A regular meeting of the Weld County Utilities Coordinating Advisory Committee was held on Thursday,
May 8, 2008 at 10:00 a.m., in the Conference Room of the Weld County Planning Department at 918 10"
Street, Greeley, Colorado.
Members Present: Don Posselt, Doug Melby, Don Somer, Robert Fleck, Jerry Adams, and Dave Snyder.
Members Absent: Chris Gathman, Department of Planning Services and Kris Ranslem, Secretary.
Also Present: Don Magnuson, Lyle Sheeder, and Al Trujillo.

LEGAL DESCRIPTION: Lot A of Avery Acres PUD; located in W2 of Section 10,T6N, R65W of the 6th
P.M.,Weld County, Colorado.
REQUEST: An Amendment to the PUD final plan(adjust the outer boundaries of Outlot A
and create an additional single-family residential lot)for Outlot A of Avery Acres
PUD.
LOCATION: East of and adjacent to CR 43 and north of and adjacent to CR 70.
Chris Gathman, Department of Planning Services, stated that this case was continued from the April 10,
2008 Utility Board meeting. The applicant is proposing to add two additional lots (Lots 6 and 7). They are
also proposing to install a 30 foot emergency access connecting Avery Drive to the cull de sac which
would serve Lots 6 and 7. Planning Staff is recommending that they show the appropriate easements for
Lots 6 and 7 which would be a 15 foot utility easement along the cull de sac, 10 foot on either side of the
common property line between Lots 6 and 7, and also along the southern boundary of Lot 6 (between Lot
6 and Lot 1). Chris stated that they already have an existing easement along the east side of Lot 6 and 7
established through the original Avery Acres PUD. The Outlot, which is to the west, currently has a
utility/irrigation easement shown along the northern boundary. He added that there is a 30 foot waterline
easement that runs all the way down from County Road 72 along Avery Drive and then it crosses over at
the south end of Avery Drive. Chris commented that the majority of the Outlot is in the floodplain so right
now it would be designated as nonbuildable with the exception of Ag exempt structures.
Pat McNear, Scott Reality, 1212 8'"Ave, Greeley CO. Mr. McNear commented that he is representing the
applicant, Mr. Bollinger. He stated that the only change that they have made that is not shown on this map
is a restrictive gate that restricts traffic flow, but would be accessible to emergency vehicles. It would be
placed at the very northwest corner of Lot 1. It would allow access to the wellhead for oilfield maintenance
and production.
Jerry referred to the 15 foot easement that Chris is proposing to run along the cull de sac and commented
that he is not sure where it would go. He added that we could use the emergency access if it was also
called out as a utility easement. Mr. McNear indicated that wouldn't be a problem because it will not serve
much purpose there other than for emergency.
Mr. McNear asked what utilities would be located there and where they would be located. Jerry said that
potentially all the utilities could locate in there and it would be on one side of the easement or the other.
Chris brought up a possible issue of where a portion of that 30 foot access will be crossing the 30 foot
waterline easement that is already there. Jerry recommended placing the 15 foot easement outside of the
existing 30 foot waterline easement to the west. Chris stated that we could run the easement all the way
down from County Road 72 outside of the waterline and then swing it down to Avery Drive. Jerry
commented that in addition to that we would bring Lots 6 and 7 up to County Standard with easement
designations.
Jerry asked the members of the Utility Board if they all agreed with those comments. The Board
concurred.
Jerry summarized the changes to be made: 1) bring Lots 6 and 7 up to County Code according to Section
24-7-60 and Section 27-9-40 (10 foot side lot easements), 2) 20 foot perimeter easement, 3) adding the

15 foot front lot easement adjacent to Avery Drive and outside the existing 30 foot waterline easement as
necessary, 4) 15 foot frontage easement along County Road 72 and County Road 43.
Robert Fleck moved to approve Case 2nd AmPF-496 with the suggested changes, seconded by Don
Somer. Motion carried.
