a THIS MATTER came on for hearing pursuant to CRS §38-1-105
before a panel of commissioners to determine compensation on

ow August 22 , 1984 . Appearing for the Petitioner , Board of County
Commissioners , was Lee D. Morrison , Assistant Weld County
co Attorney . None of the other parties appeared. This Court ,
� having considered the Certificate of Ascertainment and
. Assessment and Report of Commissioners filed herein , and being
w C4 otherwise fully advised in the premises , DOTH FIND:
S 1 . That the findings of this Court entered nunc pro tune
June 19 , 1984 , are hereby reaffirmed.
rq w 2 . That the Commissioners have ascertained and assessed
the value of the property taken and found that there was no
damage to the residual as of the date of taking, May 3 , 1984 ,
following full hearing and inspection of the property.
3 . That the Commissioners determined the property taken
permanently as right-of-way is described as the West 40 feet of
Section 28 , Township 1 North, Range 68 West of the 6th Principal
Meridian in the County of Weld, State of Colorado, consisting of
an area of 4 .85 acres , more or less .
4 . That the Commissioners determined that the property
taken temporarily as a construction easement fbr a period of one
(1) year is described as :
The east 15 feet of the west 55 feet of
Section 28 , Township 1 North, Range 68 west
of the 6th Principal Meridian, Weld County,
Colorado; and

5 . That the value determined by the Commissioners as to
the property taken permanently is $5 , 450 . 00 .
6 . The value of the property taken for a construction
easement for a period of one (1) year was determined by the
Commissioners to be $150 . 00 .
7 . That the Petitioner has paid into this Court , on May
7 , 1984 , pursuant to the Order of Immediate Possession of May 3 ,
1984 , the sum of $4 , 700 . 00 .
IT IS THEREFORE ORDERED , ADJUDGED , AND DECREED that the
permanent right-of-way described herein has been duly and
lawfully taken by the Petitioner pursuant to the statutes and
Constitution of the State of Colorado ; that the title to said
permanent right-of-way is hereby vested in the Petitioner; and

that Petitioner be allowed use of the property temporarily taken
as described herein for a construction easement for a period of
one (1 ) year .
IT IS FURTHER ORDERED that a certified copy of this Rule
shall be of the effect of a Deed of Conveyance from the
Respondents to the Petitioner , and
IT IS FURTHER ORDERED that this Rule is conditioned on the
payment of $900 . 00 plus 6% per annum interest from May 7 , 1984 ,
to August 22 , 1984 , and 8% per annum interest from August 22 ,
1984 , in addition to the $4 , 700 . 00 previously deposited with
this Court .
