Chris: These conditions have been satisfied for Monta Vista Dairy-Garrett&Carla Devries Family Trust, USR-
1595, as follows:
Regarding Condition 1.C., Monta Vista Dairy has met the liner certification requirements. Proof of liner was
provided to the Colorado Dept. of Public Health & Environment(CDPHE)during a June 6, 2008 inspection.
The dairy also has an approved Standard Operating Procedure (approved by CDPHE May 29, 2008)for solids
removal from the lagoons, which protects the liner during cleaning.
Regarding Condition 1.G., Monta Vista Dairy has a CAFO Discharge Permit#COA-931060, issued August 8,
2008.

We are about ready to wrap this up and record the plat. In looking at my file(the last correspondence I found in
the file was 10/2/2007)—there were still two outstanding conditions:
Condition 1.C: Provide documentation, prepared by a Colorado Registered Professional Engineer, that all
wastewater impoundments for the confined animal feeding operation (CAFO) meet seepage rate
standards of Colorado Water Quality Control Commission Regulation 81 [81.5(2)]. Written evidence of
Department of Public Health and Environment approval shall be provided to the Department of Planning
Services.
Condition 1.G: The applicant shall provide evidence that a CAFO Colorado Discharge Permit has been
applied for or obtained from the Colorado Water Quality Control Division. Written evidence of Department
of Public Health and Environment approval shall be provided to the Department of Planning Services.

Chris,
We review the info submitted by AgPro under cover letter dated August 24, 2007 for the Monte Vista Dairy. The
letter indicates that the submittal satisfies Condition 1.C., 1.D., 1.F., and 1.G. Here is the status of each:
1.C. Have not addressed this condition. There was information submitted concerning liner installation, however
the information did not clearly indicate that all impoundments met required seepage rates and it was not prepared
by an engineer as required in the condition. It is our expectation that an engineer stamp the certification. I
understand that the CDPHE will also be sending them a letter requiring this info.
1.D. This condition has been addressed. The facility has submitted an SOP and it was approved by the CDPHE.
The facility did not submit evidence of approval, however I rec'd it from the CDPHE.
1.F. This condition has been addressed.
1.G. This condition has not been addressed. The facility submitted an incomplete application to the CDPHE.
Please see the attached letter. It is the expectation of our Department that the intent of this condition is that a
complete application be submitted for review.

I heard back from Public Works on the improvements agreement. They indicated as long as the parking and
transportation improvements are in place, they are O.K.with removing this condition. I will verify improvements
are in place, if they are I am O.K.with removing the improvements agreement condition.
Department of Health had the remaining requirements. I had sent your information to the Health Department a
couple weeks ago. I will send an e-mail to Trevor to see if they are O.K.with everything. If they are you will be
ready to submit the plat.

I did not make a packet for the health department. Please send the additional packet that I left with you
over to Trevor.
We will make the minor changes to the plat. The next time we bring it in it will be on Mylar and signed,
unless you need to see it in bond again.

The septic is being installed. I am not sure if it is completed. I don't believe that completing that permit
should hold up the recording of the plat.
Can you please apply some pressure to Bruce on the Improvements Agreement. We will be ready to
proceed once he makes his decision.
At this time he intends to use the area designated on the plat for composting.

or does he plan on scaling it back to the location shown on the plat?)— If we do not hear on this
then I have no choice but to bring this back before the B0CC to have them review the change.
• Have you received sign-off from the Health Department on the pond lining? Has the septic been
finaled?

Dear Mr. DeVries:
The Colorado Department of Public Health and Environment's Environmental Agriculture Program(Ag Program)
received on January 17, 2007, an application for Monte Vista Dairy, LLC(Monte Vista)to be certified under
General Permit COA-931000 (the permit)for Concentrated Animal Feeding Operations(CAFOs). On February
8, 2007,the Ag Program sent your identified consultant,AgProfessionals (AgPro),an email requesting additional
information to make Monte Vista's permit application complete.
On February 12, 2007,we received from AgPro some of the additional information requested. The February
2007, submittal also indicated that the dairy is still in the construction process [and did not yet meet all permit
conditions which is necessary before applying for certification under the permit] and that a copy of the entire
application along with a signed copy of Appendix A will be submitted in late spring before the dairy commences
operation. We have not received a complete permit application to date.
Therefore,the Ag Program requests that if Monte Vista still desires to seek permit coverage,please submit a
complete permit application once all general permit conditions are met.
For your information,the Ag Program is not able to issue any certifications under the CAFO general permit until
Colorado's Regulation No. 61 and the general permit are revised to reflect the Environmental Protection
Agency's new deadlines outlined in the Agency's July 24, 2007 rule. The Ag Program is currently working on
revising the regulation and anticipates being able to issue certifications again starting around January 1, 2008.
