In addition to these requirements, the plat scale shall be 1" = 20 feet, with the Vicinity Map delineated at a scale of 1" = 2000 feet. Further, it is requested that a Legend of Symbols be employed to call out the specific equipment associated with this facility. The text on the submitted plat is difficult to read given the font selected. This application shall be in compliance with Section 23-3-350 and is address in the following comments, as applicable. Section 23-3-350 addresses the Design Standards applicable to this proposed facility. • Per Section 23-3-350.B, the applicant shall delineate all areas associated with outdoor storage. These areas shall be screened from adjacent properties and public rights-of-way. The applicant shall delineate an opaque visual screen on all sides of the property to mitigate the potential negative impact and aesthetic concerns on surrounding properties. Section 23-3-350.F addresses the setback and offsets for structures from the future right-of-way line. For this case, the setback is twenty(20)feet from the County Road and the offset is one foot for every three feet of building height or five feet whichever is greater. Section 23-3-350.G addresses the Required Landscape areas. The USR Plat has not identified areas for landscape treatment. Given the type of facility, Staff will not request a Landscape Plan for this facility. Staff does request that a Screening Plan be submitted for review and approval prior to recording the USR Plat. Section 23-3-350.H addresses the issue of trash collection areas. Areas used for storage or trash collection shall be screened from adjacent public rights-of-way and adjacent properties. These areas shall be designed and used in a manner that will prevent wind or animal scattered trash. This fence enclosure structure shall be delineated on the USR Plat. Section 23-3-350 I and Section 23-3-350. J addresses the water and sewage disposal for the site. The application materials state water is to be provided by Left hand Water District for consumption, sanitary and cleaning of equipment purposes. Effluent will be handled via an • engineered ISDS system. The applicant shall provide evidence from the Left hand Water District establishing that the use of the existing water tap is in compliance with the existing permit. The Department of Public Health and Environment will address additional requirements as warranted. • Section 23-3-360 addresses operation standards. The applicant shall address the issue of noise, air quality, water quality, radiation and radioactive material, heat light, and property maintenance. Section 23-3-360.A addresses noise. The Department of Public Health and Environment will regulate the maximum permissible noise levels allowed for this facility. Further, the application materials propose that the hours of operation be from 7 A to 330P, seven days per week each calendar year. Section 23-3-360.F addresses the issue of on-site lighting, including security lighting if applicable, this section.states "any lighting ... shall be designed, located and operated in such a manner as to meet the following standards: sources of light shall be shielded so that beams or rays of light will not shine directly onto adjacent properties...." Staff shall require a Lighting Plan be submitted for review and approval prior to recording the USR Plat. Section 23-3-360.G addresses property maintenance. Should noxious weeds exist on the property or become established as a result of the proposed development the applicant/ landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II of the Weld County Code. All other operation standards will be addressed by other referral agencies as warranted. The applicant shall delineate all on-site signs. The signs shall adhere to Article IV, Division 2 of • the Weld County Code. Further, the location of the signs shall be delineated on the USR Plat. All structures, including signs, on site must obtain the appropriate building permits. The applicant shall enter into an Improvements Agreement according to policy regarding collateral for improvements and post adequate collateral for all transportation and non- transportation components as required. The Department of Public Works will address additional requirements as warranted Should the Improvements Agreement be required for this facility, the agreement and form of collateral shall be reviewed by County Staff and accepted by the Board of County Commissioners prior to recording the USR plat. USR-1646 1. A building permit shall be obtained for a change of use for the existing building and prior to the construction of any new buildings or structures. 2. A plan review is required for each building for which a building permit is required. Plans shall bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans are required when applying for each permit. • 3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County:2006 International Building Code;2006 International Mechanical Code; 2006 International Plumbing Code; 2006 International Fuel Gas Code; and the 2005 National Electrical Code and Chapter 29 of the Weld County Code. 4.Any new construction will require an engineered foundation based on a site-specific geotechnical report or an open hole inspection performed by a Colorado registered engineer. Building height shall be measured in accordance with the 2006 International Building Code for the purpose of determining the maximum building size and height for various uses and types of construction and to determine compliance with the Bulk Requirements from Chapter 23 of the Weld County Code. BACKFLOW AND CROSS-CONNECTIONS. There exists the possibility of contamination and pollution of the District's potable water • system due to the acts and/or omissions of its users or other parties who may cause back- siphonage and cross-connections to occur. In the case of any premises where there is a well or other auxiliary water supply, the District's water system must be protected by an approved air-gap separation or an approved reduced pressure principle backflow prevention assembly. Any person, entity, association, or corporation which makes, installs, maintains or allows any such cross-connection which may cause back-siphonage and which may degrade the acceptable water quality of the District's water system shall be subject to prosecution under section 25-1-114, C.R.S. To reduce the possibility of cross-connection and back-siphonage, the District shall implement the following: 1. Notification. All new customers shall be presented with information and warnings regarding the possibility of contamination and pollution due to cross-connections and back- siphonage, and the schedule of compliance set forth in paragraph 2.2. All existing customers shall be periodically reminded of the schedule of compliance set forth in paragraph 2.2 2. Backflow Devices. 2.1 Commercial and Industrial. On or before January 1, 1992 all commercial and industrial users shall have installed an approved backflow prevention device of a type and size approved by the District, and which meets or exceeds the standards established by the Colorado Department of Health standards and specifications and which has been certified by the Foundation for Cross-Connection Control at the University of Southern California. Any unapproved backflow prevention device which is currently installed shall be replaced with an approved device at the time it fails an operational test. • 2.2 Residential. On or before January 1, 1994, all residential users shall have installed a backflow prevention device of a type and size approved by the District. 2.3 Installation Regulations. Left Hand water District shall incorporate into its engineering standards such installation regulations for backflow devices which are promulgated by the Colorado Department of Health and which are consistent with this policy. 2.4 Enforcement of Backflow and Cross-Connection Policies It is the customer's responsibility to maintain their backflow prevention devices, and to see that their devices are tested at least annually by a State certified backflow inspector. The results of the test shall be provided to the District by the customer within 20 days after inspection. If evidence of installation of a backflow device is not received after customer notification, or if notice of satisfactory"passing"inspection is not received by the District within the annual anniversary of the previous inspection, the following actions will be taken by the District: 1. A reminder notice will be sent by the District. The first notice will allow a 60 day period for compliance and note all fines and actions that may result from noncompliance. 2. If no response is received within the 60 day period, a fine of$150 will be imposed on the 61St day following notification, and a second notice will be sent. 3. The second notice will have a 30 day period for compliance. If no response is received following the second notice, a fine of$300 will be applied on the 315' day. • 4. If no action is taken to bring the backflow status into compliance after the second notice, a third notice with a term of 30 days will be issued, and service to the tap will be discontinued if no action is taken before the end of that period. Our comments and requirements are as follows: COMMENTS: Weld County Strategic Roadway: (December 2002) WCR 7 is classified by the County is a Strategic Roadway, which requires a 140-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Erie. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. (WCRs 7, 9.5, 11, 13, 22, 24, 27, 37, 49 and 74) Access is proposed to be onto WCR 7. Weld County does not maintain or have jurisdiction over this roadway. ie access request must be approved by the Town of Erie. A 40' radius is required on all accesses to public roads for accesses designed to accommodate truck traffic. {A minimum effective turning radius of forty-feet (40') shall be used for accesses intended to accommodate truck traffic. (Weld County Codification Ordinance 2000-1)} Sec. 8-2-40 B. Road access design standards. Our most current average daily traffic (ADT) count reflects 1036 vehicles taken per day in 2004 on WCR 7 at this location. This USR application will add about 42 vehicle trips per day per the data supplied by the applicant. REQUIREMENTS: The applicant shall indicate specifically on the plat the type of right-of-way/easement and indicate whether it is dedicated, private, or deeded to provide adequate access to the parcel. Storm Water Drainage: The applicant shall provide documentation on how the storm water drainage is proposed to be handled on site and disbursed. All storm water detention facilities shall be designed to detain the storm water runoff from the fully developed USR from a one-hundred-year storm and release the detained water at a rate not to exceed the rate of a five- year storm falling on the undeveloped site. (Weld County Code Ordinances 2001-1; 2003-10, and 2006-7). All storm water must be detained on site and follow the requirements per Weld County Code 24-7-130 D and rdinance 2006-7. Since this USR appears to not constructing any new facilities Public Works will waive the Wove requirement and require the applicant to detain the fully developed USR from a ten-year storm and release the detained water at a rate not to exceed the rate of a five-year storm falling on the undeveloped site. The applicant shall also provide Water Quality Capture Volume as part of the detention requirement. The detention pond shall capture the driveways, parking lots, buildings and area delineated as part of this USR Wormwater runoff. It shall be located to gravity flow into a roadside ditch, and any overtopping shall be operly protected to prevent erosion and pond failure. Final drainage construction, grading plan, and erosion controls plans (conforming to the final drainage report) stamped, signed, and dated by a professional engineer license in the State of Colorado shall be submitted with each plan. Offsite runoff flows onto the site must be managed through the site, and contours shall be shown on the site plan for a minimum of 200' from the property line, or as far as necessary to show the entire offsite contributing area. Within the Drainage Report describe in detail what the use is, concerning the existing onsite pond. Explain if there is a continuous pool of water in the pond and is so has an augmentation plan been filed with the State Engineers Office. Is it part of an Irrigation Ditch Company system if so an agreement will be required with the Irrigation Ditch Company allowing permission to discharge stormwater into the existing onsite pond. Please provide a figure in the drainage analysis that shows proposed conditions contouring for the site. The applicant must take into consideration storm water quantity capture and provide accordingly for best management practices. (Weld County Code Ordinances 2001-1; 2003-10, and 2006-7) Indicate the size, material type and label the culverts under the two driveways. Parking lot and internal drives: Explain in detail what type of proposed surface will be or is installed for the driveways and parking lots include dimensions to describe the size of these areas and the size of the existing and proposed buildings. A stop sign shall be placed outside the right-of-way line at the intersection of WCR 7 and the driveway into the USR facility to stop westbound traffic entering onto the WCR 7. Place signs to indicate where the semi trucks and trailers are to park. The applicant shall contact the oil and gas or ditch owner to obtain, in writing, permission to utilize their access road(s) for a commercial access. All parking for the site must be off street and internal. Each parking space shall be equipped with wheel guards or curb blocks when necessary to prevent vehicles from extending beyond the boundary of the space and from coming into contact with other vehicles, walls, fences, plantings or buildings. There is a residence with septic system (permit number SP-0100654), an existing shop and existing office identified on the site plan along with a future shop. It is unknown whether there is a septic system for the existing office or shop. The application also states that there will be a total of 10 people using the site. Restroom and handwashing facilities must be provided for the employees while at the site. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: • We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit a dust abatement plan for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. 2. An individual sewage disposal system is required for the proposed office/shop facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. 3. As an alternative, in the event the applicant intends to utilize the existing septic system at the residence for employee use, the septic system shall be reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the systems ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into compliance with current • Regulations. • 4. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). We recommend that the following requirements be incorporated into the permit as conditions that must be met one month prior to construction activities: 1. A stormwater discharge permit may be required for a development/redevelopment /construction site where a contiguous or non- contiguous land disturbance is greater than or equal to one acre in area. Contact the Water Quality Control Division of the Colorado Department of Public Health and the Environment at www.cdphe.state.co.us/wq/PermitsUnit for more • information. We recommend that the following requirements be incorporated into the permit as conditions that must be met prior to the issuance of the Certificate of Occupancy for the future shop: 1. An individual sewage disposal system (ISDS) is required for the future shop building if a restroom facility is installed. The ISDS shall be installed according to the Weld County Individual Sewage Disposal Regulations. 2. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. • 2 • 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan". 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved dust abatement plan at all times. 6. The facility shall have sufficient equipment available to implement dust control as required by the Weld County Department of Public Health and Environment. 7. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in 25-12-103 C.R.S., as amended. • 8. Adequate handwashing and toilet facilities shall be provided for employees and patrons of the facility. 9. Sewage disposal for the facility shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 10.The facility shall utilize the existing public water supply. (Left Hand Water District) 11.A permanent, adequate water supply shall be provided for drinking and sanitary purposes. 12.If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. 13.The operation shall comply with all applicable rules and regulations of the State and Federal agencies and the Weld County Code. • 3 Hello
