RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST THOMAS AND KATHLEEN HOUSTON FOR VIOLATION OF THE
WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Thomas and Kathleen Houston, ZCV#0701211, are allegedly in violation of
the Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 17th day of June, 2008, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Thomas and Kathleen Houston were not present or represented at said
hearing, although all parties were notified of said hearing by Department of Planning Services staff,
and
WHEREAS, the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until August 17, 2008, to allow adequate time for the property owners to restore,
remove or screen the noncommercial junkyard from all adjacent properties and pubic rights-of-way,
and to remove the commercial vehicle to bring the subject property into compliance and for an
inspection of the property by the Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV#0701211 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Thomas and Kathleen Houston to remedy the violation of the Weld
County Code, and any other persons occupying the properties, any persons claiming an interest
in the properties, and any persons acting in active concert with the identified parties, with an
instruction for delay of action upon such referral until August 17, 2008, to allow adequate time for
the property owners to restore, remove or screen the noncommercial junkyard from all adjacent
properties and pubic rights-of-way, and to remove the commercial vehicle to bring the subject
property into compliance.

REMEDY

District, it must be completely SCREENED from all adjacent properties and public rights-of-ways;
otherwise, any derelict vehicles, iron/metal, tires, wood, air conditioner, a bath tub and miscellaneous
debris shall be restored (maintain current registration and completely operable) or removed from the
property.
The presence of more than 1 (one) COMMERCIAL VEHICLE requires a Use by Special Review. If you
have any questions that you would like to discuss with a Planner, an appointment must be scheduled
with Kim Ogle, Planning Manager at 970-353-6100 Ext. 3540. To better serve you please bring this letter
with you.
RECOMMENDATION
The Department of Planning Services recommends this case be forwarded to the County Attorney's
Office, but to delay legal action for 60 days.

05/07/2008 Property Inspected Upon a visual inspection of the property, the following
items were noted: derelict vehicles, iron/metal, tires,
wood, air conditioner, a bath tub and miscellaneous
debris.
06/11/2008 Phone Call I spoke with Tom Houston (303-875-7652). At first he
indicated that he didn't see the problem. When I started
to explain, he said, he had read through the letter so he
understood what we were saying. I explained that this
was my 3rd letter. He said he was unaware of other
letters. I asked him if he would like me to meet with him
on the property. He wanted to know who turned him in. I
explained that we do not release that information without a
court order. I explained that a property is either in
violation or it is not and who turned a property in really is
irrelevant. He said it does matter if the individual doesn't
even live in the area. Then he said he did have (back?)
surgery last year and did fall behind in the maintenance of
the property. He stated that he currently has 4 project
cars. He said the tow truck is going to the salvage yard.
He stated that the iron/metal is going to be picked up and
stacked neatly. He thought I wanted him to get rid of the
iron/metal. I explained that was not the case. He said he
would and already was trying to work on the property;
however, he can only do the work on the weekends -he
works during the week. He then said, "Find me one farm
that doesn't have any derelict vehicles." I explained that
honestly wouldn't be difficult. He said he disagreed. I
said you know you're not running a farming operation on
these 9 acres. He said he knew, but just for argument
sake. He said he realized he needed to clean up the
property. He said he just fell behind on keeping it kept
up. He asked if he should attend the hearing. I explained
that it would be a good idea. He said he would attend the
Violation Hearing. He said he was going to need a couple
of months to clean it up. I told him that I would support
him requesting a 60 day delay of legal action. I asked
him again if he would like me to meet with him on the
property. He said give me 30 days and then we'll
schedule a meeting.

Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a
representative be in attendance to answer any questions the Board of County Commissioners

The presence of DERELICT VEHICLES, tires and miscellaneous debris constitute a
NONCOMMERCIAL JUNKYARD. While a Noncommercial Junkyard is an allowed use on
Agriculturally zoned properties, it shall be completely SCREENED from all adjacent
properties and public rights-of-ways; otherwise, it shall be restored or removed.
The Weld County Code allows 1 (one) COMMERCIAL VEHICLE per lot without obtaining
any zoning permits; however, the presence of more than 1 (one) Commercial Vehicle does
require a zoning permit. For questions, I suggest you speak to one of our"On-Call"
Planners. To better serve the public, we have 2 locations open. Our North office is located

DERELICT VEHICLE: A vehicle that is inoperable (unable to move under its own power); is
partially or totally dismantled; has all or portions of its body work missing or is substantially
damaged; does not have valid registration with the State, as required by Section 42-3-103,
42-3-138 or 42-12-102, C.R.S., and/or the number plate assigned to it is not permanently
attached to the vehicle, as required by Section 42-3-123, C.R.S.; or is lacking proper
equipment to the extent that it would be unsafe or illegal to USE on public road
rights-of-way or otherwise not equipped with lamps and other equipment, as required in
Sections 42-4-202 to 42-2-227, C.R.S. This definition shall not include implements of
husbandry, farm tractors or vehicles customarily operated in a FARMING operation.
COMMERCIAL VEHICLE: Any vehicle, other than an automobile, used or previously used
to facilitate an activity where goods, products or services are bought, sold or transferred in
ownership on a fee, contract or barter basis, excluding those uses listed by right and
accessory uses in the A(Agricultural) Zone District. A COMMERCIAL VEHICLE shall
include, but is not limited to, semi-trailers, dump trucks, construction equipment, railroad
cars and cargo containers. A COMMERCIAL VEHICLE shall not be allowed to deteriorate
to the condition of a DERELICT VEHICLE.
NONCOMMERCIAL JUNKYARD: An area where any waste, junk or used or secondhand
materials are stored or handled, including but not limited to scrap iron and other metals,
paper, rags, rubber tires, building materials and bottles. A NONCOMMERCIAL JUNKYARD
may also include the storage or keeping of DERELICT VEHICLES registered last or
currently registered under the property owner and/or tenant's name.
This definition does not include COMMERCIAL VEHICLES. If the Zone district allows, the

NONCOMMERCIAL JUNKYARD shall be totally ENCLOSED within a BUILDING or
STRUCTURE or visually SCREENED from all ADJACENT properties and public
• rights-of-way.
SCREENED: Construction and maintenance of fences, earth berms or the USE of
LANDSCAPING materials or other materials USED with the approval of the Department of
Planning Services to lessen the noise, light, heat or visual impacts of a USE on surrounding
uses. A SCREENING PLAN shall be submitted and approved by the Department of
Planning Services.
