RE: APPROVE PARTIAL CANCELLATION AND RELEASE OF COLLATERAL AND
ACCEPTANCE OF REPLACEMENT COLLATERAL FOR USE BY SPECIAL REVIEW
PERMIT#1444 - SW CHAMBERS, LLC, DBA HEIT FARMS GRAVEL PIT
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated January 7, 2004, the Board approved the application of
Heit Farms, Ltd, LLP, 4520 County Road 27, Fort Lupton, Colorado 80621, and 333 West
Hampden Avenue, Suite 810, Englewood, Colorado 80110, now known as SW Chambers, LLC,
7600 East Orchard Road #307-South, Greenwood Village, Colorado 80111, for Use by Special
Review Permit#1444 for a Mineral Resource Development Facility, including Wet and Dry Open
Pit Mining and Materials Processing and an Asphalt and Concrete Batch Plant, in the
A (Agricultural) Zone District on the following described real estate, to wit:
Lots 4, 5, and 6, Lupton Meadows Land Division
No. 1; being part of the N1/2SE1/4 and part of the
S1/2NE1/4 of Section 13, Township 2 North, Range
67 West of the 6th P.M.,Weld County, Colorado, and
WHEREAS, on November 5, 2007, the Board of County Commissioners of Weld County,
Colorado, approved a Long Term Road Maintenance and Improvements Agreement between the
County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld
County, and SW Chambers, LLC, dba Heit Farms Gravel Pit, with terms and conditions being as
stated in said agreement, and accepted Subdivision Bond #5030631, drawn on Bond Safeguard
Insurance Company, 1919 South Highland Avenue, Building A, Suite 300, Lombard, Illinois 60148,
in the amount of $600,000.00, and
WHEREAS, staff from the Weld County Department of Public Works has conducted a
visual inspection and recommends release of a portion of said collateral in the amount of
$510,000.00.
WHEREAS, the Board has been presented with replacement Bond #5033938, drawn on
Bond Safeguard Insurance Company, in the amount of$90,000.00, effective July 7, 2008, which
shall be retained for a period of one year as warranty collateral.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Subdivision Bond #5030631, drawn on Bond Safeguard Insurance
Company, in the amount of $600,000.00 be, and hereby is, canceled and released, and the
replacement Bond, in the amount of$90,000.00 be accepted.
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby is,
directed to return said collateral to the appropriate issuing party.

remain in full force and effect.
PROVIDED, HOWEVER, that Owner shall give Contractor and Surety notice of observed
defects with reasonable promptness.

Rich Hastings performed a final inspection of this USR site on June 24,2008,and found the required
work completed and acceptable for the Long-Term Road Maintenance and Improvements Agreement
for WCR 18 and WCR 25 (Chambers) (Doc #2005-1056).
The Weld County Public Work Department recommends partial release of collateral in the amount of
$510,000. The amount of$90,000 (15%) shall be retained as collateral for a period of one year as
warranty.
After the one-year warranty period,the applicant shall request a final inspection for consideration of
the final release of collateral.
The appropriate documentation is attached.

SUBJECT: USR#1444 SW Chambers, LLC/Heit Farms, LTD Gravel Pit Partial
Collateral Request/Release.
Weld County Public Works Department has reviewed final plan materials submitted to our office and has the
following development referral comments.
Comments
❑ The Public Works Department has received a request from the applicant, Mr. Jon Benallo, SouthWestern
Investment Group, LLC, requesting a partial release of warranty collateral for off-site improvements as part
of the LONG-TERM ROAD MAINTENANCE AND IMPROVEMENTS AGREEMENT FOR COUNTY
ROADS 18 AND 25 (CHAMBERS) Document #2005-1056, pertaining to USR-1444 in an email dated
June 25th, 2008. The specific portion of Document #2005-1056 referenced for this partial release of
collateral is found in the Improvements section, pages 2-3 and is referred to as the "NORTH WCR 25
SEGMENT". I performed a final inspection of the site on June 24th, 2008 and found the work completed to
be acceptable, except for two areas that will need monitoring by SouthWestern Investment Group
throughout the next year.
o The shoulders throughout the project will need to be stabilized if they fail to maintain their
present slope in order to protect the structural integrity of the road prism, thus providing a safe
driving surface for the general public.
o The transverse asphalt tears that have been repaired, and any new tears that appear during the
coming year, will need to be monitored and repaired, in order to protect the structural integrity of
the road prism, thus providing a safe driving surface for the general public.
o Public Works has reviewed the request and feels that the request is in line with the work completed. The
email requests that the surety be reduced by $510,000 from the total $600,000 warranty collateral in
Subdivision Bond #5030631 from Bond Safeguard Insurance Company. $90,000 will remain as part of the
15%retainage required for the one year warranty period.
Recommendation
❑ Public Works agrees with this request and all relevant supporting documentation, except for an On-Site Maintenance
Agreement,has been received and is on file in Public Works.

Please review the attached memo, and advise accordingly as this takes a slightly different
tact compared to the usual subdivision releases. Mr. Benallo would like confirmation as
soon as possible so he can have his bond reduced accordingly. If you find the memo
acceptable, can I send it to Mr. Benallo as documentation necessary in order to have his
bond reduced or should we wait for Planning to concur with our assessment of the
collateral release? If the final comment in the memo referencing the lack of an On-Site
Agreement needs removal, in order to dissuade any angst placed upon Planning, then feel
free to do so.

bond.

This letter shall act as a reminder to you of your obligations to the Board of County Commissioners of
Weld County under the above-referenced Maintenance Bond.
As you are aware, on the 7th day of July, 2008, Bond Safeguard Insurance Company, issued a
Replacement Maintenance Bond on behalf of S W Chambers, LLC, naming the Board of County
Commissioners of Weld County as beneficiary. The dollar amount of the Maintenance Bond was
established at Ninety Thousand and 00/100 ($90,000.00).
The terms of the Maintenance Bond require that it be maintained by your institution until the 7th day of
July, 2009. If the bond expired prior to that date, you must replace it.
