomeMy WebLinkAbout800955.tiff • • RESOLUTION RE: ACCEPT WELD COUNTY ENGINEER' S RECOMMENDATION CONCERNING CITIZENS PETITION ON PEACEFUL ACRES SUBDIVISION. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, a citizens petition concerning streets in Peaceful Acres Subdivision has been submitted to the Board of County Com- missioners of Weld County, Colorado, and WHEREAS, the citizens have requested, through said petition, that the streets in Peaceful Acres Subdivision be graded, graveled and oiled in 1980, and WHEREAS, the Weld County Engineering Department staff has made several visits to the site to investigate the conditions at Peaceful Acres Subdivision, and WHEREAS, the Weld County Engineer finds that said Subdivision is bound on the East and South by high ditch banks and on the North and West by higher ground. Rain and snow have no place to drain, making the roads muddy until the water evaporates or percolates away, and WHEREAS, the Weld County Engineer recommends that the roads be graded smooth and that gravel be spread on the roads, and WHEREAS, the Weld County Engineer has further informed the Board that before this situation can be remedied, it will be necessary to design and construct a drainage system to collect and remove run-off from the subdivision. The most feasible way to correct the problem would be to form an improvement district. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the recommendation of the Weld County Engineer concerning the streets in Peaceful Acres Subdivision be, and hereby is, accepted, and that the petitioners shall be informed of the foregoing recommendation. 800955 The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 14th day of May, A.D. , 1980. COLORADO 80E COLORADO May 15, 1980 Mrs. Richard Lilland 550 Paden Lane Fort Lupton, Colorado 80621 Lamar Mrs. Lilland: This is in response to the recent petition submitted to the Board of Weld County Commissioners for improvements and maintenance to the streets in Peaceful Acres Subdivision. The enclosed Board resolution is furnished you for your information and dissemination to the other interested parties. The subdivision was visited to inspect the problem by Commissioner Carlson, myself, and the Engineering staff. It is clear that the most pressing need is to correct the drainage problem of being lower than all the surrounding property. A system to collect and remove storm drainage fran your streets is absolutely necessary to solve the problem of mud and ruts whenever it rains or snows. There is no place for the drainage to go except to lie on the streets until it evaporates or percolates away. The most feasible solution to this problem may be to provide a system of surface drainage with a retention pond at the low point of the subdivision that could pump out. A more elaborate solution would be to construct curb and gutter with an internal collection system of storm sewers. Either of these would take time; however, until sanething is done, any money spent on upgrading the streets would be wasted. The County does not have the resources to finance any such improverents. There is a provision under the state law, whereby the County may form an improvement district to do the engineering and construction of improvements with tte costs being allocated equitably among the residents of the subdivision. A copy of the applicable law is enclosed for information. In the meantime, the County will do the best it can on grading your streets when they are dry enough to work on. Mr. Willis Paden has stated that he would haul gravel fran the County gravel pit and put on the streets after they have bccn graded snwth. We will schedule further grading as often as possible, but not less than once a month. Several visits were made by the staff to the site to investigate conditions. This four block suhdivision is laid out in a dead flat area just south of Weld County Road 12 and west of old Highway 85 on Fort Lupton. It is bounded on the east and south by high ditch banks, and on the north and west by higher ground. Rain and melting snow literally have no place to drain, making the roads constantly muddy, until the water evaporates or percolates away. When dry weather permits, we can grade the roads smooth and spread a little gravel, but this will not solve the problem. The next time it rains, the streets will be saturated with run-off and become muddy a rutted again. I recommend that the petitioners be advised of the foregoing and the nood to design and construct a drainage system to collect and repave run-off from the snhiivision before any workable improvements can be made on the streets. The most feasible way to correct the problem would be to form an improvement district. In the meantime, the County will keep the streets graded when they are dry enough to work on. The developer has said that he will haul gravel to the streets if he can load at the County gravel pit.
