Comments made during this phase of the subdivision process may not be all-inclusive, as other concerns or issues may arise during the remaining application process. Comments External Roads WCR 8 is a collector road and requires an 80-foot right-of-way at full build out. There is • presently a 60-foot right-of-way. This road is maintained by the City of Fort Lupton. Please contact Fort Lupton's Public Works Department at (303) 857-6694 for any additional requirements. WCR 27 (Denver Avenue) is a major arterial road and requires a 140-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by the City of Fort Lupton. General Comments No additional structures or accesses have been indicated as a result of the proposed change of zone. Drainage should, therefore, not, be affected by the proposed change of zone. Should any future construction be proposed, the applicant will at that time be required to submit appropriate drainage and access information. Currently the site has four existing access points. At this time, Weld County Public Works would recommend closing one access off of WCR 27 and on WCR 8 to allow only two accesses to remain. The applicant shall utilize there points of access, however, Public Works will reevaluate access to site upon any further commercial construction. • As there are no internal roadways associated with this change of zone, Public Works makes no comment regarding internal roadways. • Easements shall be shown in accordance with County standards and / or Utility Board recommendations, also dimensioned on the change of zone plat. The area is not in a FEMA Flood Zone. Recommendation The Public Works Department recommends approval of this change of zone, based on the above observations. Mr. Glaze indicated to me that he will have above storage fuel tanks on the property which necessitates an I-3 zoning. It is my understanding that above storage fuel tanks are only permitted in I-3 zoning districts and would create a hardship for Mr. Glaze if a lesser zoning district was imposed. Furthermore, the property is not significant enough in terms of size to pose any risk of anchoring a heavy industrial use in the future that could jeopardize the intent of the City's land use master plan for this area. Given this information the City would like to retract its initial objection to the zoning change and allow Mr. Glaze to seek I-3 zoning. After careful review the City has the following comments. • 1) It appears that the applicant and owner of the property operate a service company which caters to their customers by traveling to them rather than the customers coming to the site. It is in the opinion of the City that the proposed I-3 zoning is not consistent with the intent of Section 23-3-330. I-3 zoning is given priority to heavy industrial users which generally require more extraordinary measures to protect surrounding properties from varying impacts. The City is requesting that the County consider I-1 Industrial Zoning which seems to be more appropriate given the nature of the proposed use. "Section 23-3- 310 accommodates industrial uses which create minimal negative visual impacts". 2) Industrial zoning of I-1 is consistent with both the 2005 Interim Growth Plan and the 2007 Comprehensive Land Use Plan. Both plans are attached to this letter. If the County granted the applicant an I-3 zone it could impact the nature and overall intent of the City's land use plans. I-3 zoning is considered the County's "highest and best use" for the applicants and we understand the underlying nature of property rights. However, zoning runs with the land and not with the owner. Glaze Industrial property could decide to sell its business in the future which would give future owners carte blanche on all uses by right in I-3. 3) Given the properties close proximity to WCR 27 and WCR 8 the City believes that future uses may conflict with the County's provision that states that I-3 uses "may require locations relatively isolated from other land use types". Although similar land use types exist around the property there is still a great deal of agricultural property in the area and • • • • the potential for higher density residential to the east. I-1 zoning will minimize the potential for more intense uses at this location. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to county planning directors, this office will only perform a cursory review of the referral information and provide comments. The comments do not address the adequacy of the water supply plan for this project or the ability of the water supply plan to satisfy any County regulations or requirements. In addition,the comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure,the issuance of a well permit, or the physical availability of water. • The referral information contains a copy of well permit 277800. Well permit no. 277800 is permitted for a pumping rate of 15 GPM, annual withdrawal of 0.33 acre-feet and use of drinking and sanitary purposes for a commercial business. Water from the well cannot be used for lawn or landscape irrigation or for any other purpose outside the business building structure. The referral information did not specify the proposed uses of the well, therefore, we are unable to comment on whether the proposed uses of the well are consistent with the permitted uses of the well. Department of Public Health and Environment CASE NO.: CZ-1148 NAME: Glaze The Weld County Department of Public Health and Environment has reviewed this proposal. The application is to change the zoning from Agricultural (A)to Industrial (1-3) on a .92 acre site. The property is served by a commercial well and an Individual Sewage Disposal System. It is this departments understanding that a Site Specific Development Plan application (SPR) will be required in addition to this rezoning. When the SPR is submitted this department will require the septic system to be reviewed by a Colorado Registered Professional Engineer if the applicant intends to utilize the existing septic system, at the home, for employee use. The review will consist of observation of the system and a technical review describing the systems ability to handle the proposed hydraulic load. The review will be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed, the system will be required to be brought into compliance with current Regulations. There will also be additional conditions, such as dust control and waste handling plans, at the SPR • stage based upon the proposed use of the property. This violation was initiated due to the operation and storage of a sewage company and vehicles without first obtaining the necessary Weld County Zoning Permits. This case was presented to the Board of County Commissioners through the Violation Hearing process on October 10, 2007. At that time, the Board of County Commissioners referred this case to the County Attorney's Office, but delayed legal action for 60 days. This application if approved by the Board of County Commissioners will change the zoning from Agricultural to 1-3(Industrial). The next step would be for the applicant to complete and submit a Site Plan Review (SPR) application. If these processes are not completed in timely fashion, we will proceed accordingly through the District Court process. A building permit shall be obtained prior to the construction or change of use of any structure. 2. A plan review is required for each building for which a building permit is required. Two complete sets of plans are required when applying for each permit. Residential building plans may be required to bear the wet stamp of a Colorado registered Architect or Engineer. 3. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of permit application. Current adopted codes include the 2006 International Residential Code; 200361nternational Building Code; 2006 International Mechanical Code; 2006 International Plumbing • Code; 2006 International Fuel Gas Code; 2008 National Electrical Code, 2006 Energy Conservation Code and Chapter 29 of the Weld County Code. 4. Fire resistance of walls and openings, construction requirements, maximum building height and allowable areas will be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning Ordinance. 5. Building height shall be measured in accordance with the 2006 International Building Code for the purpose of determining the maximum building size and height for various uses and types of construction and to determine compliance with the Bulk Requirements from Chapter 23 of the Weld County Code. Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset and setback requirements. Our only comment would be to consider a less intensive zoning designation if the use is allowed in the I-2 or I-1 zone district.
