HomeMy WebLinkAbout20081543.tiff RESOLUTION • RE: APPROVE PETITION AND AGREEMENT FOR ANNEXATION OF A PORTION OF COUNTY ROAD 7 (STATE LAND BOARD ANNEXATIONS #1 - #4) AND AUTHORIZE CHAIR PRO-TEM TO SIGN - TOWN OF MEAD WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on May 28, 2008, the Board was presented with a Petition for the Annexation of a Portion of County Road 7 (State Land Board Annexations #1 -#4)from the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, to the Town of Mead, Colorado, and WHEREAS, at said meeting the Board deemed it advisable to continue the matter to June 4, 2008, and then to June 16, 2008, to allow the matter to be considered by a full quorum of the Board, and WHEREAS, the Board has reviewed the Annexation Agreement with the Town of Mead, • which addresses the annexation of this section of road, and finds the same to be acceptable and appropriate, and WHEREAS, after review, the Board deems it advisable to approve said petition and said agreement, copies of which are attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Petition for the Annexation of a Portion of County Road 7 (State Land Board Annexations#1 -#4)from the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, to the Town of Mead, Colorado, be, and hereby is, approved. These proposed annexations fall outside the I-25 MUD. All these proposed annexations, except the WCR 13 annexation, lie west of 1-25. Our comments are below. GENERAL COMMENTS: 1. Highland Estates Annexation — a serial annexation on WCR 7 south of WCR 38. This road annexation of approximately 2650 feet of 60-foot Right of Way. This road annexation will result in Mead jurisdiction over 1 mile of WCR 7 from WCR 38 to WCR 36. Public Works supports this annexation. 2. WCR 36 Vale View Annexation—This road annexation is a full mile of 60-foot ROW along WCR 36 between WCR 7 and I-25. Public Works supports this annexation. 3. WCR 34 Annexation — This road annexation of 30 feet of ROW (the south half of WCR 34 not • already annexed by Mead) extends between WCR 7 and 1-25 for a length of approximately 1504 feet. Public Works supports this annexation. 4. State Land Board Annexation—This serial annexation will incorporate 60 feet of WCR 7 ROW south of WCR 34 for a length of 1828 feet. This road annexation will create an approximately 320 acre enclave of County jurisdiction surrounded by Mead. This road annexation will result in Mead jurisdiction over 1 mile of WCR 7 from WCR 34 to WCR 32. Public Works supports this annexation. 5. Hunters Ridge Annexation—This road annexation will incorporate 60 feet of WCR 7 ROW south of WCR 32 for a length of approximately 2653 feet. Mead has already annexed the subdivisions on either side of this stretch of WCR 7. This road annexation will result in Mead jurisdiction over 1/2 mile of WCR 7 from WCR 32 to WCR 30. Public Works supports this annexation. 6. WCR 13 Annexation—This annexation will incorporate the 60 feet of WCR 13 ROW 1/2 mile north of State Highway 66 for a length of approximately 2653 feet. This road annexation lies adjacent to the 160 acre Grand View Estates subdivision which has already been annexed into Mead. Public Works supports this annexation. Note that these proposed annexations will leave short segments of County roads interspersed with Mead jurisdiction roads. Discussions between Public Works and the Town of Mead to address efficient maintenance and snow plowing needs for discontinuous road segments have begun. Masden, Chair Pro-Tern of the Weld County Board of Commissioners, on behalf of Weld County, in accordance with Colorado law, hereby petition the Town of Mead and its Board of Trustees for annexation to the Town of Mead,the following described unincorporated territory located in the County of Weld and State of Colorado, to-wit: That portion of the Weld County Road 7 right-of-way lying in Sections 15 and 16, T3N, R68W of the 6(h PM, as more precisely described in Exhibit A,attached hereto and incorporated herein by this reference. As part of this petition,your petitioner further states to the Board of Trustees of Mead, Colorado, that: 1. It is desirable and necessary that the territory described in Exhibit A be annexed to the Town of Mead. 2. The requirements of C.R.S. sections 31-12-104 and 31-12-105,as amended,exist or have been met in that: a. Not less than one-sixth of the perimeter of the area proposed to be annexed is contiguous with the Town of Mead or will be contiguous with the Town of Mead within such time as required by 31-12-104. b. A community of interest exists between the area proposed to be annexed and the Town of Mead. • c. The area proposed to be annexed is urban or will be urbanized in the near future. d. The area proposed to be annexed is integrated with or is capable of being integrated with the Town of Mead. • e. No land within the boundary of the territory proposed to be annexed which is held in identical ownership,whether consisting of one tract or parcel of real estate or two or more contiguous tracts or parcels of real estate, has been divided into separate parts or parcels without the written consent of the landowner or landowners thereof, unless such tracts or parcels were separated by a dedicated street,road or other public way. 1. No land within the boundary of the area proposed to be annexed which is held in identical ownership,comprises twenty acres or more, and which, together with the buildings and improvements situated thereon has an assessed value in excess of two hundred thousand dollars($200,000.00)for ad valorem tax purposes for the year next preceding the annexation, has been included within the area proposed to be annexed without the written consent of the landowner or landowners. g. No annexation proceedings have been commenced for any portion of the territory proposed to be annexed for the annexation of such territory to another municipality. h. The annexation of the territory proposed to be annexed will not result in the detachment of area from any school district. i. The annexation of the territory proposed to be annexed will not have the effect of extending the boundary of the Town of Mead more than three miles in any direction from any point of the boundary of the Town of Mead in any one year. • Page 1 of 5 • j. Prior to completion of the annexation of the territory proposed to be annexed,the Town of • Mead will have in place a plan for that area,which generally describes the proposed: Location,character,and extent of streets,subways,bridges,waterways,waterfronts, parkways, playgrounds,squares,parks, aviation fields,other public ways,grounds,open spaces, public utilities,and terminals for water, light,sanitation,transportation,and power to be provided by the Town of Mead; and the proposed land uses for the area; such plan to be updated at least once annually. k. In establishing the boundary of the territory proposed to be annexed,if a portion of a platted street or alley is to be annexed,the entire width of the street or alley has been included within the territory to be annexed. The Town of Mead will not deny reasonable access to any landowners,owners of any easement,or the owners of any franchise adjoining any platted street or alley which is to be annexed to the Town of Mead. 3. The area proposed to be annexed, consists exclusively of certain rights-of-way for county roads,30 feet on either side of section and township lines,as established by the Board of County Commissioners for Weld County, recorded October 14, 1889 in Book 86,at Page 273. 4. Accompanying this petition are four copies of an annexation map containing the information following: a. A written legal description of the boundaries of the area proposed to be annexed; b. A map showing the boundary or the area proposed to be annexed, said map prepared and containing the seal of a registered engineer; c. Within the annexation boundary map, a showing of the location of each ownership tract in unplatted land and, if part or all of the area is platted,the boundaries and the plat numbers of plots or of lots and blocks; d. Next to the boundary of the area proposed to be annexed, a drawing of the contiguous • boundary of the Town of Mead and the contiguous boundary of any other municipality abutting the area proposed to be annexed,and a showing of the dimensions of such contiguous boundaries. • 5. Upon the Annexation Ordinance becoming effective,all lands within the area proposed to be annexed will become subject to all ordinances,rules and regulations of the Town of Mead, except for general property taxes of the Town of Mead. 6. The zoning classification(land use)requested for the area proposed to be annexed is"Public Purposes"in Performance District 1. NOW THEREFORE,in consideration of the foregoing premises and the covenants, promises and agreements of each of the parties hereto,to be kept and performed by each of them, • it is agreed by and between the parties hereto as follows: 1. Submission of Annexation Petitions: Annexor has submitted to the Town for its consideration certain annexation petitions for the annexation of the real property described in Exhibit A,with said petitions being incorporated herein by reference (hereinafter the"Annexation Petitions"). The Annexation Petitions have been submitted on the express condition that they will be approved by the Town and the real property described in Exhibit A will be annexed to the Town under and pursuant to the conditions set forth in Paragraph 2,hereunder, and pursuant to the agreement for Annexor to pave the intersection of WCR's 7 and 38, as set forth in Paragraph 4,hereunder. 2. Conditions Applicable to Annexation. It is expressly understood by the Town that certain requirements are being imposed by Annexor as a condition precedent to the Town's annexation of the real property described in Exhibit A. These conditions are as follows: (a) From and after annexation of the real property described in Exhibit A,the Town,except as hereinafter provided, will be responsible for prospective maintenance of said real property. (d) Current ingress and egress to the real property described in Exhibit A for current uses will continue to be allowed for such purposes,the intent being that annexation shall not impair or affect current access. 3. Town's Consent to Conditions. By execution hereof,the Town shall be deemed to agree to each and every condition stated in Paragraph 2 hereof and the use and maintenance of the real property described in Exhibit A shall thereafter be in accordance with the provisions therein. 4. Paving of Intersection of WCR's 7 and 38. Prior to August 1,2008,Annexor shall, at its sole expense,pave the intersection of WCRs 7 and 38 in the manner and timing agreed to by separate agreement of the parties. 5. Entire Agreement. This instrument embodies the entire agreement of the parties with respect to the subject matter hereof. There are no promises,terms, conditions,or obligations other than those contained herein; and this Agreement shall supercede all previous communications,representations,or agreements, either verbal or written,between the parties hereto. No modification to this • Agreement shall be valid unless agreed to in writing by the parties hereto. 6. Binding Effect. This Agreement shall inure to the benefit of and be binding upon the parties hereto and their successors in interest. 7. No Third-Party Enforcement. It is expressly understood and agreed that the enforcement of the terms and conditions of this agreement,and all rights of action relating to such enforcement, shall be strictly reserved to the undersigned parties and nothing in this agreement shall give or allow any claim or right of action whatsoever by any other person not included in this agreement. It is the express intention of the undersigned parties that any entity other than the undersigned parties receiving services or benefits under this agreement shall be an incidental beneficiary only. 8. No Waiver of Immunities. No portion of this agreement shall be deemed to constitute a waiver of any immunities the parties or their officers or employees may possess,nor shall any portion of this agreement be deemed to have created a duty of care which did not previously exist with respect to any person not a party to this agreement. 9. Severability.
