SUBJECT: USR-1633, Spicer Ranches
The Weld County Public Works Department has reviewed this proposal. This project
falls primarily under the purview of the Use by Special Review Standards, Weld County
Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements
are as follows:
REQUIREMENTS:
1 . Please address and resolve all redlines on the drainage report and the
accompanying maps prior to resubmitting for review.
2. All channels shall have side slopes no steeper than 3:1 H:V.
• 3. The flow lengths used in the peak flow spreadsheets appear to be from the
wrong basin on the drainage plan map. Please revise peak flow calculations and

all subsequent calculations which relate to this requirement accordingly.
4. The applicant shall riprap downstream of the 24" diameter culvert under the west
ditch crossing.
The applicant shall address the comments listed above for this review process. Comments made during
the USR stage of the review process may not be all-inclusive,as revised materials must be submitted and
other concerns or issues will arise during further review. Issues of concern must be resolved with the
Public Works Department prior to recording.

Kim,
I would like to request a continuance for Spicer Ranches, USR Permit #1633.
They have had family issues that will prevent them from attending the hearing
scheduled for July 23, 2008. Due to these family issues, Fred Kayser will no
longer be able to represent the family in the USR application process. Dave
• Meyring will be taking over representing the family. Dave is not familiar with the
conditions of approval and will need time to be brought up to speed. He is also in
the middle of his hay harvest which makes it hard for him to get away. We would
request a new hearing date of September 3, 2008. Please let me know if this will
be acceptable.

• Thank you for submitting the Underground Injection Control (U1Cl Class V Shallow
Waste Disposal System%Well Request Form that we received on August 14, 2008.
Alicr reviewing your inventory data, the UIC staff has determined that you operate at
least one Class V disposal system. Therefore. you are regulated under the Environmental
Protection Agency's (EPA's) UIC Program in accordance with Title 40 Code of Federal
Regulations (40 CFR) Parts 144 and 146, which have been promulgated under Part C of the
Safe Drinking Water Act, 42 United States Code Sections 1421 through 1428. A copy of 40
CFR Section 144.12. which applies to Class V injection wells. is enclosed.
Your Class V disposal system(s) is currently authorized by rule under 40 CFR Sections
144.24 and i44.84(a). Authorization by rule allows you to operate your Class V disposal
systemis) without a full permit. Your Class V disposal system(s) must comply with. among
other requirements. 40 CPR Section I44.I2(a) which prohibits any underground injection that
may endanger an underground source of drinking water (see enclosure). Your Class V
disposal system(s) is also subject to periodic compliance inspections. which may include
sampling and analysis of your fluids. Finally, be aware that under 40 CFR Sections
144.12(c). (di. and (c). the EPA can require you apply for a permit or close your disposal
system under certain circumstances (e.g.. if all or part of the fluids you discharge changes
from solely sanitary-domestic wastes to industrial wastes).
