Department of Public COLORADO Health and Environment U CASE NO.: AmPZ-1035 NAME: Red Baron Development The Weld County Health Department has reviewed this proposal. This application is to change the zone of Lot 7 from Estate to C-2 for an aviation museum. This development is adjacent to the Platte Valley Airport, and is surrounded by six residential lots. CRS 25-12-103 (4), (noise standards) specifically exempts aircraft operations (governed by federal law with respect to noise control). The application states that there will be one special event per year where the attendance will be 600 people. A future paper service-only restaurant is proposed for the museum site. Water • Water for the lot will be from the existing well. The well has been re-permitted for commercial use. A Water Demand Study dated July 5, 2006 by Forrest Leaf, Leaf Engineering, appears to indicate there is enough water for the estimated demand. Due to the number of people that are projected to patronize the museum, this well is expected to be deemed a public water system (serving a 25 people or more)as defined in the Colorado Primary Drinking Water Regulations (5 CCR 1003-1). Therefore, the applicant should submit a plan review to the Drinking Water Section of the Water Quality Control Division of the Colorado Department of Public Health and Environment for the proposed water distribution system. The applicant should submit any response to any review with the Final Plan application. Sewage A septic permit application (SP-0700020) has been submitted to this office for review. Currently, the design supports the installation of a septic system at the County level. A full review is pending the approval of this request; however, the geological report from Terra Logics Consulting, dated September 30, 2006 has sized the system for the projected flow listed in the application and a future paper service-only restaurant. The system appears to meet all criteria for placement on the lot, including setbacks to the well, property lines and buildings. A secondary absorption field envelope should be placed on the lot; recommended placement could be directly east and parallel to the proposed location. • EXHIBIT 1 2008-0107 Other Comments • The development covenants should be updated to reflect that this lot is now commercial in nature. The Department recommends approval with the following conditions: 1. Water service shall be obtained from the existing individual well. 2. This well is expected to be deemed a Public Water System (serving a 25 people or more)as defined in the Colorado Primary Drinking Water Regulations(5 CCR 1003- 1). The applicant shall submit a plan review to the Drinking Water Section of the Water Quality Control Division of the Colorado Department of Public Health and Environment for the proposed water distribution system. The applicant should submit any response to any review with the Final Plan application. 3. Sewage disposal shall be by septic systems designed in accordance with the regulations of the Colorado Department of Public Health and Environment, Water Quality Control Division and the Weld County Code in effect at the time of construction, repair, replacement, or modification of the system. 4. Primary and secondary septic envelopes shall be relocated on the lot to reflect the commercial size of the septic system(prior septic envelopes were sized and placed on the lot as part of the residential PUD review). All septic system envelopes must meet all setbacks. 5. Language for the preservation and/or protection of the absorption field envelopes shall be placed in the development covenants. The covenants shall state that activities • such as permanent landscaping, structures, dirt mounds or other items are expressly prohibited in the absorption field site. 6. Adequate portable toilet facilities shall be provided during the annual special event. 7. The development covenants should be updated to reflect that this lot is now commercial in nature. 8. A stormwater discharge permit may be required for a development/redevelopment /construction site where a contiguous or non-contiguous land disturbance is greater than or equal to one acre in area. Contact the Water Quality Control Division of the Colorado Department of Public Health and the Environment at www.cdphe.state.co.us/wq/PermitsUnit for more information. 9. During development of the site, all land disturbances shall be conducted so that nuisance conditions are not created. If dust emissions create nuisance conditions, at the request of the Weld County Health Department, a fugitive dust control plan must be submitted. 10. In accordance with the Regulations of the Colorado Air Quality Control Commission any development that disturbs more than 5 acres of land must incorporate all available and practical methods that are technologically feasible and economically reasonable in order to minimize dust emissions. 11. If land development creates more than a 25-acre contiguous disturbance,or exceeds 6 months in duration, the responsible party shall prepare a fugitive dust control plan, submit an air pollution emissions notice, and apply for a permit from the Colorado • 2 Department of Public Health and Environment. • 12. "Weld County's Right to Farm"as provided in Appendix 22-E of the Weld County Code shall be placed on any recorded plat. Prior to recording the Change of Zone plat: 1. The PUD must show evidence that the plan review process has be initiated with the Drinking Water section of the Water Quality Control Division of the Colorado Department of Public Health and Environment. At the time of Final Plan submission: 1. The applicant shall submit documentation of approval from the Colorado Department of Public Health and Environment,Water Quality Control Division of the plans submitted for the public drinking water system. If conditions for approval are stipulated by the Water Quality Control Division, the applicant shall also include how each condition will be addressed. The Department recommends that these be part of any development standards: 1. The PUD must be in compliance at all times with the requirements of the Colorado Primary Drinking Water Regulations (5 CCR 1003-1). 2. The Red Baron Development/Aviation Museum is regulated by the Colorado Primary Drinking Water Regulations (5 CCR 1003-1). As such, once Red Baron Development/ Aviation Museum regularly serves a population of at least 25 people over 6 months of • the year it is required to contact the Colorado Department of Public Health and Environment, Water Quality Control Division to activate the Red Baron Development/ Aviation Museum Public Water System. 3. The applicant shall comply with Colorado Retail Food Establishment Rules and Regulations governing the regulation of food service establishments. AMPZ-1035 1. A separate building permit shall be obtained prior to the construction of any structure. 2.A plan review is required for each building for which a building permit is required.Two complete sets of plans are required when applying for each permit.All buildings will be required to be accessible to persons with disabilities. Building plans may are required to bear the wet stamp of a Colorado registered architect or engineer. • 3. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of permit application. Current adopted codes include the 2006 International Building Code; 2006 International Mechanical Code; 200 International Plumbing Code; 2006 International Fuel Gas Code; 2005 National Electrical Code and Chapter 29 of the Weld County Code. 4. Each building will require an engineered foundation based on a site-specific geotechnical report or an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a Colorado registered engineer. 5. Fire resistance of walls and openings,construction requirements, maximum building height and allowable areas will be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning Ordinance. 6. Building height shall be measured in accordance with the 2006 International Building Code for the purpose of determining the maximum building size and height for various uses and types of construction and to determine compliance with the Bulk Requirements from Chapter 23 of the Weld County Code. Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset and setback requirements. When measuring buildings to determine offset and setback requirements,buildings are measured to the farthest projection from the building. Property lines shall be clearly identified and all property pins shall be staked prior to the first site inspection. 7. A letter of approval from Hudson Fire Protection District is required prior to issuance of any building permit. 8. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to county planning directors, this office will only perform a cursory review of the referral information and provide comments. The comments do not address the adequacy of the water supply plan for this project or the ability of the water supply plan to satisfy any County regulations or requirements. In addition,the comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the issuance of a well permit, or the physical availability of water. • According to the referral information the applicant is seeking to change the zoning of lot 7 to general commercial so that a museum facility can be constructed on the lot. The proposed water source is an individual on lot well. According to the records available in the State Engineer's Office the Lafayette Foundation was issued permit no. 65391-F and has constructed a well on the subject lot, into the nontributary Laramie-Fox Hills aquifer. Well permit no. 65391-F is currently permitted for commercial use with a maximum pumping rate of 15 gallons per minute and an annual withdrawal of 0.57 acre-feet. The existing well can legally be used to serve the lot as long as the well is operated in accordance with the terms and conditions of the well permit. The site is located at the corner of WCR 16 and WCR 39; Public Works received the submittal August 29, 2007. Comments ❑ Please provide an updated Drainage Report and drawings that will provide retention and water quality for this lot. This area can also be used for snow removal from the parking lot. Weld County has adopted the Urban Storm Drainage Criteria Manual with an Addendum written to address specific Weld County conditions and exceptions to the Urban Drainage Criteria. ❑ Please provide a Grading and Erosion Control plan for this lot. ❑ Please provide more information concerning the amount of traffic expected to occur due to the new zoning at this site. The water use report indicates that weekly events of 60-patrons are expected and once a year a 600-patron event is scheduled. Provide a signage, striping and parking lot plan with hard surface ADA spaces complying with all standards of the Americans with Disability Act. The off-street parking spaces including access drive shall be surfaced with gravel,recycled asphalt, asphalt, concrete or equivalent. It shall be graded to prevent drainage problems. Clearly identify the location, length and width of access to this lot off Parks Lane. The Weld County Public Works Department is recommending that Lot 7 of the Red Baron Estates PUD escrow $3,600, the same amount as being escrowed by the Red Baron Estates PUD lot holders for stabilization of WCR 39. This escrow shall be required as part of this application. The original resolution associated with Red Baron recording number 3192870,recorded 06/25/2004. ❑ Easements shall be shown in accordance with County standards (Sec. 24-7-60) and/or Utility Board recommendations. Intersection sight distance triangles at accesses/entrances will be required. All landscaping within the triangles must be less than 31/2 feet in height at maturity, and noted.
