HomeMy WebLinkAbout800687.tiff RESOLUTION RE: MAINTENANCE OF BORROW PITS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority to control the use and maintenance of Weld County roads and right-of-ways, and WHEREAS, land owners adjacent to Weld County roads use bor- row pits for irrigation run-off and other uses , said uses being of benefit to adjacent land owners, and WHEREAS , in so doing, silt and other matter from adjacent lands accumulate in said borrow pits causing drainage problems on the Weld County roads, and WHEREAS, the Board of County Commissioners of Weld County, Colorado is vested with the authority to cause adjacent land owners, as a condition to the continued use of said borrow pits in such manner, to clean silt and other sediment from borrow pits for the purpose of facilitating proper drainage, and WHEREAS , borrow pits overgrown with weeds cause numerous problems including the drifting of snow, unsightliness and seeding of adjacent crops , and WHEREAS, the Board of County Commissioners of Weld County, Colorado has no duty to control said weeds in the borrow pits adjacent to county roads. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the removal of silt and other sediment from said borrow pits to facilitate proper drainage is the duty of the land owners adjacent to Weld County roads when the use of the borrow pit by the land owner results in said accumulation of silt and sediment. BE IT FURTHER RESOLVED that any landowner adjacent to a Weld County road may take measures to control weeds growing in borrow pits adjacent to his land if said land owner exercises proper care in so doing and does not interfere with the normal and safe flow of traffic on said county roads.
