Weld County can not move forward with any land use applications, until Hudson has provided comment to us regarding the Notice of Inquiry. 2008-2400 Violation Summary Report If Hudson expresses a desire for you to proceed through Weld County, the first step will be to schedule a Pre-Application Meeting. See pictures dated 06/03/08. 06/17/2008 Phone Call Lloyd Land (303-898-8496)called. He said he had received my letter and wanted to know what he had to do. He said he has not installed any new air strips. He said he had to"hard surface"one of the air strips. He said 1 of his planes could not land on the dirt strip, so they added about 3" of concrete and about 6" of road base over one of the dirt strips. He said the wires (I am guessing electric lines)already have balls on them so they are fine. He said he just took out 2 lakes and is now installing a large drainage pipe so the property will drain correctly. He said when the county put the road in, it messed up all his drainage, so he's trying to fix it. He said he is working on putting in an "Ag Exempt" building, but he thinks he may just go ahead and make it a regular building, so it gets inspected, so if it needs to be used for something else in like 20 years, it will already be ready. I asked what he was going to use it for now. He said he was just going to store tractors and other agricultural equipment in it, but if he ever sold the property or whatever, it would be good to go ahead and have the building permitted for whatever. I asked if it would be used in conjunction with the air strip operation. He said no, he would just be keeping farm equipment in it. I told him I would present all of this information to staff and see where we would go from there. He offered to show me around the property. I told him that I may end up taking him up on that, but first let me see what staff has to say. He said sure. 07/24/2008 Certified Mail Receipt Certified Receipt received - Signed. Simpson 6212 CR 51 Keenesburg, CO 80643-9510 303-589-3768 July 22, 2008 When I learned Mr. Land told the Weld County authorities that there were balls on the power lines designating an east/west runway was already present on his land, I took photos of the power lines on June 20 and June 21, 2008 to show where the balls are in relation to the new runway. I followed the power lines North from where the balls are in front of the trees to the new runway. You can see there are buildings and equipment behind the trees and not a runway. Then, when 1 came home on July 18, 2008, I saw the balls had been moved from their location in front of the trees to in front of the new east/west runway. I took photos again of the trees and power lines on July 19, 2008. I am providing hard copies of some the pictures, and am providing all the pictures on a disk in jpg format that can be viewed as a slide show. I've captioned the date the photo was taken and a description of what the photo is of on the disk. To insure the balls were moved and installed properly, I call United Power on Monday, July 21, 2008 and spoke with Randy Reese of their Operations Division. He told me they did move the balls on the power lines "per Lloyd Land's request, because he has a new runway." Also on July 21, 2008 at 9:26 a.m., I call Scott Brownlee, an Estate Aviation Planner, to inquire if there are any FAA regulations regarding private parties who have an airfield on their property. Mr. Brownlee told me there is an FAA form that needs to be completed by people who are going to construct an airfield on their property or modify an existing airfield before they start the construction. He told me to call Marsha Hofer, who handles this area, to see if Mr. Land completed this form. So at 9:36 a.m., I called Marsha Hofer. I received her voice mail saying she was on vacation until July 28, 2008. I selected to speak to another representative. I reached Linda, who confirmed that Mr. Land would need to complete an FAA form prior to new construction, which allows the FAA to do such things as an air space impact study. She said if he had not done that they would ask him to complete the form. Linda could not confirm if Mr. Land completed this form, due to her not having access to Ms. Hofer's files. Thus, Linda took my name and number to have Ms. Hofer call me upon her return. I also asked Linda if the FAA had any regulations parties must meet regarding a crop dusting business. She said they just insure the pilots and aircraft are certified. Other than that, she said it was up to local jurisdiction as to what is required of the responsible parties for the crop dusting business. She said they do have regulations for parties who use their airfield for commercial flight operations, i.e., carrying passengers. Other than that, they do not tell people what they can do with their property. She said once that preliminary form is completed and the FAA performs their analysis, they can make recommendations to the property owners, such as the direction for take-off and landings, etc.. However, they are only recommendations. Off the record, she said the State of Colorado's EPA may have requirements concerning such a business, due to the chemicals involved. For my own peace of mind, I am going to contact the Colorado EPA office so I'll know what the requirements are of such a business to ensure that if this property is developed into a crop dusting business, they adhere to state and local laws that apply to it. I am submitting the photos and information to the Weld County authorities for their use, and am willing to testify on behalf of Weld County, if the need arises. 672041 P meta K. All during this time, the land North of Mr. Land's hangers has always been an agricultural field. There was an empty pond close to the road and just down from the house located North of the entrance to his hangers. Over the last few months, I've watched some of that field area (North of his hangers) be torn up. A lot of dirt has been moved around, some of the large trees were pulled up, and the empty pond was filled in. Then, I proceeded to witness the building of what appears to be an East/West runway. There was no runway in that location previously, dirt or otherwise. I watched the form for the runway be built and the surfacing material put in. Currently your property is in violation of the following Section(s) of the Weld County Code: Chapter 23, Article 111(3), Division 1 A(Agricultural)Zone District 23-3-20 Uses allowed by right. 23-3-30 Accessory uses. 23-3-40 Uses by special review 23-3-40.N Expansion or extension of NONCONFORMING USES. 23-3-40.F AIRPORTS and AIRSTRIPS. 23-7-30 Nonconforming uses of land. To bring your property into compliance with the Weld County Code: My records show an existing Nonconforming Use(NCU-370) on the above referrenced property. It has been brought to our attention that a new air strip and various other construction has and is occurring on this property without the necessary Weld County Zoning Permits. In order to expand an existing Nonconforming Use, a Use by Special Review permit is necessary. If you have any questions that you would like to discuss with a Planner, an appointment must be scheduled with Kim Ogle, Planning Manager at 970-353-6100 Ext. 3540. To better serve you please bring this letter with you. It is the intention of this office to assist and cooperate with you without imposing undue hardships; however, we have no discretion in this matter if you fail to correct this violation. You have until 07/11/2008, to correct this zoning violation. Failure to do so will result in this office scheduling the violation before the Board of County Commissioners to consider whether to refer the violation to the County Attorney's Office for legal action. The potential noncompliance(s)with the Weld County Code are as follow: based upon the construction that has occurred and continues to occur on the property, it appears that either a new runway is being installed or the existing runway is being expanded either of these endeavor's would be considered "Expansion of a Nonconforming Use" (NCU-370) and thus require a Use by Special Review. However, your property is within the Intergovernmental Agreement(IGA) area that we (Weld County) have with the Town of Hudson. Please take the enclosed form to the Town of Hudson. After they have filled it out, it will need to be returned to our office before proceeding with the Use by Special Review (USR) process. As part of this operation, the grass field, north of the main buildings, was used as a crosswind landing area on an occasional,as-needed basis. - Current activity on the property is the same that has been occurring since mid 1960's. - During construction of Power Plant on adjacent property in 2002-2003,easement access was granted to the project owner,Calpine. To facilitate their desired needed access,Calpine installed additional paving, part of which was alterations to the existing runway at Land Airport. This work was completed with full knowledge, inspection, and approval of Weld County. - In 2007,Weld County issued a building permit for the construction of the new equipment storage building_ - In the summer of 2008,as a maintenance issue,a hard surface paving was placed on a portion of the existing cross wind landing area. This was done as a maintenance issue because of ongoing pest damage to an irrigation system that keep the existing landing surface intact. Concrete paving was used only used because there was a free supply, a surplus coming from a previous dispute settlement. +gi'd"" ..wry. I 1 12501 - ^ •--- He 36309.3153. Staff certainly concurs that the airstrip existed prior to the adoption of the Weld County Zoning Ordinance on August 31, 1972 and is therefore non-conforming. Further, the non- conforming use is limited to private use only. However,Staff agrees that"private"includes planes owned by you or your agricultural business. Based on the information you submitted, It is unclear to the historic number of aircraft contained on the site.We would appreciate any additional information you may have to document a number. At this point,we estimate from 4 to 5 airplanes have historically been on site. Further, staff is unclear as to whether the western most hangar/office is a permitted structure. In a telephone conversation on March 24,2003 you indicated the hangar was originally constructed as an aE ricultural exempt building which does not require a building permit. An office is not usually allowed in an agricultural exempt building. You have requested that your attorney review your case. I will be very happy to assist him. For his information, the following are sections of the Weld County Code that he may find applicable: Nonconforming Lots, Uses and Structures, Section 23-7-10. Agricultural Exempt Building, Section 23-1-90 , Definitions. After your attorney has had a chance to review the case, please contact me at the above address or call (970)353-6100 ext 3540 so that we can discuss how you wish to proceed.
