Landscape Referral
The Department of Planning Services reviewed the above referenced Use by Special Review
documentation and drawings and offers the following comments:
The Use by Special Review Plat shall be prepared in accordance with Section 23-2-260.D of
the Weld County Code, including the minimum font size for all typeface. In addition to these
requirements, the plat scale shall be 1" = 40 feet. The Vicinity Map scale of 1" = 2000 feet
scale accurately be delineated on the plat.
This application shall be in compliance with Section 23-3-250 A. and B and is address in the
following comments.
Section 23-3-250.A.1
Stormwater Management. All users of land shall provide and maintain stormwater detention
facilities designed to retain the stormwater runoff in excess of historic flow from the developed
• site. The stormwater detention facility on a developed site shall be designed for a one-hundred-
year storm. The stormwater retention facility shall be designed and operated to release the
retained water at a quantity and rate not to exceed the quantity and rate of a five-year storm
falling on the undeveloped site. The application materials do not specifically address this issue,
referring to an undated Drainage Plan for details. The applicant shall contact the Storm Water
Engineering Staff of the Weld County Department of Public Works, to further discuss this issue.
Written evidence of compliance shall be submitted to the Department of Planning Services.
Section 23-3-250.A.2
Parking. Sufficient screened, off-street, paved parking areas shall be provided to meet the
requirements of employees, company vehicles, visitors and customers of the Uses Allowed by
Right and Accessory Uses. Appendix 23-A describes the design requirements for parking
spaces and Appendix 23-B delineates the number of parking spaces required by use for this
property.
The proposed facility is comprised of three structures and multiple portable and potentially
transient offices with no future structures planned as stated in the application materials. Per the
application materials, Building I is a single story metal skinned structure serving as the office
[2000 SF], mechanic shop, and oil and gas maintenance shop and storage with unknown
associated activities having a footprint of 18400 SF. Building II is a single story metal skinned
structure serving as the agricultural commodity and equipment storage. The footprint for this
structure is 17300 SF. Building III is also a metal skinned building utilized for paper recycling
and is 34100 SF in size.

There are two office trailers located on site for use in conjunction with the activities associated
with Buildings I and III. Additional information should be requested addressing the use of these
• structures, specifically a determination of why there is not an office, lavatory and related uses
conducted within the existing structures located on site. The use of port-a-lets is not applicable
to the use on site and the use of the transient office trailers raises questions of their [the office
trailers ] ability to be in compliance with the Weld County Code.
The application materials state there are thirty-six employees expected at full build-out and an
unknown number of persons who may access the site on any given day during daylight hours.
It is unclear from the application's text whether this is a 7-day/week operation or less, therefore
staff requests clarification on this issue.
The parking requirement for this facility is as follows: Building I is classified as a warehouse with
a 2000 SF Office. The warehouse component is calculated as one space for every 1000 SF
of floor area and for the office there shall be one for every two employees, plus one parking
space for each 500 SF. Total parking required for Building I is 20 parking spaces as outlined in
Appendix 23-B.
Building II is classified as a warehouse. The warehouse component is calculated as one
space for every 1000 SF of floor area, total parking required for Building II is 17 parking spaces
as outlined in Appendix 23-B.
Building III is classified as a warehouse. The warehouse component is calculated as one
space for every 1000 SF of floor area, total parking required for Building III is 34 parking spaces
as outlined in Appendix 23-B.
For the office and warehouse components, a passenger space is nine (9) feet in width by
•
nineteen (19)feet in length. Parking for larger vehicles, depends on length of tractor, which
could exceed twenty (20)feet. Additional information is requested addressing the specific
length of the typical tractor.
The Outdoor Vehicular Storage Facility component should have a minimum number of spaces
for parked vehicles awaiting repair.
Total parking as delineated in the Weld County Code for this facility is seventy-one parking
spaces for the facility and an appropriate number of additional spaces for the repair yard.
Should the employee or the Outdoor Vehicular Storage Facility numbers increase, the parking
requirement shall be structured according to Appendix 23-B of the County Code. Written
evidence of compliance shall be submitted to the Department of Planning Services.
Section 23-3-250.A.3
Street Access. Lots shall have safe access to an approved public or private street. The design
designation of any street or highway as to type shall be in conformance with that shown on the
county thoroughfare plan and/or the master plan of the affected municipality. Visual inspection
of the USR Plat identifies one point of ingress and egress, onto SH 392 The internal circulation
is unclear, additional information shall be submitted delineating the internal circulation pattern
and the proposed parking areas associated with this facility. Further, the applicant shall
delineate on the plat the proposed parking layout, including adequate aisles, and wheel stops.
Written evidence of compliance from the Department of Public Works, the Fire Protection District

and associated emergency responder personnel shall be submitted to the Department of
Planning Services. Planning staff requires evidence of a valid access permit from CDOT.
• The Fire District of record may require a second point of ingress and egress for this facility,
including, potentially the upgrade and maintenance of SH 392 right-of-way. All approved access
roads shall be graded and drained to provide all weather access. Accesses shall be placed in
such a location as to have adequate sight distance in both directions, shall not be placed below
the crest of a hill or where physical obstructions are present. Written evidence of compliance
shall be submitted to the Department of Planning Services.
Section 23-3-250.A.4
Required Yards - Setback
No use or accessory use may be located closer than twenty (20) feet to the existing or proposed
(whichever represents the greater right-of-way width) highway or street right-of-way. Off-street
parking areas may be permitted in the required setback area when the area is screened from
direct view of persons on the public rights-of-way. Fences over six (6) feet in height are not
required to comply with the minimum setback and may be located on the property line. This is
an existing facility.

Required Yards - Offset
No use or accessory use may be located closer than ten (10)feet to its lot line. Off-street
parking areas may be permitted in the required offset area when the area is screened from
adjacent lots zoned R-1, R-2, R-3, R-4 or R-5. Fences over six (6)feet in height are not
required to comply with the minimum Offset and may be located on the property line. The plans
submitted with the application materials have not delineated the offset, and the dimensions are
unknown and do not clearly appear to be in compliance with the County Code. Written
•
evidence of compliance shall be submitted to the Department of Planning Services.
Section 23-3-250.A.5.A
Required Landscaped Areas
No more than eighty-five percent (85%) of the total area of a lot shall be covered. Land shall not
be deemed covered if it is used for growing grass, shrubs, trees, plants or flowers or if covered
by decorative gravel or wood chips, or if it is otherwise suitably Landscaped. There was a
schematic Landscape and Screening Plan submitted with the application materials. It is unclear
from the submitted drawings if the fifteen (15) percent landscaped requirement has been met.
The applicant shall address this issue and provide additional documentation including all
proposed fencing, lighting, adjacent property screening and landscape treatment to meet this
section of the Weld County Code.
Further, Staff will require an approved weed management plan and a reseeding /post
construction plan to facilitate soil stabilization and plant material growth. Moreover, staff will
require an updated Landscape and Screening Plan of the existing plant material and also a new
plan that addresses the issue of the screening component for the buffer between adjacent
properties and public rights-of-way. Written evidence of compliance shall be submitted to the
Department of Planning Services.
Section 23-3-250.A.5.B
That portion of a lot which abuts a public or private street right-of-way shall be landscaped for a
distance of ten (10) feet, measured at a right angle from the lot line towards the interior of the

lot. Driveways may pass through the required landscaped areas. There was not a schematic
Landscape and Screening Plan submitted with the application materials. Additional information is
required prior to accepting the plat for recording. Written evidence of compliance shall be
• submitted to the Department of Planning Services.

Areas used for trash collection shall be screened from public rights-of-way and all adjacent
properties. These areas shall be designed and used in a manner that will prevent wind- or
animal-scattered trash. The application materials did not identify the location of the dumpster on
the plat. Future submittals shall address this issue as outlined in this Section of the Code.
Written evidence of compliance shall be submitted to the Department of Planning Services.

Water Supply. Uses shall have an adequate source of potable water. The application materials
state that water is provided by North Weld Gouty Water District, Permit number unknown. Given
this is a commercial operation a Commercial water tap is required for each structure unless
waived by Planning Services or the Department of Public Health and Environment. The
applicant shall meet the requirements of the Weld County Department of Public Health and
Environment at all times. Written evidence of compliance shall be submitted to the Department
of Planning Services.

Sewage Disposal. Uses shall have adequate sewage disposal facilities. The application
materials state that individual sewage disposal systems (ISDS)will handle the effluent flow.
Further, the applicant shall meet the requirements of the Weld County Department of Public
Health and Environment. Written evidence of compliance shall be submitted to the Department
• of Planning Services.

Outside Storage. Uses involving outdoor storage of vehicles, (including the parking of employee
vehicles) equipment or materials when permitted shall be screened from public rights-of-way and
all adjacent properties. The applicant shall submit documentation as to how the outside storage
will be screened during the construction period, and for periods thereafter, including all service/
loading docks, areas near the canal.and from all adjacent properties.
Section 23-3-350.B.
Operation Standards. Uses shall demonstrate conformance with the following operation
standards to the extent that they are affected by location, layout and design prior to construction
and operation.
Further, the applicant shall submit to the Department of Planning Services written evidence of
compliance with all Department of Building Inspection and Fire Protection District regulations.
Section 23-3-350.B.1
Noise. Uses and structures shall be located, designed and operated in accordance with the
noise standards as established in Section 25-12-101 C.R.S. The applicant shall meet the
established standards set by the Weld County Department of Public Health and Environment.

Air Quality. Uses shall be located, designed and operated in accordance with the air quality

standards established by the Colorado Air Pollution Control Commission. The applicant shall
meet the established standards set by the Weld County Department of Public Health and
Environment.

Section 23-2-250.6.3
Water Quality. Uses shall be located, designed and operated in accordance with the water
quality control standards established by the Colorado Water Quality Control Commission.
Section 23-2-250.6.4
Radiation and Radioactive Materials. The handling, use, storage and processing of radioactive
materials shall be in accordance with the applicable regulations of the State and the United
States government. The application materials do not indicate this is applicable, should this not
be the case, the applicant shall provide additional information to the Weld County Department of
Public Health and Environment.
Section 23-2-250.6.5
Heat. Uses shall not emit heat in such an amount sufficient to raise the temperature of the air or
of materials at or beyond the Lot line more than five (5) degrees Fahrenheit. The application
materials do not indicate this is applicable, should this not be the case, the applicant shall
provide additional information to the Weld County Department of Public Health and Environment
and the Department of Building Inspection. Further, the applicant shall obtain a written approval
from the jurisdictional Fire Protection District stating that the facility is in compliance with the Fire
Code.
Section 23-2-250.B.6
Light. Any lighting, including light from high temperature processes such as welding or
combustion, shall be designed, located and operated in such as manner as to meet the following
•
standards: sources of light shall be shielded so that beams or rays of light will not shine directly
onto adjacent properties; neither the direct nor reflected light from any light source may create a
traffic hazard to operators of motor vehicles on public or private streets; and no colored lights
may be used which may be confused with or construed as traffic control devices. The
application materials did not include a Lighting Plan. Should exterior lighting be a part of this
facility, all light standards shall be delineated on the USR Plat.
Section 23-2-250.B.7
Property Maintenance. Property shall be maintained in such a manner that grasses and weeds
are not permitted to grow taller than twelve (12) inches. In no event shall the property owners
allow the growth of noxious weeds. The application materials do not address property
maintenance. Future correspondence shall identify how the property will be in compliance with
this Section of the County Code.
Section 23-4-50.
Off Street Loading. The applicant shall delineate on the plat the location of the loading zone that
is in compliance with this Section of the Code. There shall be parking or staging of trucks within
the public rights-of way. Further, the applicant shall meet all requirements of the Department of
Public Works concerning access and internal circulation of vehicles for this proposed facility.
Section 23-4-90
Signs. The application materials did not address the issue of on-site signs. The applicant shall
provide written evidence that all proposed signs are in compliance with this section of the Code.

The applicant shall enter into an Improvements Agreement according to policy regarding
collateral for improvements and post adequate collateral for all transportation (access drive,
• parking areas, etcetera) and non-transportation (plant materials, fencing, screening, et cetera).
The agreement and form of collateral shall be reviewed by County Staff and accepted by the
Board of County Commissioners prior to recording the USR plat.

Environmental Health Services has reviewed this proposal for an oil and gas support
service facility/maintenance shop, commodity storage and recycling business complex.
There is a septic permit (SP-0100308) that was issued for the property. The system
was installed but never finaled by this Department. Nothing is known about the
installation of this system, including any setbacks to the existing well (see below). At
the time of application, the applicant was undecided as to whether they will modify the
existing system for the proposed load (depending on setbacks to the well) or install a
new system. The Department is aware that the lot size will allow for the installation of a
new system. Additionally, per the applicant, there are no known floor drains in this
• building.
There is a well located inside the Oil & Gas support building (that appears by septic
records to have not been disclosed at the time of permit issuance) that will remain. A
North Weld County Water District tap has been purchased and the building will be
converted.
The applicant is proposing self contained office trailers for the'recycling building and the
east end of the oil and gas support service facility/maintenance shop. Following
establishment Department policy, we are not in support of these self-contained office
trailers (water/sewage collection) unless they are for seasonal use only (less that 6
months per year). The applicant is aware of this.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
Prior to recording the plat:
1. The applicant shall submit evidence to the Department of Planning Services,
from the Colorado Division of Water Resources, demonstrating that the well(s)
are/is appropriately permitted for the commercial use.

2. The applicant shall submit a waste handling plan, for approval, to the
• Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to the issuance of the Certificate of Occupancy:
1. Adequate sewage disposal system(s) shall be provided for all portions of the
operation.
a) The existing septic system serving the proposed oil and gas support
service facility/maintenance shop is not appropriately permitted. This
system must either be permitted or a new system installed. If this system
is utilized, it must be shown that the system meets all setbacks as outlined
in the Individual Sewage Disposal System (ISDS) regulations.
• b) The portable office units proposed to serve the east end of the proposed
oil and gas support service facility/maintenance shop and the recycling
business are intended as permanent structures. In accordance with
Section 30-2-10 of the Weld County Code these structures shall be served
by approved permanent ISDS systems.
c) The commodity storage building is intended for seasonal use
(approximately 2 times per year/ 2 months each). Because of this
seasonal use (less than 6 months per year) the Department is not
opposed to portable toilets for this building.
2. All septic system(s) are required to be designed by a Colorado Registered
Professional Engineer according to the Weld County Individual Sewage Disposal
Regulations.
3. The applicant shall submit evidence of an Underground Injection Control (UIC)
Class V Injection Well permit from the Environmental Protection Agency (EPA)
for any vehicle maintenance facility located on the site that is equipped with a
floor drain. Alternately, the applicant can provide evidence from the EPA that
they are not subject to the EPA Class V requirements. (New EPA rule effective
4/5/2000).

4. If the existing septic system is abandoned, it must be abandoned in accordance
• with Section 30-7-70 of the Weld County Code pertaining to individual sewage
disposal systems.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan".
• 5. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in 25-12-103 C.R.S., as amended.
6. Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the facility.
7. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
8. Adequate portable toilet facilities shall be provided for the commodities storage
for seasonal use.
9. The facility shall utilize the existing public water supply.

The Weld County Public Works Department has reviewed this proposal; this project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section
23. Our comments and requirements are as follows:
COMMENTS:
WCR 39 is a major arterial road, which requires a 140-foot right-of-way at full build out. There is presently a
60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the
Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line.
The applicant shall reserve or dedicate an additional 40-foot right-of-way parallel to the WCR 39 right-of-way
for future build-out.
Ilkur most current average daily traffic count (ADT) reflects 1,255 vehicles trips per day in 2006 on WCR 39
orth of this location.
Access for this USR application is off HWY 392 and will add about 96 vehicle trips per day per the data
supplied by the applicant. The most current average daily traffic (ADT) count per Colorado Department of
Transportation (CDOT) website reflects 3,700 vehicle trips per day observed in 2005 on HWY 392.
REQUIREMENTS:
CDOT has jurisdiction over all accesses to the state highways. Please contact Gloria Hice-Idler at the Greeley
office (970-350-2218) to verify the access .permit or for any additional requirements that may be needed to
obtain or upgrade the permit. (State Highway 392)
The applicant shall indicate specifically on the plat the type of right-of-way/easement and indicate whether it is
dedicated, private, or deeded to provide adequate access to the parcel.
Storm Water Drainage:
All storm water detention facilities shall be designed to detain the storm water runoff from the fully developed
USR boundary from a one-hundred-year storm and release the detained water at a rate not to exceed the rate

Parking lot and internal drives:
Explain in detail what type of proposed surface will be installed for the driveways and parking lots.
A stop sign shall be placed at the intersection of HWY 392 and the access into the USR facility to stop
southbound traffic entering onto the HWY 392.
Place signs to indicate where the semi-trucks and trailers are to park.
The right-of-way or easement shall be a graded and drained road to provide an all-weather access.
The applicant shall contact the oil and gas or ditch owner to obtain, in writing, permission to utilize their access
road(s) for a commercial access.
Striping will be required to define parking stalls for employees and visitors and for semi truck parking on
.sphalt surfaces. Signs shall be installed to direct traffic flow and parking.
Stop blocks will be required to be installed for all employee and visitor parking where a constructed element is
not present to help prevent vehicles from rolling after being parked next to buildings.
Parking lots shall conform to all standards of the American with Disabilities Act.
Utilize the existing agricultural, oil and gas, and ditch roads that are necessary for your agricultural operation.
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds.

time to review a report prior to the hearing date of February 5, 2008; other cases are

PW has decided to only require the applicant to provide water quality for this site. This
would entail a Drainage Report to include all the calculations to support detaining as
follows:
All storm water detention facilities shall be designed to detain the storm water runoff
from the fully developed USR from a one-hundred-year storm and release the detained water
at a rate not to exceed the rate of a five-year storm falling on the undeveloped site.
(Weld County Code Ordinances 2001-1; 2003-10, and 2006-7) . All storm water must be
detained on site and follow the requirements per Weld County Code 24-7-130 D and Ordinance
2006-7. Since this USR appears to not be constructing any new facilities Public Works
will waive the above requirement and require the applicant to detain the fully developed
USR from a ten-year storm and release the detained water at a rate not to exceed the rate
of a five-year storm falling on the undeveloped site. The applicant shall also provide
Water Quality Capture Volume as part of the detention requirement. The detention pond
shall capture the driveways, parking lots, buildings and area delineated as part of this
USR stormwater runoff. It shall be located to gravity flow into a roadside ditch, and any
overtopping shall be properly protected to prevent erosion and pond failure.
This should fit better on their site since it will not be as large as a 100-yr detention
or retention pond. Should a retention pond be required it shall be 1.5 times as large as
0oe 24-hour storm for the 10-year storm event.

Site Specific Development Plan and Special Review Permit for a Recycling Business, an Oil and
Gas Support Company and Commercial Storage located in the A (Agricultural) District.
USR-1642
Description: Change of use from a U Occupancy (Agricultural Drying and Storage) to a proposed
F-1/S1/M/B Occupancies. There are 3 large structures, with multiple uses to be considered. The
Occupancy Classifications can not be confirmed until a complete building permit
application and a complete set of plans has been submitted.
• There are 4 historical Building permits attached to this parcels .All have been finaled
1. A building permit shall be obtained for all temporary office trailers, denoted on site plan, all
new construction and, prior to the change of use for all three structures.
2. A plan review is required for each building for which a building permit is required. Two
complete sets of plans are required when applying for each permit. Include a Code Analysis
Data sheet provided by the Weld County Building Department with each Building permits
application Plans shall include a floor plan showing the specific uses of each area for the
building. The Occupancy Classification will be determined by Chapter 3 of the 2006
International Building Code the plans shall also include the design for fire separation and
occupancy separation walls, when required by Chapter 5 and 7 of the 2006 International
Building Code. Fire Protection shall conform to Chapter 9 and Exiting requirements by Chapter
10. Building plans shall also be submitted to Eaton Fire Protection District.
3. Buildings shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 2006
International Building Code; 2006 International Mechanical Code; 2006 International Plumbing
Code; 2006 International Fuel Gas Code; and the 2005 National Electrical Code and Chapter 29
of the Weld County Code.
4. Building height shall be measured in accordance with the 2006 International Building Code
for the purpose of determining the maximum building size and height for various uses and types
of construction and to determine compliance with 2006 International Building Code. After

preliminary review and site inspection. The structure will probably be required to adhere to
Chapter 9, Sec 903.2.1.3 of the 2006 International Building Code for Fire Suppression .The
structures would probably be required to have a sprinkler system. The building also exceeds the
allowable square footing for Type II Construction, Table 503 for proposed occupancy.

5. All building plans shall be submitted to the Fire District having jurisdiction for review and
approval prior to issue of Building Permits, Eaton Fire District

We have been working with the authorized agent for the Lucerne Commons, LLC project
Dusty McCormick, on the Eaton Fire Protection District requirements for fire protection.
We have explained to Mr. McCormick that requirements will be based on how the
occupancy will be classified by the county.
We have also discussed options for receiving required fire-flow for the occupied buildings
• in this area. Requirements will be based on building type classification and square footage.
We will continue to work on different options to meet both the client's business and our
fire protection needs.
After reviewing the submitted referral each building will be reviewed separately for fire
protection requirements. Owner has agreed to install fire suppression sprinklers into the
proposed recycling building. Sprinkler plans must be submitted, reviewed, and approved
before occupancy of the building can occur.

The canal for The New Cache La Poudre Irrigating Company, commonly known as
Greeley#2 Canal, passes along the northern boundary for entire length of the property.
The canal is in this area is still quite large. The right-of-way in this area would typically
be a total of 150 feet in width being 75 each side of the center of the canal.
The information furnished does not give definition to the canal right-of-way. The
establishment of this parcel happened some time ago. Unfortunately, overlooking the
need to giving clear definition to the right-of-way of the canal leaves the canal right-of-
way as a prescriptive right which is rarely conducive to neighboring uses other than
agricultural production.
It is critical to the safe operations of the canal that access is not limited. Unfortunately,
commercial business along the canal right-of-way has a propensity to expand into the
canal right-of-way. This leads to conflicts associated with canal maintenance. Such is the
case with this property. With storage being placed against the toe of the canal bank, soil
from canal maintenance infiltrates materials stored too close the canal access.

Oversight to clearly document canal right-of-way in the Town of Lucerne in time past is
creating the potential for conflicts between the canal company and our neighbors.
Changing and potentially competing uses have and are changing the ability to operate
without clear definition of property lines. The New Cache La Poudre Irrigating Company
would recommend using this opportunity to clarify the right-of-way of the canal along
the northern property line including clearly labeling it as an exclusive right-of-way for

stating that any activity within the right-of-way must have written approval from The
New Cache La Poudre Irrigating Company.
