RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST WILLIAM AND TERESA WOOD FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, William and Teresa Wood, ZCV #0800127, are allegedly in violation of the
Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 12th day of August, 2008, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, William and Teresa Wood were not present or represented at said hearing,
although all parties were notified of said hearing by Department of Planning Services staff, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until September 12, 2008, to allow adequate time for the property owners to submit
a Use by Special Review application or close the dirt bike track to the public, to bring the subject
property into compliance and for an inspection of the property by the Department of Planning
Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV#0800127 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against William and Teresa Wood to remedy the violation of the Weld County
Code, and any other persons occupying the properties, any persons claiming an interest in the
properties, and any persons acting in active concert with the identified parties, with an instruction
for delay of action upon such referral until September 12, 2008, to allow adequate time for the
property owners to submit a Use by Special Review application or close the dirt bike track to the
public, to bring the subject property into compliance.

received it. Therefore, I have no choice but to proceed with the violation process. If you choose to
continue to open/advertise the dirt bike track to the public (either via training, practice or recreational
purposes), a Use by Special Review(USR) permit is required. The first step in the process would be a
"Pre-Application" meeting. The paperwork is located at the following web address:

track. 1 trailer that looked like it could be used to haul a
bike. No pictures were taken during this inspection.
06/30/2008 Phone Call Theresa Wood called. She said they have closed the dirt
bike track. She said only her children would be using it.
I asked her to send me a letter stating such. She said
she would get that out to me.
07/16/2008 Property Inspected Upon a visual inspection of the property, the following
items were noted: I still could not verify one way or the
other if this site was open to the public. I still have not
received the letter that Teresa indicated she would send
me. No pictures were taken during this inspection.

This hearing will take place in the County Commissioners Hearing Room, first floor, Weld County
Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a
representative be in attendance to answer any questions the Board of County Commissioners
might have about the violations.
Please also be advised that I will be taking video and/or pictures from the road or adjacent
properties the business day before or as soon as possible to the above mentioned Violation
Hearing date.
The Department of Planning Services' staff will be recommending that the Board of County

• The pre-application request is the preliminary review of a land use proposal. Pre-application
reviews are required prior to beginning the application process; however, this review is not
an application.
• Pre-application reviews are held every Friday with the Weld County Departments of Public
Works and the Public Health and Environment. The first, third, and fifth Friday pre-applicant
reviews are held in the Greeley office. The second and fourth are held in the Longmont office

Posts: 10 hey everyone its ruggles again, some of you may not know but i have a sick motocrc
Joined- May 2, 2008 out by brighton. all sand basicly, gets really rough, great training. i am working on tr
it up and running for the public to come out and practice. i am just trying to get an o
what people thought and if they would pay 10 dollars to ride there. of course it wouk
watered and preped regulary but one of my goals would be to have it a little bit roug
normal colorado tracks. please call me and if you have not been out there yet call mi

some equipment to build the jumps up but the dirt is just amazing. with this injury tl
would like to try and get this up and running for everyone.
