TO THE C-2 (GENERAL COMMERCIAL) ZONE DISTRICT FOR ONE LOT WITHIN THE
RED BARON ESTATES PUD - MARK HOLLIDAY/RED BARON DEVELOPMENT, LLC,
AND ANDREW PARKS/LAFAYETTE FOUNDATION
A public hearing was conducted on January 23, 2008, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated December 27, 2007, and duly published January 2,
2008, in the Fort Lupton Press, a public hearing was conducted to consider the request of Mark
Holliday/Red Baron Development, LLC,and Andrew Parks/The Lafayette Foundation,for Amended
Change of Zone,AmPZ#1035, from the E(Estate)Zone District to the C-2(General Commercial)
Zone District,for one lot within the Red Baron Estates PUD. Bruce Barker, County Attorney, made
this a matter of record. Chair Jerke advised the applicant's representative, Marilyn Taylor,that she
has the option of continuing this matter to a date when the full Board will be present. However, if
she decides to proceed today, it will require three affirmative votes, or in the case of a tie vote,
Commissioner Long will listen to the record and make the determining vote. Ms. Taylor indicated
she would like to proceed today. Jacqueline Hatch, Department of Planning Services, presented
a brief summary of the proposal, entered the favorable recommendation of the Planning
Commission into the record as written, and gave a brief description of the location of the site. She
stated the applicant is proposing to change the zoning on Lot 7 from PUD (Planned Unit
Development) to C-2 (General Commercial) to relocate the Vintage Air Museum from the Platte
Valley Airpark to Lot 7. She further stated the site is within the three-mile referral area for the City
of Fort Lupton, which did not respond, and the Town of Hudson, which indicated no concern with
the proposal. Ms. Hatch displayed photographs of the site and surrounding area, and stated the
Platte Valley Airpark is located to the southwest, single family lots are located to the north and
west, USR#1322 for chickens and USR#1575 for an assisted living facility are located to the east,
and there are also agricultural uses in the vicinity. She stated 13 referral agencies reviewed the
proposal,four offered no comment, six responded favorably or provided comments that have been
addressed in the Conditions of Approval, and no response was received from the Airport Authority,
Platte Valley Soil Conservation District, or the City of Fort Lupton. She further stated staff is
requesting an administrative review of the Final Plan, along with a concurrent review of the Site
Plan Review application.

Pam Smith, Department of Public Health and Environment, stated Lot 7 will be served by a private
well, and since the development will serve the public, the applicant is required to apply through the
Colorado Department of Public Health and Environment to address the public water system
requirements. She stated the applicant is also proposing a future restaurant at the museum with
paper service only. She further stated the museum will be allowed to host one special event per
year, and the septic system will be adequately sized for the facility. In response to Commissioner
Masden, Ms. Smith explained a paper service only restaurant requires less water, which will meet
the constraints of the smaller lot size and septic system. She further stated the applicant will be
required to provide portable toilets for special events hosted at the site.
Don Dunker, Department of Public Works, stated the site will be accessed from Park Lane, which
extends off of County Road 39. He stated as of September 2007, County Road 39 has an average
daily traffic count of 172 vehicles. He further stated the remainder of his comments will be
addressed at the time of Final Plan. In response to Commissioner Masden, Mr. Dunker stated a
traffic count was also conducted on County Road 18 in September 2007, and it also has an
average daily traffic count of 172 vehicles per day.
Andy Parks, President of The Lafayette Foundation, stated they operate a historic and educational
501(c)3 foundation,which was incorporated in Colorado in 1984,and they receive financial backing
from the Gates Robert Family Trust. He stated this is the largest museum of its kind, housing
aircraft and memorabilia from World Wars I and II. He stated they intend to construct a museum
facility, as well as the hangars to house the aircraft. He further stated they will host school field
trips, as well as public functions, and they hope to have the third building completed within the next
two years.
No public testimony was offered concerning this matter. In response to Commissioner Jerke,
Mr. Parks stated he and the applicant have reviewed, and concur with, the Conditions of Approval.
Commissioner Masden moved to approve the request of Mark Holliday/Red Baron Development,
LLC, and Andrew Parks/The Lafayette Foundation, c/o Marilyn Taylor, for Amended Change of
Zone, AmPZ #1035, from the E (Estate) Zone District to the C-2 (General Commercial) Zone
District for one lot within the Red Baron Estates PUD, based on the recommendations of the
Planning staff and the Planning Commission, with the Conditions of Approval as entered into the
record. The motion was seconded by Commissioner Garcia, and it carried unanimously. There
being no further discussion, the hearing was completed at 10:35 a.m.
Following the formal hearing proceedings, in response to Commissioner Masden, Mr. Parks stated
the museum contains materials from World War I, which were collected by his father since 1937.
He stated he was fortunate to be acquainted with many of the surviving WWI pilots, and 45 WWI
Aces gathered at a reunion in Paris, France, in 1981. He reviewed the names of numerous pilots
who are represented by items contained in the museum collection, and stated the museum is
known world-wide and contains an extensive archive for authors and historians. Mr. Parks stated
they have participated with providing information used in documentaries, movies, and books. He
stated this is a treasure for Weld County, and the location provides the best venue for flying and
displaying the aircraft. He stated this museum collection surpasses all others and it is used as a
resource by the Smithsonian Museum. He further stated many European counties lost a lot of their
artifacts during, and after, the Wars; however, this museum houses a large collection of materials

from foreign pilots who came to the United States following the Wars. In response to
Commissioner Jerke, Mr.Parks stated they currently display the planes on the weekends;however,
once the museum building is complete, they intend to be open to the public seven days a week.
This Certification was approved on the 28th day of January, 2007.
