Environmental Health Services has reviewed this proposal for junkyard and salvage
yard. We have no objections to the proposal, however, we do recommend that the
following conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall provide evidence to the Weld County Department of Public
Health and Environment that the applicant has submitted a registration form to
• the Colorado Department of Health and Environment, Air Pollution Control
Division (APCD), Chlorofluorocarbon (CFC) program, for air cooler, chillers or
food storage refrigerators and freezer containing ozone-depleting refrigerants.
Alternately, the applicant can provide evidence from the APCD that they are not
subject to these requirements.
2. The applicant shall submit a dust abatement plan for parking and driving areas
for review and approval, to the Environmental Health Services, Weld County
Department of Public Health & Environment.
3. The Environmental Health Services Division was unable to locate a septic permit
for the septic system serving the office/garage structure. The septic system shall
be reviewed by a Colorado Registered Professional Engineer. The review shall
consist of observation of the system and a technical review describing the
systems ability to handle the proposed hydraulic load. (6 employees & patrons to
the site) The review shall be submitted to the Environmental Health Services
Division of the Weld County Department of Public Health and Environment. In
the event the system is found to be inadequately sized or constructed the system
shall be brought into compliance with current Regulations.

4. The applicant shall submit evidence to the Department of Planning Services,
• from the Colorado Division of Water Resources, demonstrating that the well is
appropriately permitted for the commercial use.
5. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
• -' final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan".
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved dust abatement
plan at all times.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in 25-12-103 C.R.S., as amended.

• 7. Adequate toilet and handwashing facilities shall be provided for employees. The
employees shall be allowed to use the toilet facilities located in the office/garage.
8. Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.
9. A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
10.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section
23. Our comments and requirements are as follows:
COMMENTS AND REQUIREMENTS:
Weld County Road Classification Plan (FHU): (June 2003)
WCR's 18 and 81 are local gravel roads and require a 60-foot right-of-way at full build out. There is presently
a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of setback in the
Weld County Zoning (23-1-90), the required setback is from the future right-of-way.
Access: Existing access will be utilized. No new access points are proposed.
A 40' radius is required on all accesses to public roads for accesses designed to accommodate truck traffic. {A
\Winimum effective turning radius of forty (40) feet shall be used for accesses intended to accommodate truck
affic. (Weld County Codification Ordinance 2000-1)} Sec. 8-2-40 B. Road access design standards.
The applicant shall indicate specifically on the plat the type of right-of-way/easement that exists.
Off-street parking spaces including the access drive shall be surfaced with gravel, asphalt, concrete or the
equivalent and shall be graded to prevent drainage problems.
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds.
Storm Water Drainage:
The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will
reasonably preserve the natural character of the area and prevent property damage of the type generally
attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm
run-off.
The applicant must take into consideration storm water capture/quantity and provide accordingly for best
management practices.
This area IS NOT in FEMA Flood Zones.

AMUSR-1193
1. A building permit is required prior to any new construction or change of use of any existing buildings.A change of
use will be required for the office in the existing garage. A building permit will be required if additional bathrooms for
employees are added.
2. A plan review is required for each building for which a building permit is required. Plans shall bear the wet stamp of
a Colorado registered architect or engineer. Two complete sets of plans are required when applying for each permit.
• 3. Structures shall conform to the requirements of the various codes adopted at the time of permit application.
Currently the following has been adopted by Weld County: 2006 International Building Code; 2006 International
Mechanical Code; 2006 International Plumbing Code; 2006 International Fuel Gas Code; and the 2005 National
Electrical Code and Chapter 29 of the Weld County Code.
4. New structures will require an engineered foundation based on a site-specific geotechnical report or an open hole
inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a Colorado
registered engineer.
5. Fire resistance of walls and openings, construction requirements, maximum building height and allowable areas will
be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning Ordinance.
6. Building height shall be measured in accordance with the 2006 International Building Code for the purpose of
determining the maximum building size and height for various uses and types of construction and to determine
compliance with the Bulk Requirements from Chapter 23 of the Weld County Code. Building height shall be measured
in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset and setback
requirements. When measuring buildings to determine offset and setback requirements,buildings are measured to the
farthest projection from the building. Property lines shall be clearly identified and all property pins shall be staked prior
to the first site inspection.
7. Provide letter of approval from Southeast Weld Fire protection District prior to new construction.
8. There is one historical building permit with final status on record for this parcel.

Dear Ms. Hatch:
We have received your request for comment for the Gary Novotny salvage yard project(AMUSR-1193)and would
like to thank you for the opportunity to comment on this proposal. The goal of the Colorado Division of Wildlife
(CDOW)is to provide complete, consistent and timely information to all entities who request comment on matters
within our statutory authority and our mission-which is to protect,preserve,enhance and manage wildlife and their
environment for the use, benefit, and enjoyment of the people of Colorado and its visitors.
• District Wildlife Manager Chris Mettenbrink recently visited the proposed project site and found that the site
mainly consisted of disturbed grasslands, agricultural fields,with a variety of trees bordering the northern boundary
of the property. A variety of wildlife species can be found using these types of habitats including grassland birds,
raptors, deer, coyotes, and a variety of small mammals.
The Division of Wildlife makes the following recommendations to mitigate the impacts to wildlife in the area:
1. If possible leave in tact the trees and shrubs that border the property.
2. Any fences constructed should follow the guidelines below.
3. A weed management plan should be developed for during and after construction.
Trees and Shrubs
If possible the CDOW recommends that the trees line and shrubs on the property be left in place. Trees and shrubs
provide a shelter and food for a variety species of wildlife and add value to the property.
Fences
Some types of fencing can be dangerous and even fatal to deer and pronghorn(antelope). CDOW recommends that
if any fencing is to be used within or around the project site,either during or after the project, should be the type
that would allow the free passage of wildlife. Fencing plans should avoid the use of woven wire type fences that

will trap or prevent movement of wildlife. The Division of Wildlife prefers the use of three or four strand fencing
with a bottom strand height of 17 inches and a maximum top strand height of 42 inches, along with installation of
double stays between posts.This design allows young animals to pass under,as well as allows mature deer and
• pronghorn to cross over the top.
Weed Management
The spread and control of noxious weeds on the site is also a concern for wildlife. The Colorado Division of
Wildlife recommends that consideration be given to using principles of an integrated weed management plan which
Weld County may already have in place. Invasive plants endanger the ecosystem by disturbing natural processes
and jeopardizing the survival of native plants and the wildlife that depend on them. The threat is so severe in the
United States that scientists now agree that the spread of invasive species is one of the greatest risks to biodiversity.
Thank you again for the opportunity to comment on the Gary Novotny salvage yard project. Please do not hesitate

Dear Ms. Hatch:
This referral does not appear to qualify as a "subdivision" as defined in Section 30-
28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005
memorandum to county planning directors, this office will only perform a cursory review of
the referral information and provide comments. The comments do not address the
adequacy of the water supply plan for this project or the ability of the water supply plan to
• satisfy any County regulations or requirements. In addition, the comments provided
herein cannot be used to guarantee a viable water supply plan or infrastructure, the
issuance of a well permit, or physical availability of water.
According to the submitted information, the water for the commercial business as
well as for drinking and sanitary purposes will be provided by an existing well, Permit No.
275131. It appears that the existing well was re-permitted on September 5, 2007, to include
the commercial use in addition to the previous domestic use.
