HomeMy WebLinkAbout831051.tiff RESOLUTION RE: APPROVAL OF EXTENSION OF AGREEMENT BETWEEN WELD COUNTY AND STEAMWAY FOR CLEANING SERVICES AND AUTHORIZATION FOR CHAIRMAN TO SIGN SAME WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on the 10th day of May, 1982 , SteamWay and Weld County entered into an agreement concerning cleaning services, and WHEREAS, the original terms of the agreement were for the period of July 1, 1982 to June 30, 1983, and WHEREAS, a request has been presented to the Board for an extension to June 30, 1964, a copy of the agreement authorizing said extension being attached hereto and incorporated herein by reference, and WHEREAS, after review, the Board deems it advisable to approve the extension of said agreement to June 30, 1984. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the extension of the agreement between SteamWay and Weld County to June 30, 1984 , be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board of County Commissioners that the Chairman of the Board be, and hereby is, authorized to sign said agreement. Brantner 62 )24rLy County Attorney Norman Carlson LHR 853 l J Cqrane Jh son A: Dept CAO Bids DAY FILE: JUNE 1, 1983 831051 AGREEMENT FOR STEAM CLEANING SERVICES THIS AGREEMENT made on the 25th day of May, 1983 by and between STEAMWAY OF GREELEY, hereinafter referred to as "SteamWay" and the COUNTY OF WELD, STATE OF COLORADO, by and through its Board of County Commissioners, hereinafter referred to as "County". 1 . SERVICES SteamWay shall provide steam cleaning services to County on a per call basis for the various departments in Weld County Government in accordance with the standards indicated on Exhibit "A" attached hereto and incorporated herein by reference and as hereinafter provided. All calls from the County to SteamWay shall be initiated from the Supervisor of Buildings and Grounds. Except on an emergency basis, all cleaning shall be done in the evenings or on weekend hours, and SteamWay must have the carpet dry by the start of the next day' s normal business hours. During all times that cleaning is done after normal working hours and on weekends, SteamWay must arrange with the Buildings and Grounds' Supervisor for the provision of security. SteamWay shall do all work in a good workmanlike manner. 2. TERM OF CONTRACT This contract shall commence on July 1 , 1983 and shall continue for a period of one (1 ) year and shall then terminate automatically by its own terms, subject only to termination by either party in the event of breach of contract, in which case, this contract may be terminated by given written notice of termination to the other party at least thirty (30) days prior to the proposed termination date. 3. CONTRACT PRICE County agrees to pay to SteamWay for the services provided in this contract at the rate of six cents (6(t) per square foot of carpet cleaned for all cleaning of 5,000 or more square feet of carpet per call . If amount of carpet to be cleaned on a call is less than 5,000 square feet, then the rate shall be seven cents (7¢) per square foot. Neutralizing agent applied to wool carpets is at the rate of two cents (2(t) per square foot of carpet. Each call shall be billed by SteamWay and shall be paid by County within thirty (30) days of billing. - 2 - 4. GUARANTEES SteamWay guarantees that there shall be no stretching, shrinking, or other damage to the carpet caused by their operations. SteamWay shall use only trained employees certified as carpet cleaners. 5. EQUIPMENT SteamWay shall use truck-unit equipment as indicated on Exhibit "B" attached hereto and incorporated herein by reference. SteamWay shall not carry any water into any of the buildings to be cleaned. 6. COUNTY TO PROVIDE ACCESS It shall be the duty of the County to provide access to County buildings to SteamWay so that SteamWay may carry out its obligations under this contract. 7. MODIFICATION TO CONTRACT No modification or waiver of this agreement or any other covenant, condition or provision herein contained shall be valid unless in writing and duly executed by the party to be charged therewith. 8. INSURANCE SteamWay shall carry adequate insurance to protect itself and the County from personal liability or property damage. SteamWay shall provide copies of such insurance policies to the Supervisor of Buildings and Grounds before commencing any work under this Agreement. 9. COMPLETE AGREEMENT This agreement embodies the full agreement between the parties. There are no inducements, promises, terms, conditions or obligations made or entered into either by SteamWay or the County other than contained herein, and this contract shall supercede all previous communications, represen- tations or agreements, either verbal or written, between the parties hereto. In 1982 and 83 it seems as though that most of our costs of supplies and labor have been fairly stable. Therefore SteamWay is willing to continue for another year contract through June 30th of 1984 at the same cost to the county as our present contract, if we can go without going out for bid. In the past year we did not have to clean near as much as in our first year of cleaning. We feel the carpets are staying in great shape and would like to continue providing the maintenance on them. In the past 2 years we have had an excellent working relationship with the Weld County Buildings and Grounds. At this time we know where and what your people are talking about when they call and we feel it would be to your advantage along with ours if we could continue our contract with you. The prices on our present contract are as follows: $0.06 per sq. ft . (over 5000 sq. ft. per call) $0.07 per sq. ft. (under 5000 sq. ft. per call) Additional #0.02 per sq. ft. for wool carpets in the court house. Optional $0.025 per sq. ft. for any carpet guard applied at contractees request . All other spotters, pre—scrubbing and solutions used are included in above prices. I want to thank you for your business in 1981-82 and 1982-83 and look forward to your response for 1983-84. It was a pleasure doing work for Weld County and if ever there are any problems of any kind please feel free to contact me and rest assured they will be taken care of as soon as possible.
