Hannah,
The final stormwater pond was lined last week. We should have the QA/QC report in a
week or two. Spillways should be completed in the same two week time period. We can
then submit our CAFO application to Trevor and the State to finalize GW criteria and then
COA's. I would like to get the plat recorded before the end of April.
I will check the COA's,but are there any other outstanding items on your list other than
the Health Dept. ?

Hi Tom,
The only remaining issue on this USR is getting sign off from the Health Department that all
of their criteria have been met. At that point I will need a mylar and the recording fee.
According to Dusty,the DeHaans were in the process of completing their impoundments but
were waiting for some warmer weather to install the liners and that was what was holding
them up. He had indicated that all would be complete around the beginning of April which
is why I am checking in. I am sure Trevor Jiricek at the Health Department can go over what
remains outstanding.
If you could provide some estimation of when you think the remaining Conditions of
Approval will be complete I would appreciate it.

We have rec'd a copy of AgPros January 29, 2008, letter concerning the Great Western Dairy. We have also
rec'd AgPros February 7, 2008, memorandum that more fully explains their request in the January letter. We
have no issue with the issuance of a TCO to allow for limited herd development and milk production. Even
though the infrastructure isn't all currently constructed to meet the State Regulations, it appears adequate controls
are in place to prevent surface discharges and protect public health in the short-term. We suggest a definitive
time line be established for the recording of the plat to ensure that all infrastructure is installed and functional prior
to full-scale operations. Please let me know if you have any questions.

I figured it a couple of ways. They average area that you are requesting to have an improved surface is 55,000
Sq.Ft. instead of the 45,000 that was proposed. If we continue with the same cost per Sq.Ft. then the new cost
would be $32,450.
This would bring the total cost of the improvements agreement to$51,000.

This letter is to verify that the DeHaan Family is working diligently to complete the
necessary requirement of USR 1583. The timing of start up of a new dairy is a delicate process.
Once the dairy cattle have been bred,there are very few variables that could change when these
cows will be ready for production. Once the dairy cows are have calved,they have to be milked.
Attached with this letter are two copies of the revised plat. Please review them at your
earliest convenience. Once your review is complete,please notify us so that we may be able to get
the fmal Mylar signed and delivered to your office, along with the appropriate fees.
Attached is a copy of the nearly complete CAFO application. The application could be
mailed in at this time,but can not be certified until all construction is complete and certified by a
Registered Professional Engineer. Specifically,the southern pond still needs to be lined and the
emergency spillway needs to be completed. This construction will take place in the next few months
as weather permits. If the liner is not installed properly during good weather, it may compromise the
longevity of the liner. To ensure proper containment,the liner will need to be placed during the
installation of the emergency spillway. This construction is estimated to begin during March and to
be complete no later than the end of April,weather permitting.
Also accompanying this letter will be the draft of the Improvements agreement that has been
prepared by the DeHaan's attorney. This will need to be reviewed by the Department of Planning
Services and the County Attorney. Once their review has been completed, a signed copy(with
corrections, if needed)will be submitted,along with the irrevocable letter of credit,to the Board of
County of Commissioner's for their approval.
With that being said,we respectfully request a temporary certificate of occupancy be issued
for the milking parlor. We make this request knowing that the plat can not be recorded at this time.
Also knowing that upon receipt of this letter the Department of Planning Services should have all of
the necessary documents for final review before recording of the plat for USR 1583.
Once your review is complete,please respond with your comments and/or corrections as
soon as you are able. We would like to complete this project quickly. Please feel free to contact me

The facility will identify the top of the lagoon liner by surveying or measuring the depth of the lagoon.
The survey or measurements will include the depth of the pond and the slope of the lagoon
embankment. The operator can measure the depth of the manure layer using the information included
in the survey or site map by measuring the depth of the pond to the top of the manure layer. A copy of
the survey or a site map will be kept with the SOP.
If the facility chooses pumping as an option for manure removal,the pipe inlet will be placed at a
minimum of six inches above the pond liner. Information from the site map or survey will provide the
operator with the pond depth and the operator can then measure the length of the pipe and place the
inlet appropriately.
A staff gauge will be installed in most lagoons that will indicate the top of the lagoon liner. Lagoon
gauges will be labeled on the site map and will assist the operator as to where the lagoon liner begins.
If the facility decides to revise the SOP, an amended SOP will be submitted to the Division for
approval 30 days prior to the structure being cleaned by the revised method. The revised SOP will
indicate how the pond will be cleaned in a manner that protects the liner. The structure will not be
cleaned by the revised method until there is written approval from the Division of the amendment to
the SOP.
After cleaning each pond the operator will conduct a visual inspection, certify that this approved SOP
was followed and notify the Division within 30 days of the removal event if this SOP is not followed.

The operator will clean the concrete separator periodically and inspect the visible portions at that time.
The loader will operate on the concrete surface and no method other than feel will be necessary to
locate the top of the liner.

This application is for use after June 30,2004 by an operator of any new,or existing and currently operating Concentrated Animal Feeding
Operation(CAFO),except those that: 1)are a"Housed Commercial Swine Feeding Operation",as that term is defined at 25-8-501(2)(b),
Colorado Revised Statutes;or 2)the discharge is to waters of the state for which there is an applicable control regulation that limits the
quantity or concentration of total phosphorus or total nitrogen in discharges.
WATER RIGHTS
The State Engineer's Office(SEO)has indicated that capture and retention of precipitation and storm water has the potential for material
injury to a water right. As a result,the SEO needs to determine that material injury to a water right will not occur from such activities.

It is important to understand that any Colorado Discharge Permit System(CDPS)permit issued by the Division does not constitute a water
right. Issuance of a CDPS permit does not negate the need to also have the necessary water rights in place. It also is important to
understand that even if the operation has an existing CDPS permit,this is no guarantee that the proper water rights are in place.
STORMWATER GENERAL PERMIT
Please note that a certification under a Stormwater General permit is required from the Division if construction of your facility,or parts
thereof,disturbs one or more acres in total land area. Information about such a certification can be obtained by calling(303)692-3517.
REGULATION NO.81-GROUNDWATER PROTECTION REQUIREMENTS
As a reminder,CAFOs must provide for groundwater protection per Colorado Water Quality Control Commission Regulation No.81 (Reg.
81). These requirements are not included in a CAFO permit and must be complied with by CAFO operators separately from their permit.
Reg.81 requires operators to have available documentation prepared by a Professional Engineer(P.E.)registered in the State of Colorado
certifying that the provisions of section 81.5(2)have been met and stating what constitutes each constructed liner. For impoundments
constructed prior to June 30,2004,such documentation shall be available no later than April 13,2006. For any impoundment constructed by
an operator on or after June 30,2004,such documentation shall be available at least 30 days prior to wastewater entering the impoundment.
Refer to Reg.81 for additional requirements,such as submitting to the Division,a Standard Operating Procedure for manure removal from
impoundments

Standard Operating Procedure
For
Precipitation Measuring and Recording
The Colorado Department of Health& Environment General Permit for CAFOs requires
that each permitted facility to implement a standard operating procedure per Subsection
61.17(5),Proposed Subsection(c) (xi) for measuring and recording precipitation at the
permitted facility.
General
One precipitation gauge is located at the facility. It is installed where there will be no
obstruction of precipitation reaching the gauge. The gauge is constructed and calibrated
to measure precipitation to 0.1 inch and has a capacity of at least 5.0 inches. The gauge
will be located near the office.
Inspection
Each rain gauge will be inspected on a routine basis (monthly)to ensure: 1)it is securely
mounted and in proper working order, i.e.,no cracks or breaks; 2)there is nothing
obstructing the opening that would prevent precipitation from entering the gauge; and, 3)
that any foreign material inside the gauge is removed. The inspection will be documented
on the Facility Inspection checklist. Each time a precipitation measurement is taken each
rain gauge will be observed for cracks,breaks or anything else that would prevent an
accurate measurement.
Measuring and Recording
When a precipitation event begins an authorized person will record the date and time.
Each gauge shall be read at the end of each precipitation event or at least every 24 hours
during long precipitation events. Each time a measurement is taken,the following
information is recorded:
1. Date
2. Beginning and ending times of precipitation event(or amounts every 24 hours
during long precipitation events)
3. Amount of precipitation to the nearest 0.1 inch, including snow.
After the measurement is taken and information is recorded, the precipitation will be
poured out of the gauge and placed back in its mount.
Recordkeeping Requirements
All precipitation measurements will be recorded on the precipitation log in the facilities'
record keeping book. This information is to remain on-site for 5 years and be available
for inspection and copying by the Director of Colorado Department of Health&
Environment and/or authorized representatives.

Attached is a proposed Improvements Agreement regarding completion of the remaining
improvements for the DeHaan Great Western Dairy which is the subject of USR #1583. Please
review this draft,and notify me of any comments or requested revisions. Upon your approval of the
form,we will provide you with an executed Improvements Agreement together with the necessary
letter of credit for presentation to the Board of County Commissioners. I would appreciate your
providing me with any particular language or form that you require for the letter of credit.
The original applicant for this USR was Margaret J.DeHaan. Since the application was filed,
for business and estate planning reasons the property was transferred by Mrs. DeHaan to L&M
Farms,LLC,a Colorado limited liability company which is solely owned and controlled by Margaret
J. DeHaan and her husband Larry D. DeHaan. The Improvements Agreement will be executed by

I am sure a building application for the modular will be forthcoming I am not too concerned at this
point about that portion of the project.
In regards to the request for a TCO:
I took the question to our staff meeting this morning. Staff has determined that a C.O. (temporary
or otherwise)will not be issued by this department until the USR requirements have been
completed and a plat recorded. The applicant was granted extra time to complete the requirements
and this time has expired;additionally there has been no progress toward the completion of the
requirements in quite some time.
I will be out of the office for the remainder of the day but please feel free to contact me on Monday
if you would like to discuss this further.

In regards to the mobile home, the septic system has been designed and we are awaiting the final approval from
the engineer. I should have that today or tomorrow. Once we have the septic design, we can apply for the
septic permit, which is a requirement of the building permit.

I have been informed that Great Western has called for inspections so they may get a TCO. I have
not approved this and will not be able to comment on it until I have had a chance to review the
status of the USR as per our conversation yesterday.
Additionally, a modular home is in the process of being located on the property without any
permits of any kind. This structure needs a building permit a red tag was issued in regards to this
project.
