The submitted materials are in compliance with the application requirements of Section 23-2-260 of the Weld County Code. 2. It is the opinion of the Department of Planning Services' staff that the applicant has shown compliance with Section 23-2-220 of the Weld County Code as follows: a. Section 23-2-220.A.1 --The proposed use is consistent with Chapter 22 and any other applicable code provisions or ordinance in effect. Section 22-5-100.A (OG.Goal 5.) states"Oil and gas support facilities decisions which do not rely on geology for locations shall be subjected to review...." This proposal has been reviewed by the appropriate referral agencies and it has been determined that the attached Conditions of Approval and Development Standards ensure that there are adequate provisions for the protection of the health, safety and welfare of the inhabitants of the neighborhood and county. • USR-1617-Warncr 2 • 22-2-60 D. A.Goal 4. states: "Conversion of agricultural land to nonurban residential, commercial and industrial uses will be accommodated when the subject site is in an area that can support such development. Such development shall attempt to be compatible with the region. This goal is intended to address conversion of agricultural land to nonurban uses. Once converted, this land is less conducive to agricultural production." This operation encompasses a small portion of the property (approximately 5 acres). Development standards and conditions of approval ensure that visual impacts and fugitive dust impacts will be mitigated. 22-4-40.E.1 states: "Development will occur in areas where adequate water quantity and quality is currently available or reasonably obtainable." There is an existing 4-inch commercial Little Thompson water tap located on the property. b. Section 23-2-220.A.2 --The proposed use is consistent with the intent of the A (Agricultural)Zone District. Section 23-3-40 A.2 of the Weld County Code provides for Oil and Gas Support and Service facilities as a Use by Special Review in the A(Agricultural) Zone District. c. Section 23-2-220.A.3 --The uses which will be permitted will be compatible with the existing surrounding land uses. The site is adjacent to a single-family residence to the West and the Garcia PUD to the Southwest, agricultural land to the South and East and a single-family residence and agricultural land to the North. The applicants are proposing to relocate the existing access point from County Road 3 to • State Highway 60. The proposed access point for this facility is an existing oil and gas access approximately 1/8 of a mile to the east of the intersection of County Road 3 and State Highway 60. This access point is adjacent to an existing single-family residence across State Highway 60. The applicant is proposing to relocate the access to address impacts to County Road 3 (fugitive dust...) and adjacent residential properties to the east of the site. Attached development standards and conditions of approval ensure that visual impacts, fugitive dust and traffic impacts will be mitigated. The site is currently in violation (VI-0700110); if this Use by Special Review application is approved the property will be in compliance. If denied, the Department Planning Services requests that the Board of County Commissioners refer this case to the County Attorney's Office, but to delay legal action thirty(30)days in order to give the applicant adequate time to ensure that all operations have ceased and vehicles have been removed from the property. d. Section 23-2-220.A.4 --The uses which will be permitted will be compatible with future development of the surrounding area as permitted by the existing zoning and with the future development as projected by Chapter 22 of the Weld County Code and any other applicable code provisions or ordinances in effect, or the adopted Master Plans of affected municipalities. The proposed site is located within the 3-mile referral areas for Larimer County and the Towns of Berthoud and Johnstown. It is not located within an Intergovernmental Agreement Area boundary. Larimer County, Berthoud and Johnstown all indicated no conflict with their interests in their respective referrals dated May 17, 2007, June 8, 2007, and May 10, 2007. • USR-1617-Warner 3 • e. Section 23-2-220.A.5 --The application complies with Section 23-5 of the Weld County Code. Effective January 1, 2003, Building Permits issued on the proposed lots will be required to adhere to the fee structure of the County Road Impact Program. (Ordinance 2002-11) Effective August 1, 2005, Building permits issued on the subject site will be required to adhere to the fee structure of the Capital Expansion Impact Fee and the Stormwater/Drainage Impact Fee. (Ordinance 2005-8 Section 5-8-40) f. Section 23-2-220.A.6 --The applicant has demonstrated a diligent effort to conserve prime agricultural land in the locational decision for the proposed use. The site is located on land designated as "Prime" according to the according to the 1979 Prime Farmlands of Weld County Map. However, the commercial water tap and structures are in place and with little land (approx. 5 acres) taken out of production. The majority of the site is still in agricultural production. g. Section 23-2-220.A.7 --The Design Standards (Section 23-2-240, Weld County Code), Operation Standards (Section 23-2-250, Weld County Code), Conditions of Approval and Development Standards ensure that there are adequate provisions for the protection of health, safety, and welfare of the inhabitants of the neighborhood and County. This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral entities. • The site is currently in violation (VI-0700110)for the operation of a commercial water tap for oil and gas support services without the property zoning permits. If this Use by Special Review application is approved and the plat is recorded the property will be in compliance. If denied, the operation shall be removed from the property, otherwise, the violation case will proceed accordingly. The Department of Planning Services'staff recommendation for approval is conditional upon the following: 1. Prior to recording the plat: A. The plat shall be amended to delineate the following: 1. The attached Development Standards. (Department of Planning Services) 2. All sheets of the plat shall be labeled USR-1617. (Department of Planning Services) 3. CR 3 is a local gravel road and requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of setback in the Weld County Code (23-1-90), the required setback is measured from the future right-of-way line. (Department of Public Works) 4. The off-street parking, loading spaces, and the access drive shall be surfaced with recycled asphalt, asphalt, concrete or the equivalent and shall be graded to • prevent drainage problems. (Department of Public Works) USR-1617-Wamer 4 • 5. The vehicle turn-around/parking area shall be completely screened from adjacent properties. The type and height of proposed fencing and landscaping to be installed shall be indicated on the plat. (Department of Planning Services) 6. Off-street parking for the facility shall be indicated on the plat (a minimum of ten (10)tractor trailer spaces). (Department of Planning Services) 7. The plat shall be prepared in accordance with Section 23-2-260.D of the Weld County Code. The plat scale shall be enlarged to 1"=40'. (Department of Planning Services) B. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. Evidence of such shall be submitted to the Department of Planning Services. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals to be stored on site. 3) The waste handler and facility where the waste will be disposed (include the facility name, address, and phone number). (Department of Public Health & Environment) • C. The applicant shall submit evidence of an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application from the Air Pollution Control Division (APCD), Colorado Department of Health and Environment. Alternately, the applicant can provide evidence from the APCD that they are not subject to these requirements. Written evidence of such shall be provided to the Department of Planning Services. (Department of Public Health and Environment) D. The applicant shall submit a dust abatement plan for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. Written evidence of such shall be provided to the Department of Planning Services. (Department of Public Health and Environment) E. The applicant shall address the recommendations/requirements of the Weld County Sheriff's Office as stated in their referral received 6/3/2007. Written evidence of such shall be provided to the Department of Planning Services. (Department of Planning Services) F. Written evidence that the access to State Highway 60 has been approved by the Colorado Department of Transportation (CDOT) shall be provided to the Department of Planning Services. If CDOT denies access from State Highway 60, the applicant shall enter into an Off-site Road Improvements Agreement with the Weld County Public Works Department for the upgrade and paving of CR 3 from the southern most access to the property to State Highway 60. The typical cross section will reflect 24 feet of pavement with four-foot shoulders, adequate depth of asphalt shall be determined a geo-tech report to accommodate the type of use at the facility. This report will be reviewed by the Public Works Department prior to approval. As a part of the Improvements Agreement, the applicant shall provide a road construction set of plans identifying adequate turning • USR-1617-Wamer 5 • radiuses at 90°to CR 3 tracking pads at both access points. The purpose of the tracking pads is to keep from tracking debris, rocks, and mud on to the paved road surface. (Department of Public Works) G. The applicant shall attempt to address the requirements of the Berthoud Fire Protection District as stated in their referral received 5/22/2007. Written evidence of such shall be provided to the Department of Planning Services. (Berthoud Fire Protection District) H. The applicant shall address the requirements of the Department of Planning Services (landscape) referral as stated in their referral dated May 8, 2007. Written evidence of such shall be provided to the Department of Planning Services. (Department of Planning Services) J. A Landscape/Screening Plan shall be submitted to the Department of Planning Services for review. The vehicle parking and turnaround area shall be screened from adjacent properties and rights-of-way. Landscaping and screening shall be located outside of the right-of-way for County Road 3. (Department of Planning Services) K. The applicant has not indicated that there will be any lighting on site. If lighting is intended, a Lighting Plan, including cut sheets of the proposed light fixtures, shall be provided to the Department of Planning Services for review and approval. The lighting plan shall adhere to the lighting requirements for off-street parking spaces per Section 23-4-30.E of the Weld County Code and shall adhere to the lighting standards, in accordance with Section 23-3-360.F and Section 23-2-250.D of the Weld County Code. Furthermore, the approved Lighting Plan shall be delineated on the plat. (Department of Planning Services) • L. The Department of Planning Services has no evidence that proper building permits have been applied for the existing tanks and buildings adjacent to and enclosing the commercial water tap. Evidence that proper permits have been applied for shall be submitted to the Department of Planning Services. (Department of Planning Services) M. The applicant shall demonstrate that the existing building enclosing the commercial tap is located outside of the right-of-way for County Road 3. The building shall be relocated if located within the right-of-way for County Road 3. (Department of Planning Services) N. The applicant shall address the requirements of the Department of Public Works as stated in their referral received July 10, 2007. Written evidence of such shall be provided to the Department of Planning Services. (Department of Public Works) O. The applicant shall enter into an Improvements Agreement according to policy regarding collateral for improvements and post adequate collateral for all required improvements. Required improvements include: fencing and landscaping, access and circulation improvements. Ditch crossing/culvert improvements shall be included if required. The agreement and form of collateral shall be reviewed by County Staff and accepted by the Board of County Commissioners prior to recording the USR plat. The improvements agreement will not be needed if the necessary improvements are done to the satisfaction of the Department of Public Works and the Department of Planning Services. The applicant shall submit written evidence of an agreement with the users of the lateral ditch adjacent to the access road in regards to ditch crossings (if required)and providing adequate access to the ditch for maintenance or provide evidence of an adequate attempt to address their concerns. The applicant shall submit two (2) paper copies of the plat for preliminary approval to the Weld County Department of Planning Services. (Department of Planning Services) 2. Upon completion of 1. above the applicant shall submit a Mylar plat along with all other documentation required as Conditions of Approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services' Staff. The plat shall be prepared in accordance with the requirements of Section 23-2-260.D of the Weld County Code. The Mylar plat and additional requirements shall be submitted within thirty (30)days from the date of the Board of County Commissioners resolution. The applicant shall be responsible for paying the recording fee. (Department of Planning Services) 3. In accordance with Weld County Code Ordinance 2005-7 approved June 1, 2005, should the plat not be recorded within the required sixty (60) days from the date the Administrative Review was signed a $50.00 recording continuance charge may be added for each additional 3 month period. 4. The Department of Planning Services respectively requests the surveyor provide a digital copy of this Use by Special Review. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation); acceptable GIS formats are ArcView shapefiles, Arclnfo Coverages and Arclnfo Export files format type is .e00. The preferred format for Images is .tif(Group 4). (Group 6 is not acceptable). This digital file may be sent to maps(a�co.weld.co.us. (Department of Planning Services) • 5. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. (Department of Planning Services) 6. Prior to Operation: A. A stormwater discharge permit may be required for a development/redevelopment/construction site where a contiguous or non-contiguous land disturbance is greater than or equal to one acre in area. The applicant shall inquire with the Water Quality Control Division (WQCD)of the Colorado Department of Public Health and Environment at www.cdphe.state.co.us/wq/PermitsUnit if they are required to obtain a stormwater discharge permit. Alternately, the applicant can provide evidence from WQCD that they are not subject to these requirements. (Department of Planning Services) 2. Approval of this plan may create a vested property right pursuant to Section 23-8-10 of the Weld County Code. (Department of Planning Services) 3. The internal road system, including the access drive, shall be surfaced with recycled asphalt, asphalt, concrete, or the equivalent and shall be graded to prevent drainage problems. The surface shall be thick enough to accommodate loaded truck traffic. (Department of Public Works) 4. There shall be no staging or parking on State Highway 60 or WCR 3 at this location. Utilize on- site parking. (Department of Public Works) 5. The applicant shall apply dust suppressant throughout the circulation and parking areas if recycled asphalt is utilized. (Department of Public Works) 6. The applicant shall utilize all paved roads as possible to access the facility. Do not utilize gravel • roads for short cuts. (Department of Public Works) 7. Hours of operation (hauling hours) shall be limited from 7 AM to 5 PM, with the exception of emergency situations, including life and safety. (Department of Planning Services) 8. Water transport vehicle trips to the site shall be limited to a total of ten (10) trips/trucks per day. (Department of Planning Services) 9. Water usage totals involving the commercial tap shall be provided by the applicant to the Department of Planning Services on a monthly basis. (Department of Planning Services) 10. The historical flow patterns and run-off amounts shall be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. (Department of Public Works) 11. The applicant must take into consideration storm water capture/quantity and provide accordingly for best management practices. (Department of Public Works) 12. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30- 20-100.5, C.R.S.) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. (Department of Public Health and Environment) 13. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. The facility shall be operated in accordance with the approved dust abatement plan at all times. (Department of Public Health and Environment) 16. The facility shall adhere to the maximum permissible noise levels allowed in the Residential Zone District as delineated in 25-12-103, C.R.S. (Department of Public Health and Environment) 17. Bottled water shall be utilized for drinking and hand washing. (Department of Public Health and Environment) 18. If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. (Department of Public Health and Environment) 19. The applicant shall operate in accordance with the approved "waste handling plan". (Department of Public Health and Environment) 20. Sources of light, including light from high-temperature processes such as combustion or welding, shall be shielded so that light rays will not shine directly onto adjacent properties where such would cause a nuisance or interfere with the use on the adjacent properties; and Neither direct nor reflected light from any light source may create a traffic hazard to operators of • motor vehicles on public or private streets and no colored lights may be used which may be confused with or construed as traffic control devices. 21. A building permit shall be obtained prior to the construction of any new building, addition or remodel of existing buildings. (Department of Building Inspection) 22. Building height shall be measured in accordance with the 2006 International Building Code for the purpose of determining compliance with the Bulk Requirements from Chapter 23 of the Weld County Code. Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset and setback requirements. Offset and setback requirements are measured to the farthest projection. (Department of Building Inspection) 23. A building permit shall be obtained prior to the construction or placement of additional oil and gas equipment on the site. (Department of Building Inspection) 24. A letter of approval from the Berthoud Fire Protection District shall be provided prior to any new construction or placement of new equipment. (Department of Building Inspection) 25. Effective January 1, 2003, Building Permits issued on the proposed lots will be required to adhere to the fee structure of the Weld County Road Impact Program. The property owner or operator shall be responsible for complying with the Operation Standards of Section 23-2-250,Weld County Code. 29. The operation shall comply with all applicable rules and regulations of the State and Federal agencies and the Weld County Code. 30. Personnel from the Weld County Government shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County regulations. 31. The Special Review area shall be limited to the plans shown hereon and governed by the foregoing standards and all applicable Weld County regulations. Substantial changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 32. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. I have scheduled a meeting with the Weld County Planning Commission for July 17, 2007, at 1:30 p.m. This meeting will take place in the Hearing Room, Weld County Planning Department, 4209 CR 24.5, Longmont, Colorado.
