HomeMy WebLinkAbout20080839.tiff RESOLUTION RE: APPROVE MEMORANDUM OF UNDERSTANDING FOR SPECIAL EDUCATION SERVICES FOR REGIONAL HEAD START AND MIGRANT/SEASONAL HEAD START PROGRAMS AND AUTHORIZE CHAIR TO SIGN - SAINT VRAIN VALLEY SCHOOL DISTRICT WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Memorandum of Understanding for Special Education Services for the Regional Head Start and Migrant/Seasonal Head Start Programs between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, Family Educational Network of Weld County, and the Saint Vrain Valley School District, commencing April 1, 2008, and ending March 31, 2009, with further terms and conditions being as stated in said memorandum, and WHEREAS, after review, the Board deems it advisable to approve said memorandum, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Memorandum of Understanding for Special Education Services for the Regional Head Start and Migrant/Seasonal Head Start Programs between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, Family Educational Network of Weld County, and the Saint Vrain Valley School District be, and hereby is, approved. The purpose of this Memorandum of Understanding is to establish collaboration and working procedures between the LEA and FENWC in the provision of services to Regional Head Start and Migrant and Seasonal Head Start children eligible for special education services for the 2006-2007 school year in compliance with IDEA (IDEIA 2003) (34 C.R. F. Part 300), Colorado Rules for the Administration of the Exceptional Children's Education Act, and the Head Start Program Performance Standards on Services for Children with Disabilities (45 C.F. R. 1308). The term of this Agreement shall commence on April 1, 2008 through March 31, 2009. If you have any questions please contact Janet Flaugher, Director, @ 353-3800, ext. 3340. 2008-0839 MEMORANDUM OF UNDERSTANDING BETWEEN SAINT VRAIN VALLEY SCHOOL DISTRICT AND FENWC REGIONAL HEAD START AND MIGRANT AND SEASONAL HEAD START PROGRAMS (2008) This Agreement is between St. Vrain Valley School District (hereinafter referred to as LEA) and the Family Educational Network of Weld County Regional Head Start and Migrant Seasonal Head Start(hereinafter referred to as FENWC), for the period from April 1, 2008 to March 31, 2009. I. PURPOSE STATEMENT The purpose of this Agreement is to establish collaboration and working procedures between the LEA and FENWC in the provision of services to Regional Head Start and Migrant and Seasonal Head Start children eligible for special education services in compliance with IDEA (IDEIA 2005) (34 C.R.F. Part 300), Colorado Rules for the Administration of the Exceptional Children's Education Act,and the Head Start Program Performance Standards on Services for Children with Disabilities(45 C.F.R. 1308). The intent of the Agreement is to: 1. Define which services will be provided by each Agency. 2. Ensure that children eligible for special education services receive free and appropriate public education,as required by law, in the least restrictive environment. 3. Ensure that each Agency cooperatively maintains communication and shares leadership responsibilities at the local level to ensure that available resources are utilized in the most effective manner. 4. Ensure that cooperative arrangements between the LEA and FENWC are developed, implemented,and persevered. II. RESPONSIBILITIES OF FENWC 1. Recruit, enroll,and serve eligible Regional Head Start children ages 3 —5 and Migrant and Seasonal Head Start children ages 6 weeks through 5 years. No less than 10 percent of the total number of enrollment opportunities in the FENWC Head Start Programs shall be available for children with disabilities and/or significant developmental delays who are eligible to participate. 2. Screen all children within 45 days for Regional Head Start and within two weeks for Migrant and Seasonal Head Start of enrollment for potential health problems and/or developmental delays. FENWC will invite LEA staff to participate in screenings. FENWC will participate in Child Find Activities under Part B, of IDEIA, including but not limited to,participation in staffing/IEP development meetings, annual reviews and transition planning. 3. Refer children to St. Vrain Valley School District Child Find Coordinator to obtain appropriate determination of eligibility for children with disabilities and/or significant developmental delays. 4. Coordinate the development of the IFSP/IEP for children identified with a disability and/or significant developmental delay based on evaluation information. The IFSP/IEP interdisciplinary team that includes FENWC interdisciplinary staff, LEA interdisciplinary staff and the parents/guardians of the child will complete IFSP/IEP development. IFSP/IEP meetings will be held at a location and time convenient for all the interdisciplinary team members. Copies of the IEP will be made available to LEA, FENWC and the parents in English and the preferred language of the family. 5. Basrd on the IFSP/IEP interdisciplinary team determination, children will be placed in the least restrictive environment. 6. Seek out additional resources in the community for children with disabilities and/or significant developmental delays as needed. 7. Work collaboratively with LEA to develop cooperative staff training opportunities to increase knowledge and ability to provide quality services to children with disabilities and/or significant developmental delays. III. RESPONSIBILITIES OF LEA 1. Locate, identify and evaluate children with suspected disabilities or significant developmental delays within the LEA's jurisdiction that may be eligible for early intervention/special education and related services, including highly mobile children, private school children and homeless children. 2. Refer identified Regional Head Start eligible children and Migrant/Seasonal Head Start- eligible children to FENWC for possible services. 3. Provide comprehensive evaluations of children with suspected disabilities or significant developmental delays by appropriate personnel using appropriate instruments, and provide comprehensive evaluations on children who may require special evaluations. 4. Coordinate the development of the IEP/IFSP for children with disabilities and/or significant developmental delays based on evaluation information. . The IFSP/IEP interdisciplinary team that includes FENWC interdisciplinary staff, LEA interdisciplinary staff and the parents/guardians of the child will complete IFSP/IEP development. IFSP/IEP meetings will be held at a location and time convenient for all the interdisciplinary team members. Copies of the IEP will be made available to LEA, FENWC and the parents in English and the preferred language of the family. 5. Provide special education services to identified FENWC children and families according to the IFSP/IEP as determined by the IFSP/IEP interdisciplinary team. 6. Place pre-school children with disabilities and/or developmental delays based upon the IEP process and FENWC eligibility criteria. 7. Provision of the above outlined services at the designated costs represents an in kind contribution of$0.00 to the FENWC program in the services and amounts. 8. Work collaboratively with FENWC to implement specially designed instruction based upon the IFSP/IEP goals and objectives to meet the unique needs of a child with a disability and or developmental delay(content,methodology and/or delivery of instruction). IV. SPECIFIC PROGRAM SERVICE DELIVERY 1. St. Vrain Valley School District is required to provide Special Education and related services designated in the child's IEP. 2. The FENWC program is required to seek out related services in the community for children with disabilities and/or significant developmental delays. V. TRAINING AND TECHNICAL ASSISTANCE 1. St. Vrain Valley School District and FENWC will collaborate to provide on-going training for staff to increase their knowledge and ability to provide quality services to children with disabilities and/or significant developmental delays. 2. St. Vrain Valley School District and FENWC may coordinate efforts by: a. Developing a system for staff needs assessment in the area of training. b. Coordinating training calendars. c. Training staff regarding the regulations and program philosophy of each agency. d. Inviting staff from each agency to share training activities. VI.COUNTING AND REPORTING 1. St.Vrain Valley School District and FENWC have systems for counting and reporting children with disabilities and/or significant developmental delays and/or developmental delays. a. Training staff regarding specific procedures and regulation for each agency. b. Clear communication of time lines and persons responsible for reporting. VII. TRANSITION PLANNING In an effort to provide for a smooth transition from the preschool setting to a public school setting the following will occur: 1. Prior to the child entering the public school setting,the pre-school staff and the child's elementary teacher will meet to share strategies. Transition plans will be developed jointly at an IEP meeting or Annual Review, and occur prior to the students' exit from FENWC to the K-12 school setting. 2. Information to parents regarding the differences in service delivery will be provided jointly during the Transition Staffmg of the child from FENWC to the public school setting. 3. Placement alternative for students will be generated by the needs of the students as indicated on their currant IEP and as presented and discussed jointly at the Transition Meeting, with neither FENWC nor school personnel predisposing parents to choices that have not been jointly discussed as possible alternatives. XI. CONFIDENTIALITY 1. Consent for Release of Information Forms that will assist FENWC and St.Vrain Valley School District in providing optimal services will be generated and signed as each child is identified in accordance with the Family Education Privacy Rights Act and the Health Insurance Portability and Accountability Act. XII MODIFICATION OF AGREEMENT 1. All modifications to this agreement shall be in writing and signed by both parties. XIII. ASSIGNMENTS 1. This Agreement shall be binding upon the parties hereto, their successors,theirs, and legal representatives.
