RE: ISDS-0701067, requirements for approval of septic system installed without a permit
Dear Mr. Shubert: On December 5th, 2007, an ISDS inspection was performed by Steve
Wiatrowski, an Environment Health Specialist with this Division. The following non-
compliance issues were discovered:
1. The leach field was installed without obtaining a repair permit. The field
installation was observed by Jay Freese of Freese Engineering, and the evidence of the
field installation was observed by Steve Wiatrowski.
2. The field was installed approximately five (5) feet from the shop. Weld County
ISDS Regulations (Chapter 30, Appendix 30-B) requires that the leach field be setback
from any dwelling or occupied building by at least twenty(20) feet. The Commercial
Shop is considered an occupied building.
3. The engineer's assessment dated November 6, 2007, was based on a percolation
rate (16 mpi) for the modular home located south of the subject property. While this
extrapolation would be adequate for an existing field for which no data or permit was
available, or where the referenced percolation area is within fifty(50) feet of the new
leach field, it is unacceptable in light of our discovery that:
• the field is newly installed—and
• the referenced percolation data is from an area that is approximately two
hundred and fifty(250) feet away.
Therefore, the following is required in order to approve this system:
1. Obtain percolation and soil profile data for the location of the newly installed
field. CAUTION: If there is insufficient room in the area of the newly installed
field to meet the twenty(20) foot setback to the shop, and the ten (10) foot
setback to the property line, you should perform these soil tests in an area where
the field can be moved to.

2. Provide a reassessment of the sizing for the commercial system from your
engineer,based on the actual percolation and soil profile data. If the actual data
show the size and/or installation of the field to be inadequate, the field will
have to be modified to meet these conditions.
3. Bring these documents to the Weld County Department of Public Health and
Environment, located at 1555 N. l7`h Ave., Greeley, CO 80631:
• Two engineer stamped originals of the soils report
• Two engineer stamped originals of the reassessment of commercial sizing
You must submit these documents, and apply for a commercial repair permit($600.00).
4. If you were able to keep the system in its current location, and modify it to meet
the conditions listed above, you will need to do the following before final
inspection:
• Uncover the distribution box
• Uncover a four (4) foot section of the sewer line between the tank and the
distribution box.
• Uncover a four(4) foot section of the sewer line between the distribution
box and the field.
• Provide visible evidence that the setbacks to the shop and the property line
have been met.
5. If you must move the leach field to another location, you must leave the new
installation completely uncovered for inspection by the Weld County Health
Department and your engineer.

9/25/07—Talked to Mr. Shurbert @ 303-517-2159. Mr. Shurbert stated he is a trucker
and has not had time. I have given him a deadline to have septic issues resolve of
11/1/07. If not we will review it at that time to resolve the issue. Possible action will be
to take the case to the Board of County Commissioners; I have discussed this with Mr.
Shubert.

Char,
I went out to Mr. Shubert's property yesterday. He was not there, but several employees were. I inspected the
tank behind the house, which was the subject of the letter sent to him on June 3, 2002. It appeared to me that if
anything had been previously resolved, it was no longer, as the lid to the tank was off, and wires were coming out
of it, apparently connected to a pump. I asked one of his employees why the lid was off, and he replied that they
had been pumping it out.
One of the other employees called Mr. Shubert, who was picking up something from the mountains. Mr. Shubert
told the employee to tell me I had to come back when he was present on the property.
At this point, I intend to call Mr. Shubert to see what the deal is. I don't hold much confidence that he will provide
us with the truth. I will need him to provide some proof that the tank is connected to a drain field, and that the
system is permitted. The pump will need to be disconnected. I'm not sure why this didn't happen already, except
that this was never a separate incident file, as it was discovered incidentally to an inspection of the property for
other reasons.
So, to make a long story shorter, he is not in compliance yet. I'll let you know how my phone conversation with
him goes.

Dear Applicant:
On June 4, 2003, your application for a use by special review was administratively approved by the Weld
County Board of County Commissioners with specific Conditions of Approval.
One of the required Conditions of Approval grants applicants sixty(60) days to submit a Mylar Plat. Should
you choose not to complete the use by special review process and provide the required Mylar Plat, the
Department of Planning Services will need to be notified in writing of your decision.
If you do not formally withdraw your application and/or are unable to meet the Conditions of Approval, your
case will be scheduled for a hearing before the Weld County Board of County Commissioners. Planning
Staff will be recommending denial or your request at this hearing. If your application is denied by the Board
of County Commissioners, the decision could affect future land development applications located on this
parcel. Withdrawing applications will not generally affect future applications.
Planning Services Staff is aware of the difficulty and associated delays in meeting the Conditions of
Approval normally associated with land use cases, and is willing to work with you in completing your
request. Please notify the Department of Planning Services, in writing, within 10 working days of your

Condition 1C -APEN Information has been submitted by the applicant indicating that an APEN is not needed-
storage of Carnival equipment only. This condition is resolved and can be removed.
Condition 1D - Septic System Engineer review. Information about the use of restrooms for employees has not
been resolved.
According to the application 4 seasonal employees are on site. The two Septic permits on file are indicated
for residential use only not commercial. An engineer review is required for the additional numbers of people using
the restrooms and must be permitted as a commercial use. Therefore, this condition is still pending to resolve
these concerns.
Condition 1 E -Above ground storage tanks. According to representative of applicant the large fuel tank has been
removed and the two small tanks are not being used at this time. This condition is resolved and can be removed.
Condition 1F -Washing of Vehicles/equipment. According to representative there is minimal washing of
equipment on site. This condition is resolved and can be removed.
Condition 1G -Waste Handling Plan Information regarding waste on property has been submitted by the
representative. This condition has been met and can be removed.
