HomeMy WebLinkAbout20081426.tiff RESOLUTION RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION ZCV #0701206 AGAINST JACOB AND BETTY DAWSON FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,Jacob and Betty Dawson,ZCV#0701206,are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 13th day of May, 2008, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Jacob and Betty Dawson, property owners, and Rick Dory, tenant, were present at said hearing, and WHEREAS, the Board deems it advisable to bring legal action against those individuals named above to correct said violation. REMEDY 2008-1426 Nation Summary Rep rt as we previously discussed the COMMERCIAL VEHICLES shall be permitted or removed as well as any storage. At one point in time, you indicated that your intent to accomplish this was to split the property through a Recorded Exemption (RE) and then apply for a Use by Special Review(USR). In splitting the property, you will also need to apply for a new Zoning Permit(ZPMH) for a Principle Dwelling Unit. However, I have not heard from you in quite some time, but my last inspection still revealed numerous Commercial Vehicles and miscellaneous debris. RECOMMENDATION The Department of Planning Services recommends this case be forwarded to the County Attorney's Office, but to delay legal action for 60 days.
