WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on February 14, 2007, the Weld County Board of Commissioners approved Use by Special Review Permit#1584, for Gerrard Family Limited Partnership, LLLP, 1739 South County Road 13C, Loveland, Colorado 80537, for a Use Permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial and Industrial Zone Districts (construction business with two shop buildings, an office, and outdoor storage) in the A (Agricultural) Zone District on the following described real estate, to-wit: Part of the SW1/4 of Section 18, Township 5 North, Range 67 West of 6th P.M., Weld County, Colorado WHEREAS,on September 17, 2007,the Board of County Commissioners of Weld County, Colorado, approved an Improvements Agreement According to Policy Regarding Collateral for Improvements(Public Road Maintenance)between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and Gerrard Excavating, Inc., with terms and conditions being as stated in said agreement, and accepted Subdivision Performance Bond#104773586 from Travelers Casualty and Surety Company of America, One Tower Square, Hartford, Connecticut 06183, in the amount of $197,798.33, and WHEREAS, on March 26, 2008, the Board approved replacement collateral in the form of Subdivision Performance Bond Rider#104773586 from Travelers Casualty and Surety Company of America, One Tower Square, Hartford, Connecticut 06183, reducing the amount of credit available for draw by Weld County to $29,669.75, and has now received a request for full cancellation and release of said collateral, and WHEREAS, staff from the Weld County Departments of Public Works and Planning Services have conducted a visual inspection and recommend release of said collateral. COLORADO The Public Works Department has received a request from Nathan Gerrard, Vice President of Gerrard Excavating, for the final release of collateral for off-site road improvements. All items from the punch list dated 11-28-2007 have been completed/submitted. The as-builts have been reviewed and is in line with the work completed. Since the partial release of the collateral earlier this year the site has been periodically inspected and appears to be functioning as designed.
