RE: APPROVAL OF USE BY SPECIAL REVIEW FOR AN ACCESSORY STRUCTURE
GREATER THAN 1 , 500 SQUARE FEET IN A RESIDENTIAL-ONE (R-1 )
ZONED SUBDIVISION - SEYMOUR (BRAD) AND JOAN A. PETERSON
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners held a public
hearing on the 28th day of November, 1984 , at the hour of 2 : 00
o' clock p.m. in the Chambers of the Board for the purpose of
hearing the application of Seymour (Brad) and Joan A. Peterson ,
7307 11th Street , Greeley, Colorado 80634 , for a Use by Special.
Review for an accessory structure greater than 1 ,500 square feet
in a Residential-One (R-1) Zoned Subdivision on the following
described real estate , to-wit
Lot 3 , Block 1 , Knaus Subdivision, located in
Part of the Nz NE;, Section 8 , Township 5
North, Range 66 West of the 6th P.M. , Weld
County, Colorado
WHEREAS , Section 24 . 4 . 2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS , the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter, and having been fully informed, finds that this
request shall be approved for the following reasons :
1 . The submitted materials are in compliance with the
application requirements of Section 24 . 7 of the Weld
County Zoning Ordinance.
2 . It is the opinion of the Board of County Commissioners
that the applicant has shown compliance with Section
24 . 4 . 2 of the Weld County Zoning Ordinance as follows :

a. The accessory building in the R-1 District is
consistent with the Weld County Comprehensive Plan .
The structure will be constructed, operated and
maintained in accordance with the requirements and
procedures as set forth in Section 24 , Use by
Special Review, listed in the Weld County Zoning
Ordinance.
b. The accessory structure will be compatible with
existing and future residential uses in the
neighborhood. The size of the structure and its
distance from surrounding property lines minimizes
visual impacts to the surrounding neighborhood.
c. The City of Greeley reommended no objections to the
request in a meeting dated September 11 , 1984 .
d. No overlay district affect the site.
e. Use by Special Review Operation and Design
Standards provide adequate protection of the
health, safety and welfare of the neighborhood and
County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application for a
Use by Special Review for an accessory structure greater than
1 , 500 square feet in a Residential One (R-1) Zoned Subdivision on
the hereinabove described parcel of land be , and hereby is ,
granted subject to the following conditions :
1 . The attached Standards for Use by Special Review be
adopted and placed on the Use by Special Review plat
prior to recording.
2 . The prescribed Use by Special Review activity shall not
occur nor shall any building or electrical permits he
issued on the subject property until the Use by Special
Review plat has been delivered to the Department of
Planning Services Office and the plat has been recorded
in the office of the Weld County Clerk and Recorder.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 28th day of
November, A.D. , 1984 .

OPERATION STANDARDS
Seymour (Brad) and Joan A. Peterson

1. The permitted use shall be a two thousand forty (2,040) square foot
accessory structure as described in the submitted application materials
on file with the Department of Planning Services.
2. The applicant shall comply with the design standards for the Use by
Special Review, Section 24.5 et seq. , of the Weld County Zoning
Ordinance.
3. The applicant shall comply with the Operation Standards fur Uses by
Special Review, Section 24.6 et seq. , of the Weld County Zoning
Ordinance.
4. Representatives or members of the Weld County Health Department and
Weld County Department of Planning Services shall be granted access
onto the site at any reasonable time in order to insure the operations
carried out on the site comply with the Development Standards stated
hereon and all applicable Weld County Regulations.
5. The Use by Special Review shall be limited to the plans shown hereon
and governed by the Standards as stated above and all applicable Weld
County Regulations. Any material deviations from the plans and/or
Standards as shown or stated above shall require the approval of an
amendment of the Permit by the Weld County Planning Commission and the
Board of County Commissioners before such changes from the plans and/or
Standards are permitted. Any other changes shall be filed in the
office of the Department of Planning Services.
6. The property owner and/or operator of this operation shall be
responsible for complying with all of the above stated Standards.
Noncompliance with any of the above stated Standards may be reason for
revocation of the Permit by the Board of County Commissioners.

The following business was transacted:
I hereby certify that pursuant to a notice dated November 13, 1984, and duly pub-
lished November 15, 1984, in the La Salle Leader, a public hearing was conducted
to consider the application of Seymour (Brad) and Joan A. Peterson for a Use by
Special Review for an accessory structure greater than 1,500 square feet in a
Residential-One (R-1) zoned subdivision. Assistant County Attorney Lee D. Morrison
read this application into the record. Rod Allison, Planning Department represen-
tative, read the favorable recommendation of the Planning Commission into the
record and noted that six Operation Standards have been proposed for this appli-
cation. Brad Peterson came forward to answer questions of the Board. After
discussion, Commissioner Martin moved to approve the Use by Special Review appli-
cation of Seymour (Brad) and Joan A. Peterson. The motion was seconded by Com-
missioner Brantner and carried unanimously.

APPEARANCE:
Brad Peterson, property owner and applicant, explained his reasons for this
request is for a building larger than 1 ,500 square feet in a subdivision.
When they bought the property there was an existing garage. He has two
horses and wants to be able to have them on his property. The logical thing
to do was to add the horse barn onto the garage. This is considered an
addition to an existing building and it made the building larger than the
County allows in a subdivision without a Use by Special Review Permit.

MOTION:
Lydia Dunbar moved case number USR-651 :84:47 for Brad and Joan Peterson for
a Use by Special Review Permit for an Accessory Structure greater than 1 ,500
square feet in a Residential-One Zone Subdivision be forwarded to the Board
of County Commissioners with the Planning Commissions recommendation for
approval based upon the recommendations, conditions, and operation standards
as outlined by the Department of Planning Services staff sand the testimony
of the applicant. Motion seconded by Doug Graff.
The Chairman called for discussion from the members of the Planning
Commission. Discussion followed.
The Chairman asked the secretary to poll the members of the Planning
Commission for their decision. Sharon Linhart — yes; Jack Holman — yes;

REQUEST: An amendment to a Use by Special Review Mining Permit for an
open-cut wet gravel pit
LEGAL DESCRIPTION: Part of the W%, Section 31, T2N, R68W of the 6th P.M.
Weld County, Colorado
LOCATION: Approximately 2.5 miles north of Erie; east of County Line
Road and north of State Highway 52
Stephen Hamilton asked the Chairman to be excused for this case due to a
possible conflict of interest.
APPEARANCE:
Gilbert Rindahl, P.E. , Rindahl and Associates, represented the applicants.
He explained why this request was not filed with the original application.
He also reviewed the reclamation plans for the area.
The Chairman asked Mr. Rindahl if he had reviewed the recommendations,
conditions, and Operation Standards, as outlined by the Department of
Planning Services staff. He stated he had and takes exception to 8.B,
stating that no right turns will be made and that a no right turn sign

shall be posed at the point of egress. He stated he would like the Planning
Commission to amend this requirement. He had stated in the application
materials that the normal haul route would turn left, but on occasion farms
and other businesses in the area, will buy a load of gravel and it would be
more convenient for them to turn right, which is with the flow of traffic
and not against it.
Rod Allison felt the better way to handle this would be for the Planning
Commission to approve the standard as written, and then the staff would send
a recommendation to the Engineering Department asking that the requirement
for right turns be waived before the Board of County Commissioners is
scheduled to act on this request.

Corporation, the Smith Amendment to the Armstead Gravel Pit, be forwarded to
the Board of County Commissioners with the Planning Commission's
recommendation for approval based upon the recommendations, conditions, and
operation standards, as outlined by the department of Planning Services
staff and the testimony of the applicant. Motion seconded by Paulette
Weaver.
The Chairman called for discussion from the members of the Planning
Commission. Discussion followed.
The Chairman asked the secretary to poll the members of the Planning

COMMENTS:
Access to the subject site is from 11th Street, a paved road. Improvements
consist of one brick/wood framed house and one large garage. On the east side of
the garage the applicant has a partly constructed 3 sided wood structure to be
used as a horse barn. Because the applicant has added this 3 sided structure
(approximately 760 square feet in size) to the garage, it has placed the total
square footage of the garage/barn structure over the maximum allowed 1500 square
