THIS ACCESS AND UTILITY EASEMENT AGREEMENT ("Agreement") is
made and entered into as of 9 1 2008 by and among:
Eric Grapengeter and Gina Grapengeter(collectively"Grantors")

(collectively "Grantees").
Recitals:
• A. Grantors are the owners of the real property more particularly depicted and described
on Exhibit A attached hereto and incorporated herein, as Lots A and B of Recorded
Exemption (RE) 4435 shown on Sheet 2 of 2 of Exhibit A.
B. Grantees are the owners of certain real property more particularly depicted and
described on Exhibit A attached hereto and incorporated herein, as proposed Lots A,
B, and C of RE-4660 shown on Sheet 2 of 2 of Exhibit A ("Grantees' Property").
C. Grantees desire an easement for access to and egress from the Grantees' Property,
including uses associated with the Cambodian Cultural Center activities as described
in USR-1627 for proposed Lot A, RE-4660, and a utility easement for the Grantees'
Property.
Agreement:
NOW THEREFORE, in consideration of$1.00 and other good and valuable
consideration, the receipt and adequacy of which are hereby acknowledged, it is agreed: •
1. Grantors hereby grant to Grantees an easement more particularly described on Sheet 1
of 2 ("Easement Property") and depicted on Sheet 2 of 2 of Exhibit A attached hereto
and incorporated herein, for purposes of access to and egress from Grantees'
Property, including uses associated with the Cambodian Cultural Center activities as

• described in USR-1627 for proposed Lot A, RE-4660, and a utility easement for the
Grantees' Property.
2. Grantees shall use the Easement Property rights granted above with due regard to the
rights of others and others' use thereof, and shall not use the Easement Property in
any way that will impair the rights of others to use, and shall not obstruct passage
thereon.
3. The Grantees shall contribute equally with the other property owners using the
Easement Property to the cost of any material and labor used in the repair and
maintenance of the Easement Property. However, any specific damage caused by a
particular property owner or its invitees that results in the need for specific repairs,
shall be the responsibility of that property owner, who shall pay for the necessary
repairs.
4. The repairs and maintenance to be under taken and performed under this Agreement
shall include the following and only the following: the filling of chuckholes, the
grading of the road, the leveling of the road, and maintaining the road in its present
condition. Any additional repairs or maintenance deemed necessary or advisable, but
not included within the maintenance and repairs specified above, shall not be
undertaken under this Agreement except with the express written consent of each of
the parties and an assumption by each in writing of their proportionate share of
financial liability for the costs of such additional repairs or maintenance.
• 5. The easement described herein is to and shall run with the land, and shall be for the
benefit and use of the Grantees and their respective heirs, devisees, successors-in-
interest, and assigns.
6. This Agreement may he executed in one or more counterparts, each of which shall
constitute an original and all of which shall constitute one and the same document.
IN WITNESS WHEREOF the parties hereto have executed this Agreement.

This is in regards to the hearing tomorrow for Special Use Permit #1627. I am inquiring
if my original letter to the Planning Commission is still in the file. Also I was made
aware of the hearing date by a neighbor who received a letter on it. Isn't this supposed
to be posted on a visible sign to the public? There is no sign posted stating intent or
hearing date.

Subject: Evaluation of Existing Individual Sewage Disposal System (I.S.D.S.)

Dear Mr. Preap:
This is an addendum to our septic system evaluation letter dated September 19, 2007. We have
been informed that there will 2 large events each year at the Cambodian Cultural Center. Our
original evaluation had stated that there was only 1 large event per year. Approximately 200
• people will attend each of these large events, which will be picnic/potluck style and be held
outdoors in a tent. Portable toilets will be provided for these large events.
Our calculations indicate that a 1,500 gallon tank and a 2,433 ft2 trench absorption field are
required for the intended use. It is our opinion that the existing septic system consisting of a
1,500 gallon septic tank and an approximate 4,000 ft2 trench leach field is adequate for the
intended use.
We appreciate providing engineering services for you. The Weld County Health Department
retains the final approval authority for all I.S.D.S. evaluations. Any questions or comments
pertaining to our work should be directed to Laube Engineering, LLC.
