After the first reading the Board at a work session approved the following change to Sec.
29-3-70 Moved Buildings
3. Mechanical. Mechanical systems and equipment serving the building, heating, cooling
or ventilation needs shall comply with Section 403 of the International Energy
Conservation Code except sizing as required by Section 403 .6. Gas appliances must meet IMC
requirements for combustion air, venting, and required shutoff valves.

Subject: Changes to Chapter 29 of the Weld County Code.
1. Adoption of the 2008 National Electric Code with amendments.
2. Adoption of the 2006 International Energy Conservation Code.
3. Changes to Section 29-3-70 Moved Buildings. These changes are due to the code adoptions of the 2008
National Electric Code and the 2006 International Energy Conservation Code.
The changes that I am proposing have been reviewed and unanimously approved by the Building Trades
Advisory Board and the Planning Commission.
The adoption of the 2008 National Electric Code directly impact single family dwellings.Three of the new code
requirements are:
1. Tamper resistant receptacles required throughout.
2. Arc fault protection in all 15 and 20 amp circuits.
3. Outside receptacles are required to be weather resistant.
The recommendation from the Building Trades Advisory Board and the Planning Commission is to adopt the
2008 National Electric Code with the existing amendments.
The adoption of the International Energy Conservation Code has been mandated by the State of Colorado.
Jurisdictions have until July 1, 2008 to adopt ata minimum,the 2003 International Energy Conservation Code.
Adopting the 2006 version will mean all of the adopted International Codes will be on the 2006 cycle.
The recommendation of the Building Trade Advisory Board and the Planning Commission is to adopt the 2006
International Conservation Energy with the two amendments.
The changes to Section 29-3-70-Moved buildings- are to reflect the code requirements in the 2008 National
Electric Code and the 2006 International Energy Conservation Code. The recommendation of the Building
trade Advisory Board and the Planning commission is to adopt this section.

The publication of the National Fire Protection Association,known as the National Electrical Code,2005
2008 Edition,NFPA No. 70-20007 2008 is incorporated by this reference as a part of this Building Code for
the purpose of establishing standards for the inspection of electrical installations and issuance of electrical
permits in the County, with the following amendments:
A. Add Section 230.70(A), Exception No. 1:
"The service disconnecting means may be located inside a building or structure at a readily
accessible location if the service disconnecting means is placed back-to-back with the metering
equipment and the total service entrance conductor length does not exceed three feet six inches
measured from the exterior wall of the structure. The service disconnecting means shall also be
located on the ground level."
B. Add Section 230.70(A), Exception No. 2:
"The service disconnecting means may be located inside a building or structure at a readily
accessible location if the service entrance conductors enter the building under a minimum two-inch-
thick concrete slab or floor. The total length of the service entrance conductors from the top of the
floor to the point of termination in the service disconnecting means shall not exceed seven feet. The
service disconnecting means shall be located on the ground level. Service conductors installed
under and inside the building shall be installed in an approved raceway for their entire length."
C. Add Section 250.52, Exception 2 after Section 250.52 Exception:
"Existing water supply or distribution systems which have not been changed,modified or expanded
shall not be required to be modified by installing ten feet of underground metal water pipe in direct
contact with the earth. However,two eight-foot ground rods shall be installed no less than six feet
apart."
D. Add Section 300.5(L):
"All electrical underground wiring located outside a building or structure shall be separated by a
minimum of twelve inches from all other underground utilities, including telephone and cable
television. Such separation may be horizontal or vertical. Gas piping shall be in a separate trench."
E. Add the following sentence to Section 511.3(B):
"The areas described in Sections 5I 1.3(A)and(B)shall also apply to private garages as defined by
the IBC."

The publication of the International Code Council, Inc.. known as the International Energy Conservation
Code, 2006 Edition are incorporated by this reference as a part of this Building Code with the following

A. Amend Section 201.3 by substituting "adopted Electrical code for the ICC Electrical Code in all
sections throughout this code.
B. Amend Section 401.3, first sentence as follows "A permanent certificate shall be posted in a

1. Definitions.
Residential structures means any buildings which are Group R Occupancies as defined in the IRC.
These include but are not limited to,one and two family residences,townhouses,condominiums,
lodging houses,apartment buildings,hotels and motels,manufactured homes as defined in Section
29 1 20 and mobile homes as defined in Section 29 120 of this Chapter. (Energy conservation
values for manufactured housing shall be as per I IUD requirements).- Group U Occupancies as
defined in the IBC are exempt from the requirements of this Subsection A. Included in this
exemption would be private garages, carports, sheds, agricultural buildings, tanks and towers.
R Value means the reciprocal of the average overall coefficient of heat transmission in British
Thermal Units(BTUs)per hour. The term is applied to usual combinations of insulation materials,
as generally recognized and accepted in the residential building construction industry.
2. Insulation requirements.
a. In addition to the requirements of the IRC, insulation in residential buildings in the County shall
conform to the following standards contained in Table 29.1:

b. Insulation having a minimum R Value of 11 shall be used in all exterior walls contiguous to
unheated areas above grade.
c. Insulation having a minimum R Value of 19 shall be used in all exterior ceilings of heated areas
above grade.
d. All windows shall be double glazed.
e. All exterior doors or doors leading to unheated areas above grade shall be weather stripped and
sliding glass doors shall be double glazed.
f. Crawl spaces may be insulated by different methods as described below:
1) If a furnace is installed in the crawlspace, the foundation walls may be insulated with
minimum R 11 insulation and closable vents installed.-Air vents meeting the code must be
installed to provide combustion air for the furnace or other gas appliances. If the crawlspace
is heated,then the foundation walls must be insulated with a minimum of R 11 insulation and
no exterior vents installed,provided that no heating equipment is installed in the crawlspace.
2) In an unheated crawlspace either the subfloor or the walls of the crawlspace can be insulated.
If the crawlspace walls are insulated, floor joist end cavities around the perimeter of the
crawlspace must also be insulated. When the floor is insulated,then heating ducts are to be
insulated with a minimum of R 1 insulation.-Crawlspace walls are to be insulated to a depth
of a minimum of eighteen(18)inches below grade. Such shall be covered with a material that
meets the restrictions of the IRC. (See Section R311.2.3 IRC for foam plastic insulation.)
g. Computation submitted by a licensed architect or engineer that the total energy required in a
residential building, through design or otherwise, equals or is less than the total energy used if
the building is built according to standards contained in this Section, shall be considered an
acceptable alternative for conformance with the prescriptive standards set forth in this Section.
The total energy required shall be computed as the annual estimated BTUs necessary to heat,
cool and light the proposed residential building.-(Weld County Code Ordinance 2003 1 1)
Sec. 29-3-70. Moved buildings.
A. Building permits issued pursuant to this Article are required prior to any buildings or structures being
moved into or within the County. A pre-move permit shall also be obtained from the Building
Inspection Department and a pre-move inspection shall be made before a building permit is issued to
determine any unsafe or substandard conditions. Any conditions determined to be unsafe or
substandard as defined in Sections 29-11-30, 29-11-40 and 29-I 1-50 of this Chapter, will need to be
corrected in accordance with approved plans and prior to the issuance of a certificate of occupancy.
B. In addition, the following items are required for moved buildings of Group R Occupancies:
1. Building/structural:
a. Egress windows and window wells shall be installed according to the IRC and to the adopted
Energy Codc.
b. Any opened walls are to be framed according to the IRC.
c. All attic spaces having a height thirty (30) inches or greater shall have an access opening of
twenty-two (22) inches by thirty(30) inches.
d. Under-floor spaces shall be provided with an access opening measuring eighteen(18)inches by
twenty-four(24) inches.
2. Insulation. Ceilings shall be insulated to R 19. R-38 Walls that are opened shall be insulR'�a`^o
-1-1-. have the cavity completely filled with insulation or be insulated to R-19. Subfoors-over
unheated crawlspaces or side walls of* ^a " "^"be ins late Foundations systems
shall he insulated according to Section 29-2-90.A.2.f of this Chapter.
3. Mechanical. Mechanical systems and equipment serving the building,heating,cooling or ventilation
needs shall comply with Section 403 of the International Energy Conservation code. Gas appliances
must meet IMC requirements for combustion air, venting and required shutoff valves.
4. Glazing. Double-pane or storm windows shall be-installed present throughout the dwellings with
safety glazing installed where required by the IRC.
5. Electrical:
a. Smoke detectors are to be hard wired with battery backup and located where required by the IRC.
b. The minimum electrical service shall be one hundred (100)amps. A main breaker is required.
All bonding and grounding must be as outlined in the NEC.
c. GFCI protection for personnel must be installed as required by the Electrical Code.
d. Receptacles as specified,shall be spaced and installed at locations required by NEC.
e. All open splices in attics or under subfloors shall be accessible and placed in boxes with covers.
Any metal boxes or covers shall be properly grounded.
f. A separate circuit shall be provided for central heating equipment such as a furnace or boiler.
g. Arc-fault circuit interrupter protection must be installed as required by the Electrical Code.
h. Electrical devices,fixtures and penetrations shall be durably sealed to limit infiltration according
to adopted energy Code.
C. Buildings or structures to be moved into or within the County shall not be required to conform to all of
the requirements of this Chapter for new buildings or structures as determined by the Building Official.
D. Any new work that is done to a moved structure must meet the requirements of the adopted codes of
this Building Code. (Weld County Code Ordinance 2003-11)

added that he feels they have a duty to the Board of County Commissioners that we send them completed
cases and this one is not complete. If we gave them another two weeks, and the applicant seems to be
on board with that, and if staff feels that they don't have enough time within those two weeks to make the
February 19, 2008 meeting then we can move it to the March 4, 2008 meeting.
Commissioner Spitzer stated that he is in favor of the continuance just so they could have a little more
information and know that they are going to be giving the County Commissioners something that is really
going to fit with the code.
The Chair asked Mr. McCormick if continuing it out one month will cause any hardship on the applicant. Mr.
McCormick replied that it is better than being denied.
Tom Holton moved to continue Case USR-1642 to the February 19, 2008 Planning Commission meeting,
seconded by Roy Spitzer.
Commissioner Lawley stated that he wants the applicant to understand what needs to be submitted. Mr.
McCormick stated that he understands he needs to have 1) preliminary perks of the location of where the
septic systems will be located and 2) preliminary drainage report complete and stamped.
The Chair asked the secretary to poll the members of the Planning Commission for their decision. Nick
Berryman, yes; Paul Branham, Absent; Erich Ehrlich, yes with comment; Robert Grand, yes; Bill Hall, yes;
Mark Lawley, yes; Roy Spitzer, yes;Tom Holton, yes; Doug Ochsner, yes. Motion carried unanimously.
Commissioner Ehrlich commented that he needs clarity on the drainage report and also how that
coincides with the Cache la Poudre Irrigation Company. He added that is not too sure about building
codes and the Eaton Fire District and that goes to the denial that the Planning Staff put in which is Section
23-2-220.A.7.

Weld County Code Changes

Tom Honn, Director of Planning Services, stated that there are two basic code changes that we are
processing to be adopted by mid-summer as dictated by State Legislature. He pointed out that one of
changes is revisions to the Electrical Code and the other has to do with the Energy Code conditions.
Mr. Honn mentioned that the Building Department has reviewed this through the Building Code Advisory
Group and added that they also sent letters out to contractors that operate within the County and invited them
to a public meeting.
Roger Vigil, Department of Building Inspection, stated that there are three changes to Chapter 29 that are
being proposed: 1)Adoption of the 2008 National Electric Code with amendments, 2)Adoption of the 2006
International Energy Conservation Code, and 3)Changes to Section 29-3-70 Moved Buildings.
Mr. Vigil commented that they invited a number of people to a public meeting because there are three
changes in the National Electric Code that are going to directly impact contractors and homeowners. He
added that the Energy Code mandated by the State is going to really present a new way to insulate dwellings
and to meet the code.
Mr. Vigil stated that the only change to the National Electric Code is the date from 2005 to 2008. The
amendments are all staying the same.
Mr. Vigil commented that with regard to the Energy Code, they are asking to adopt the 2006 International
Conservation Energy Code. It is going to be adopted with two amendments. The first amendment will be to
substitute the adopted Electrical Code for the ICC Electrical Code and the other amendment is going to allow
the permanent certificate to be in a conspicuous place. The 2006 Energy Code requires that it be affixed to

the electrical box and they feel that this gives a little more leeway with the contractors as then they don't get
into labeling in the box.
Mr. Vigil stated that the last change is to Moved Buildings. He added that this is to reflect the changes in the
National Electric Code and the Energy Code. He said that they are going to require that the egress windows
have to be installed through the Adopted Energy Code. Previously it was R-19 and now the ceilings need to
be insulated to R-38. He added that in addition to that any wall that is opened shall have its cavity completely
filled with insulation,whereas before it needed to be R-11. The other change is that the foundation needs to
meet the requirement of this section which is in the prescriptive table shown in his presentation. Mr.Vigil also
added that as far as the mechanical code the heating, cooling and ventilation will also need to meet the
Energy Code.
Mr.Vigil moved on to the electrical requirements of a moved-in building. Arc-fault interrupters are required as
specified and the electrical devices,fixtures and penetrations shall be sealed to limit infiltration according to
the Energy Code.
Mr.Vigil pointed out the particulars of the National Electric Code. He commented that one of the big changes
is the tamper-proof resistant receptacles are going to be required throughout a dwelling so that a child can't
take a bobby pin and poke it in one side. He added that these receptacles also need to be a combination type
AFCI which is a change from the previous code. That will impact the builders as they go to purchase them.
Mr. Vigil mentioned that right now these are limited and is not sure how many supply houses carry that
product. However he is hopeful that by the time the code is adopted they will be available.
Commissioner Holton asked if these changes will be adopted regardless of what the Planning Commission
votes on. Mr.Vigil replied yes and added that with code requirements you can make it more restrictive but you
can't lessen the requirement of the National Electric Code or the Building Code.
Commissioner Holton commented that the proposed changes to the insulation code make no sense to him.
He added that for instance where it states that the cavity has to be completely filled. If you have a 2x6 wall
that you fill with foam insulation that you will give you an R-50 value. Mr.Vigil stated that the reason it has to
be filled to the capacity is because the insulating value won't be reached if it is not completely encapsulated in
that.
Commissioner Holton said that it still didn't answer the question as far as requiring an R-19 wall. Mr. Vigil
replied that the exception is there so that any filled wall only needs to be filled and it doesn't have to meet the
R-19, it gives a choice.
Commissioner Holton clarified that then you can have an R-19 value or fill the cavity. Mr.Vigil stated that was
correct.
Mr.Vigil continued to the changes with regard to the receptacle. He stated that the other requirement is that
outside or wet locations not only be protected but the receptacle itself is going to have to be weather resistant.
The current code just requires that it be covered.
Mr. Vigil moved on to the Energy Code. He said that the air infiltration needs to be taken care of. Therefore
windows, doors, soleplates, floors, plumbing, electrical, and service access needs to be maintained. He
added that Electrical Contractors are going to have to provide fixtures that meet the requirement for that.
Commissioner Holton brought the question up of the polyurethane foam in the wall again. He added that if you
interpret this new code then the foam will have to completely fill that cavity and it will make it so expensive that
you will not be able to have your house insulated with polyurethane foam which is the most effective and
efficient insulation that you can buy. Mr. Vigil said that that particular section is for moved-in housing.
Commissioner Holton indicated that he is talking about new construction or even a re-model. Mr. Vigil said
that the particular code is only for moved-in buildings. He added that if you look in that section it states that if
you open a wall then it needs to be filled to its capacity.
Commissioner Holton stated that according to the handout it states in Section 29-2-90 Table 402.1.1.b it
states"or insulation sufficient to fill the framing cavity; R-19 minimum." Mr. Holton stated that it doesn't say
"or R-19 minimum." He added that his concern with foam insulation is that it is expensive so a lot of people

don't want to deal with it, but when you start requiring cavities to be filled with foam insulation then you've
driven the contractors to a point where they can't compete. Mr.Vigil stated that out of 30 years of inspecting
moved-in buildings he has seen only 1 or 2 where they have opened the walls and removed everything and re-
insulated.
Commissioner Holton commented that according to the Energy Conservation Code it doesn't state"or R-19
minimum" it is just a semi-colon. Mr. Holton added that at some point he would like to see us stop adopting
codes and regulations that were basically built for the Northeast Coast. Mr.Vigil said that the 2003 Energy
Code contained 11 different zones throughout the United States. He added that the 2006 has only 4 zones
and the Northeast is different and the South is different and the strip right through where Colorado is zone 5.
Mr. Holton said that he understands that there are different requirements for us but he is just saying that all
those zones were designed from somebody back east, for instance vapor barriers.
Bryon Horgen, Building Department, wanted to clear up Mr. Holton's question. He commented that if you
move in a building from somewhere else and it's a 2x4 wall and you are going to remodel it, they are saying
that you can fill that with fiberglass insulation and then that would give you a value of R-13 and that would be
okay. Mr. Holton stated that they don't specify whether it is fiberglass or foam. Mr. Horgen said that if you do
2'/3 inches of foam you are going to get a value of R-19, then you don't have to fill the cavity up. Mr. Holton
commented that is not what is says in the code. Mr.Horgen replied that it states a minimum of R-19 or fill the
cavity; therefore if you can reach R-19 without filling it then it would be okay. Mr. Holton said that it doesn't
give you the option; it just says that it has to be filled.
Mr. Horgen commented that Mr. Holton is correct and added that the intent was that it needs to be filled or
meet a minimum of R-19. He added that we need to add"or meet a minimum R value of R-19." Mr. Holton
said that would be more specific.
Tom Holton made a motion to amend Section 29-3-70.B.2 to insert the word"or", seconded by Mark Lawley.
Motion carried.
Bill Hall moved to approve the amended Code Changes to Chapter 29 and to forward to the Board of County
Commissioners along with the Planning Commission's recommendation of approval, Roy Spitzer seconded
the motion. Motion carried unanimously.

Ester,
Tom Honn wants to conduct one more meeting with the public informing them of the changes
before any meetings with the BOCC. We are speaking to the Weld County Home Builders
Association on March 11, 2008. I am going to schedule a work session after that. The
public hearings can then be scheduled. Will this time table work? I am also sending a
final draft of the changes to Chapter 29.

Hi Esther,
I have some changes to Chapter 29 that will need to be scheduled for the Board.
1. Adoption of the 2006 International Energy Conservation Code.

The State of Colorado has mandated that the Energy code be adopted by July 1, 2008. I
would like to schedule the hearings so that we would meet that deadline. I am scheduling
with the Planning commission on February 5, 2008.
