NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Subdivision Bond #5030631, drawn on Bond Safeguard Insurance Company, in the amount of $600,000.00 be, and hereby is, canceled and released, and the replacement Bond, in the amount of$90,000.00 be accepted. Weld County Public Works Department has reviewed final plan materials submitted to our office and has the following development referral comments. Comments ❑ The Public Works Department has received a request from the applicant, Mr. Jon Benallo, SouthWestern Investment Group, LLC, requesting a partial release of warranty collateral for off-site improvements as part of the LONG-TERM ROAD MAINTENANCE AND IMPROVEMENTS AGREEMENT FOR COUNTY ROADS 18 AND 25 (CHAMBERS) Document #2005-1056, pertaining to USR-1444 in an email dated June 25th, 2008. The specific portion of Document #2005-1056 referenced for this partial release of collateral is found in the Improvements section, pages 2-3 and is referred to as the "NORTH WCR 25 SEGMENT". I performed a final inspection of the site on June 24th, 2008 and found the work completed to be acceptable, except for two areas that will need monitoring by SouthWestern Investment Group throughout the next year. o The shoulders throughout the project will need to be stabilized if they fail to maintain their present slope in order to protect the structural integrity of the road prism, thus providing a safe driving surface for the general public. o The transverse asphalt tears that have been repaired, and any new tears that appear during the coming year, will need to be monitored and repaired, in order to protect the structural integrity of the road prism, thus providing a safe driving surface for the general public. o Public Works has reviewed the request and feels that the request is in line with the work completed. The email requests that the surety be reduced by $510,000 from the total $600,000 warranty collateral in Subdivision Bond #5030631 from Bond Safeguard Insurance Company. $90,000 will remain as part of the 15%retainage required for the one year warranty period. Mr. Benallo would like confirmation as soon as possible so he can have his bond reduced accordingly. If you find the memo acceptable, can I send it to Mr. Benallo as documentation necessary in order to have his bond reduced or should we wait for Planning to concur with our assessment of the collateral release? If the final comment in the memo referencing the lack of an On-Site Agreement needs removal, in order to dissuade any angst placed upon Planning, then feel free to do so.
