HomeMy WebLinkAbout840872.tiff MINUTES HOME RULE CHARTER STUDY COMMITTEE June 12, 1984 Present: June Steinmark, Chairperson Dwight Holter Jack Holman Cynthia Hayes Paul Neubauer Dick Boettcher Don Warden Lee Morrison The committee voted unanimously that there be no change in the County Council's role in suspending an elected official for a crime. However, they did unanimously recommend that the Council develop and adopt a written procedure dealing with the due process of the individual prior to any incident. No change was recommended for the Council's role in conflict of interest matters, but the committee voted that the Council should clarify the standards. No change was recommended concerning an employee running for county office. No change was recommended concerning the annual rotation of Commissioner Coordinators. The issue will again be discussed under structure of county government. The committee voted to amend Section 14-7 concerning the 5% limit as indicated on the attached Exhibit A. The committee, after discussing the sales tax issue being part of the Charter in relationship to Lee Morrison's opinion dated May 22, 1984, decided to take the following action: Recommend that the Board of County Commissioners place on the next general election ballot the issue of one-half percent sales tax for road and bridge purposes. Meeting was adjourned at 9:00 p.m. Next meeting is scheduled for Tuesday, June 26, 1984. 840872 Exhibit A Section 14-7 -- Limitation on Annual Tax Levy (1) Limitation. Except as otherwise provided herein, all ad valorum tax levies for county purposes, when applied to the total valuation for assessment of the County, shall be reduced so as to prohibit the levying of a greater amount of tax revenue than was levied from ad valorum taxation in the preceding year plus five percent (5%) except to provide for the payment of bonds and interest thereon. In computing the five percent limit the increased valuation for assessment attributable to growth shall be excluded. Growth shall be defined as all increased assessed value except increased values attributable to reappraisals. (2) (a) In the • event an increase beyond that which the Board is authorized to levy is sought, the question may be submitted to the qualified electors of the county at a general or special election called for that purpose. (b) Due notice of submission of the question of whether to grant the increase levy shall be given by the County Clerk at least thirty (30) days in advance of the date set for the general or special election by giving a public notice as provided herein. If a majority of the votes cast at any such election is in favor of the increased levy as named in said election notice, then the county may make such increased levy. (c) In the event such increase shall be voted by the electors under the preceding subsections, the increased revenue resulting therefrom shall be included in determining the five percent (5%) limitation in the following year. PRESS RELEASE as The Home Rule Charter Amendment Study Committee, appointed by the Board of County Commissioners to review the Weld County Home Rule Charter, has met and established its study agenda. The purpose of the Committee is to determine whether or not any amendments would be appropriate in order to provide better government by the citizens of Weld County. The Committee has established a series of meetings over the nextthreemonths to study the Charter so that appropriate action may be taken prior to the general election to be held in November of 1984. The Committee is comprised of nine members appointed from the six geographical districts of Weld County and three at-large members. Former County Commissioners, June Steinmark, has been elected Chairperson by the committee members. The Committee, at their March 27, 1984 meeting, established the following study agenda. On Tuesdays, April 10 and April 24, 1984, the Committee will explore taxation and the 5% limitation contained in the Charter. On May 8, 1984, the role of the County Council in Weld County government will be discussed. On Tuesday, May 22, 1984, items of technical concerns such as ordinance provisions, County Attorney opinions, and bid procedures will be discussed. On Tuesday, June 12, 1984, issues associated with County employees, such as conflict of interests and employees seeking election to a public office will be studied. Tuesday, June 26, 1984 the Committee will examine the overall structure of Weld County government. Citizens wishing to provide input on the above topics may attend the Committee meetings at 7:00 p.m. on the above dates at the Centennial Complex located at 915 10th Street, Room 316, in Greeley, or send written comments to the Weld County Home Rule Charter Amendment Study Committee's attention at P.O.
