Schrage in his capacity as Trustee of the Schrage Living Trust ("Schrage") for good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, confirms the existence of these Grantees' Easement and to the extent necessary and appropriate grants and conveys unto Gary R. The failure to enforce all or any portion of this Easement by the Elmquists shalt not be deemed as an acquiescence or waiver by the Elmquists of any of their rights.
