HomeMy WebLinkAbout20083289.tiff HEARING CERTIFICATION DOCKET NO. 2008-95 PUBLIC HEARING RE: COUNTY ROAD 24 CORRIDOR STUDY A public hearing was conducted on December 15, 2008, at 9:00 a.m., with the following present: Commissioner William H. Jerke, Chair Commissioner Robert D. Masden, Pro-Tem - EXCUSED Commissioner William F. Garcia Commissioner David E. Long Commissioner Douglas Rademacher Also present: Acting Clerk to the Board, Elizabeth Strong County Attorney, Bruce Barker Public Works representative, Wayne Howard The following business was transacted: I hereby certify that pursuant to a notice dated November 26, 2008, and duly published December 5, 2008, in the Greeley Tribune, a public hearing was conducted to obtain public input regarding the adoption of the County Road 24 Corridor Study, which was drafted by the Weld County Department of Public Works. Wayne Howard, Department of Public Works, stated this study is regarding the section of County Road 24 located on the west side of US Highway 85, and the purpose of the study is to connect this section of County Road 24 to County Road 22. He stated County Roads 22 and 24 are both strategic roadways which connect County Road 49 to the 1-25 area. He stated public input will be invited today; however, the recommendation will be provided to the Board on December 31, 2008. Mr. Howard reiterated the purpose of the project is to establish a preferred alternative for regional connection between the intersection of County Roads 24 and 23, and the intersection of County Road 22 and US Highway 85. He stated the corridor will provide a regional connection between 1-25 and County Road 49. He stated the reason the project is needed is to improve the regional east-west connectivity, particularly in the future. Mr. Howard stated the project will connect two existing primary corridors that serve surrounding communities, and it will prevent the potential impact of segmented developments. He stated the preferred alignment will serve as a guide for which rights-of-way need to be preserved by the appropriate agencies. He stated the study is a planning effort and it is intended to conduct enough conceptual design to assess alignment alternatives for the sake of preserving right-of-way. Mr. Howard stated there is currently no funding for the construction of the roadway, and the necessary funds may not be available for many years. He stated the original study boundaries were expanded in order to consider additional alignments after one of the open houses was held at which the public expressed it would like staff to investigate additional alignments. Mr. Howard reviewed the study process,which begins with data collection, then identifying alternatives, evaluating the alternatives, presenting the alternatives to the public through open houses, and lastly, the alternatives are compared with the design criteria to determine the recommended alignment. He stated this particular study was presented to the Board last year and it determined the corridor needed to be further evaluated at that time, based on public testimony. He stated staff further investigated the flood plains, wetland boundaries, 2008-3289 EG0058 HEARING CERTIFICATION PAGE 2 existing roadways, and potential wildlife habitat. Mr. Howard stated the preferred alignment that staff recommended to the Board on October 1, 2007, was rejected, and since that time staff and committee members have met with land owners, toured sites, evaluated new information, further researched the potential impacts of the alignments, and conducted two more open houses on July 17, 2008 and September 10, 2008. He stated three new alternatives were added to the study area as a result of the process. He stated when considering the new alignment alternatives staff strived to avoid the wetlands. He stated the following criteria were used to evaluate the alternatives: social, including transportation effectiveness, safety, and land use consequences; economic; construction; and environmental criteria, including wetlands, wildlife areas, and flood plains. Mr. Howard stated the Committee focused on primary areas of concern, and the details will be focused on after a route is selected. He stated Alternative #3a ranked the highest using the criteria, Alternative 4 ranked the next highest, and Alternative #3 ranked the third highest. He further stated Alternative#3a has a curve which is less sharp than the route presented in October, and it follows the old railroad right-of-way, and then it follows the Section Line across County Road 22 and connects to US Highway 85. Mr. Howard stated the positive attributes of Alternative #3A are the safety benefits, the effective use of existing parcel lines, reduced segmentation of existing parcels, low environmental impacts, reduced potential flood plain effects to existing structures, and it received the highest number of votes from the general public at the open houses. He stated the next step will be the adoption of the study, which will be considered by the Board in two weeks and, if approved, the agencies involved will incorporate the study into the planning process for rights-of-way preservation and Weld County will coordinate with other agencies as development occurs. In response to Commissioner Rademacher, Mr. Howard stated 140 feet of right-of-way will be reserved. Responding to Chair Jerke, Mr. Howard stated both Alternatives#4 and #4a will cut across the Miller parcels if selected. Further responding to Chair Jerke, Mr. Howard stated Alternative#4 ranked second highest using the criteria. Chair Jerke stated he is surprised Alternative #4 ranked the second highest, since it will be more difficult to mine gravel reserves in the future if it is selected. Mr. Howard stated he is also surprised Alternative#4 ranked second and the criteria scoring can be misleading. He stated all of the committee members preferred Alternative 3a. In response to Commissioner Garcia, Mr. Howard stated there was no way to completely avoid curves, since the best way to build a road across a flood plain is at a 90-degree angle. He further stated curves were necessary to connect County Road 22 and US Highway 85. Further responding to Commissioner Garcia, Mr. Howard stated US Highway 85 is a difficult area to connect to. Robert Temmer, Weld County resident, stated he has attended the public open houses and has submitted comments to, and met with, Mr. Howard. Mr. Temmer stated the second curve of the preferred alignment cuts off a corner of his property and it travels along the south side of his property. He further stated the preferred alignment will take a portion of each of his two hayfields. Mr. Temmer stated Weld County is an agricultural community and the preferred alignment will not protect the agricultural heritage. He further stated the road is for the urban community. He stated Mr. Howard indicated the preferred alignment will have a minimal impact on the environment; however, it will create a new bridge across the South Platte River, which will travel directly through the middle of a wildlife habitat containing ducks, geese, coyotes, white-tailed deer, and prairie dogs. Mr. Temmer stated the preferred route uses the railroad right-of-way, and the route was initially rejected due to a concern about hazardous materials possibly being present there, and there have not been any studies conducted to discover whether or not hazardous materials are present. He stated the current traffic flow from County Road 24 to US Highway 85 is to follow 2008-3289 EG0058 HEARING CERTIFICATION PAGE 3 County Road 23 when arriving at the intersection of County Roads 23 and 24, then follows Sand Point Reservoir to County Road 18, and County Road 18 connects to US Highway 85. Mr.Temmer stated the County replaced a bridge over an irrigation ditch on County Road 18 this year and the main bridge over the South Platte River has been replaced within the last five years. He stated he was told County Road 18 does not connect with County Road 49; however, the road can be extended to do so. He further stated County Road 22 is also an acceptable route, on which the County may utilize existing rights-of-way and no new bridges are required. He stated Alternative #3a will result in purchasing a large amount of right-of-way; constructing an entire new road; and constructing multiple bridges, including a large bridge across the South Platte River,which will cost millions of dollars. Mr. Temmer stated the route he has proposed is not as direct as Alternative #3a; however, it does not need to be direct, as it is in an agricultural area. He stated in an agricultural community people sometimes have to travel out of their way to reach their destination, and it is a part of living in an agricultural community that cannot be avoided. He further stated he is opposed to the additional traffic and noise Alternative #3a will create. Mr. Temmer stated the placement of Alternative#3a will put his nearest neighbor's home at risk when the roads are slick. In response to Commissioner Rademacher, Mr. Temmer stated there are between 18 and 24 houses in the area. In response to Chair Jerke, Mr.Temmer stated he is unsure of how many acres will be severed from his fields for Alternative #3a. Robert Nash, Weld County resident, concurred with Mr. Temmer. Mr. Nash stated he moved into his dream home upon retiring, and after examining Weld County maps to ensure there was no planned development for the area. He stated licensed real estate agents have indicated to him that the road will decrease the property value of his home; however, there is nothing in the study regarding compensation to the surrounding property owners who will be affected by the noise and pollution. He stated the study indicates the reason for the proposed road is to connect population centers; however,there are no populated areas on the route. Responding to Mr. Nash, Mr. Howard stated the proposed road will connect one major part of Weld County, which is located east of US Highway 85, to a rapidly developing part of Weld County, which is located near 1-25. Mr. Howard stated the concept for this roadway has been around since 2001, when the Board adopted the Strategic Roadway System; however, the study more clearly defines the proposed path. In response to Mr. Nash, Mr. Howard stated if a person lives on the east side of Highway 85 and wishes to travel on 1-25, there are a limited number of ways to do so. Mr. Howard stated as more development occurs east of US Highway 85, it will become clear this roadway is very much needed. Chair Jerke stated County Road 49 has an average daily traffic count in the thousands and it is a major thoroughfare between 1-76 and US Highway 34. Responding to Mr. Nash, Mr. Barker stated the affected properties will be appraised, and the appraisal will consider diminished property values, in addition to the cost of obtaining right-of-way. Mr. Barker stated if any part of a property is taken for the roadway, that will be one of the elements considered when providing compensation. Chair Jerke stated Mr. Temmer may end up having a remaining lot on the corner, which will be an asset for the property owner. In response to Chair Jerke, Mr. Nash stated the entire area is on a 100-year flood plain. In response to Commissioner Rademacher, Mr. Nash stated he lives on County Road 22.5. Brad Windell, Weld County resident, stated he is in attendance to represent his family and the family business. Mr. Windell stated the road will be approximately 20 yards away from his front door, and he moved to his current residence in an effort to escape urban sprawl. He encouraged the Board to look further into the preferred alternative before selecting it. He stated he has owned 2008-3289 EG0058 HEARING CERTIFICATION PAGE 4 a business named Aquatic and Wetland for 25 years and approximately one third of the work he has performed has been heavy highway construction, including building roadways, bridges, and dams. He stated the plan for Alternative#3a is not cost effective, since it includes building a road almost entirely in the flood plain. He further stated there is a superior option, which is taking County Road 24 to US Highway 85. Mr. Windell stated earlier planners intended for the roads to be laid out on section lines. He stated the criteria used to rate the proposed alignments are not adequate. He stated a straight alignment was never considered as an alternative, and according to his calculations, the straight alignment will cost approximately one-third less than the proposed route. He further stated he does not believe it will be difficult to connect to Highway 85 and the Colorado Department of Transportation (CDOT) will work with Weld County on the matter. Mr. Windell stated he does not believe an adequate study has been conducted regarding the surrounding wildlife and there is a substantial wildlife corridor which will be affected on the proposed route. He further stated the study does not consider building a wildlife crossing structure. He stated the study fails to consider the constraints of the road traveling through the flood plain and decreased property values. Mr. Windell further stated the proposed road will travel 25 feet away from his father's home. He stated the study does not address noise mitigation and there will be a four way stop on a road with a 60 mile-per-hour speed limit where his property is located. Mr. Windell stated he leases some of his land out for hunting migratory birds and the road will be built directly through it. He stated on the straight alignment he was told there is a problem with a wetland area; however, he examined the wetland and determined it is a manmade wetland, which has been created by the Platte Valley Ditch; therefore, it is not a problem. He stated agriculture is the backbone of the County and the proposed route does not promote rural preservation. He further stated the proposed route will contain dangerous curves, which will be particularly dangerous when the sun shines in peoples' eyes when traveling south in the morning and when fog is present. Mr.Windell stated urban sprawl will be a consequence of selecting Alternative#3a, and the Board needs to consider the plans our forefathers had for County growth. He stated that Commissioner Rademacher should rescind himself from making a decision on this matter because he has a relationship with Ronald Zaruba, a Weld County resident who would be adversely impacted by the straight road alignment. Kenneth Miller, Weld County resident, stated he farms and ranches and he is in support of Alternative #3a because it will be good for Weld County. Mr. Miller stated the proposed route is also good for his family since it does not cross most of his fields or divide his operations, as other proposed routes will do. He stated other positive aspects of Alternative #3a are there are high banks on both sides of the proposed bridge site, it travels through the least amount of wetlands, and it has the least impact on surrounding wildlife of all of the proposed routes. Gregory Light, Weld County resident, stated he lives on the property adjacent to Mr. Temmer and Mr. Windell on County Road 25. Mr. Light stated the false premises of the study are bothersome, for example, the study assumes that Weld County needs additional roadways; however, there are currently several ways available to cross the South Platte River on County Roads 28 and 18. He stated he has never seen traffic congestion on either of those roads. He further stated the term strategic roadway is being used loosely, as it is not imperative that the proposed road be constructed. Mr. Light stated if additional roadway is needed, County Road 24 should be expanded. He stated Weld County has a rural tradition, and submitted Exhibit H into the record, the Petition for Domestic Tranquility Against 3a. He stated the existing roads effectively serve the public and will continue to do so. Mr. Light requested that the Board reject the preferred alignment, 2008-3289 EG0058 HEARING CERTIFICATION PAGE 5 since it is an unwanted and unneeded highway. He stated he is concerned about a highway being built which is half the length of a football field where there is currently a country road. He clarified that he is concerned about the highway being placed in close vicinity of children and livestock. He concurred with Mr. Windell that it is appropriate for Commissioner Rademacher to rescind himself on this matter when it is considered for approval. Chair Jerke stated the Board will make a decision regarding the study on December 31, 2008, and the hearing today is solely for the purpose of public input. In response to Commissioner Rademacher, Mr. Howard stated the railroad right-of-way no longer exists and the rights-of-way have reverted back to the land owners. He stated he is unsure of how wide the right-of-way was when it belonged to the railway; however, it is a single parcel boundary line at this point. Further responding to Commissioner Rademacher, Mr. Howard stated County Road 24 does not presently connect with US Highway 85. In response to Commissioner Rademacher, Mr. Howard stated it will be difficult to cross the flood plain and the final design will examine the construction plan in detail; however, the proposed placement of the bridge seems to be in a very good location. He stated there used to be a bridge at County Road 22.5; however, the former route was not considered a viable alternative due to new development in the area. There being no further discussion, the hearing was completed at 12:00 p.m. This Certification was approved on the 15th day of December, 2008.
