HomeMy WebLinkAbout20081424.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST DOUGLAS AND MANDIE GILDOW FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Douglas and Mandie Gildow, ZCV#0701148, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 13th day of May, 2008, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Douglas Gildow, property owner, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until August 13, 2008, to allow adequate time for the property owners to sell the semi-truck and trailer, and to finalize the building permit for the cargo container to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. It does appear that this permit has been finaled yet. During my last inspection, I also noted that your fenced area has been installed around the Noncommercial Junkyard; therefore, this aspect has been closed. During my inspection I did note that a semi truck (cab)was again present on this property without a permit. As I have previously indicated in order to park(even if temporary) a COMMERCIAL VEHICLE within the boundaries of a subdivision, such as Bil-Lar Acres a Zoning Permit for a Commercial Vehicle (ZPCV) application is required. Lastly, I noted the presence of a semi trailer. If the trailer is utilized with the Commercial Vehicle than the 1 (one) permit mentioned above (ZPCV) is necessary; however, if it does not leave the property or is used as a Storage Unit, than a Zoning Permit for an Accessory Structure (ZPAS) is necessary. My records indicate that a ZPCV application has already been sent to you, but I do not show that a ZPAS application has been sent to you yet, so I have enclosed one with this letter. RECOMMENDATION The Department of Planning Services recommends this case be referred to the County Attorney's Office for immediate legal action. No pictures were taken during this inspection. 11/01/2007 Phone Call Doug Gildow called. He said he received my letter. We discussed the cargo container. He asked me to send him a permit. We discussed the semi. He drives it. He asked me to send him an application. We discussed the NCJY. He said he only has like 1 derelict vehicle. He indicated that he would use the cargo container as 1 side of the fence, the shop as another and add 2 end pieces. I told him that I would send him a 60 day letter to allow him enough time to complete everything. He said thanks. 11/07/2007 Phone Call Doug Gildow called back. He had questions about installing a fence. He was asking about using the landscaping fabric. I explained that we have historically denied such requests, but he could propose it. I just could not give him permission to install it. He said that he was going to need to install more fencing than he thought. He had more derelict vehicles than he thought he had. He also said he had not received my letter yet. I explained that I hadn"t had a chance to send it yet. He asked if that would reflect negatively on him. A cargo container used for storage shall require the issuance of building permits. The following conditions shall apply:23-3-30.K.1 Electricity is the only utility which will be connected to the cargo container used for storage. 23-3-30.K.2 The cargo container used for storage will not be used on any basis as a DWELLING or as overnight or temporary housing for any person. 23-3-30.K.3 The property upon which the cargo container is to be located must be a LEGAL LOT. 23-3-30.K.4 The applicant shall not remove any structural component of the cargo container used for storage making it unmovable. 23-3-30.K.5 A cargo container used for storage shall not be allowed to fall into a state of disrepair. Such disrepair may include a cargo container that is partially or totally damaged by fire, earthquake, wind or other natural causes, or is in a state of general dilapidation, deterioration or decay resulting from a lack of maintenance, vandalism or infestation with vermin or rodents. When the pi rty is located within an approved or recorc subdivision, or part of a LOT which is part of a map or plan filed prior to adoption of any regulations controlling subdivisions, such USE may be permitted through Section 23-4-950 of this Code. • DERELICT VEHICLE: A vehicle that is inoperable (unable to move under its own power); is partially or totally dismantled; has all or portions of its body work missing or is substantially damaged; does not have valid registration with the State, as required by Section 42-3-103, 42-3-138 or 42-12-102, C.R.S., and/or the number plate assigned to it is not permanently attached to the vehicle, as required by Section 42-3-123, C.R.S.; or is lacking proper equipment to the extent that it would be unsafe or illegal to USE on public road rights-of-way or otherwise not equipped with lamps and other equipment, as required in Sections 42-4-202 to 42-2-227, C.R.S. This definition shall not include implements of husbandry, farm tractors or vehicles customarily operated in a FARMING operation. NONCOMMERCIAL JUNKYARD: An area where any waste, junk or used or secondhand materials are stored or handled, including but not limited to scrap iron and other metals, paper, rags, rubber tires, building materials and bottles. A NONCOMMERCIAL JUNKYARD may also include the storage or keeping of DERELICT VEHICLES registered last or currently registered under the property owner and/or tenant's name. This definition does not include COMMERCIAL VEHICLES. If the Zone district allows, the NONCOMMERCIAL JUNKYARD shall be totally ENCLOSED within a BUILDING or STRUCTURE To bring your property into compliance with the Weld County Code: as we previously discussed, the following items need to be addressed accordingly. A building permit (see enclosed) shall be completed and submitted. A Zoning Permit for a Commercial Vehicle application (see enclosed) shall be completed and submitted. The NONCOMMERCIAL JUNKYARD consisting of DERELICT VEHICLES and miscellaneous debris shall be removed, restored or completely SCREENED from all adjacent properties and public rights-of-ways. It is the intention of this office to assist and cooperate with you without Imposing undue hardships; however, we have no discretion in this matter if you fail to correct this violation. You have until 01/14/2008, to correct this zoning violation. Failure to do so will result in this office scheduling the violation before the Board of County Commissioners to consider whether to refer the violation to the County Attorney's Office for legal action.
