WELD COUNTY COUNCIL
February 11, 2008

The Weld County Council met in regular session in full conformity with the We1d-County
Home Rule Charter, Monday, February 11, 2008, 6:30 p.m., at the Weld County
Centennial Center, 915 10th Street, Greeley, CO.
ROLL CALL: The meeting was called to order by President Ginny Buczek. Councilman
John Kivimaki, Councilman Gene Stille, Councilwoman Nancy Teksten and Councilman
Don Mueller were present, constituting a quorum of the members. Also present was
Commissioner Dave Long, Commissioner William Jerke, County Attorney Bruce Barker,
Judy Griego, and Karla Ford, council secretary.
REVIEW PROGRAM: Commissioner Jerke discussed information about the
Greeley/Weld Airport Authority. This is a legal authority and receives grants from FFA.
It is a good way to leverage FFA dollars. The airport is free and clear— no debt. There
are about 1100 acres with full mineral rights. Twenty oil wells will be drilled on this
property over the next year. There are seven employees and also a restaurant on-site.
The Federal government does have some presence at the airport—Air National Guard.
Commissioner Dave Long and Judy Griego gave a description of Social Service Audits.
The Department of Social Services is a sub-arm of the state administered by the county.
The rules/legislation is run by the State Department of Human Services.
Ms. Griego explained that as a county department and a recipient of federal funds, an
independent auditor comes in to verify that the department meets the standards that the
federal and state outline in a single audit.
The department also has a Management Evaluation for Food Stamps from the State
Department. The auditor will do surveys with outside agencies and review files to see if
they are compliant. The auditor will then give a report for corrective actions. The
county continues to struggle with the CBM system - people get a notice they qualify and
then get another notice they do not qualify. Weld County does not mail these notices.
The auditors look to see how the county deals with these issues; however some of the
issues are out of the control of the county.
A handout was given to council members that displayed what Weld does for additional
audits.
Fraud Detection - the county has fraud investigators and is trying to do more prevention
of fraud. The county does report identity theft to local law enforcement.
Child Welfare and Adult Protection Audits
Child Protection Team —this team reviews, by statute, child protection referrals and
investigations.
Adult Networking Committee —this committee reviews cases where an adult/elderly is in
need of adult protection services.

Child Welfare —this is the most reviewed area by the state. They review every case
where a child is in foster care. They review the administration and operation of child
welfare services.
Child Fatality Reviews —the state will do an investigation of any child fatality that
happens in Weld County when Social Services have prior involvement with the
family/child. There are two cases currently—those will be completed by the end of
February. The state will issue a report of all child fatalities in March 2008.
Federal Child and Family Services Review (CFSR) — The Federal Department reviews
the state's compliance of federal requirements in protective services. The State
Department reviews each county in meeting the federal standards.
Several other audits are conducted in specific areas:
Human Services Audits, Employment Services, Weld County Area Agency on Aging,
UNC Evaluation on behalf of the Interagency Oversight Group, Head Start Program
and Child Support. The handout outlines all the details for each area.
Council President Buczek asked for the definitions/difference between Social Services
and Human Services. Ms. Griego stated the Social Services' programs are outlined by
the statute and the county is mandated to serve people. Social Services use the
federal, state and county funds that are available.
Human Services is federally operated, they have Federal Head Start Program, Federal
State Employment Services Program and Older American's Act. The programs are
grant driven. These grants serve a certain number of people and that is it. People
choose to utilize these services.
Ms. Griego explained the reasoning of the county putting Human Services and Social
Services together. The county wants to see how fiscally the two groups can work
together. One assessment of each family—try to eliminate duplication. Blend case
managers to help the individual instead of several different people trying to help the
individual. The savings to the county will be about $380,000 when these two groups
merge together.
Councilman Stille asked what the new name of the department will be. Ms. Griego said
the name has not been determined yet.
Councilwoman Teksten asked if the form for food stamps is the same in Weld County
as Larimer County. Ms. Griego did state the form should be the same and did discuss
food stamps and food baskets available to residents.

Councilman Kivimaki made a motion to approve the January 21, 2008 and February 6,
2008 council minutes. The motion was seconded by Councilman Stille and carried.

NEW BUSINESS:
Clarify Terms for Weld County Council
Bruce Barker, Weld County Attorney, disbursed a handout regarding previous
resolutions regarding John Kivimaki and Nancy Teksten's terms —their appointments to
the council were for the first two years of the term and ending at the end of election
2008. This is due to the state statute stating that any appointment is to date of general
election and '/2 of term.
Mr. Barker's legal conclusion was that Councilman Kivimaki and Councilwoman Teksten
would continue their appointment until general election 2008 and would then need to
stand on election. However, any future appointments will be for remainder of term due
to the Home Rule Charter changes in the 2007 election.
All five council positions will have to be on the general election 2008 ballot and
Councilman Kivimaki and Councilwoman Teksten's positions will be for a 2-year term.
This way the staggering of the members will be back in sync.
Same Party Registration for Vacancies Issue — Home Rule Charter
Councilman Stille requested Mr. Barker to review Home Rule Charter sections 13-15
and 13-8 —specifically the timing as to the date of the political party registration. Is it
the date of the election or a different date —was the question. There was a suggestion
to state to the Board of County Commissioners a change in the Home Rule Charter for
the November election. Mr. Barker agreed with this.
Petitions for County Council — Home Rule Charter
There was a change two years ago in 13-9 from 125th day to the 75th day—which would
give plenty of time prior to September 10-12th date to have information for the ballot.
However, the change had not been changed to paragraph 6, 8, or 9 to make them
consistent. Mr. Barker suggested to have the changes made to paragraph 6 —should
be 75th day and the paragraph 8 — should be 65th day and paragraph 9— should be 60th
day.
Councilman Stille made a motion to have Bruce Barker and Karla Ford work on a draft
resolution to correct petition deadlines and same party registration information in the
Home Rule Charter that will go to the Board of County Commissioners. Councilman
Kivimaki seconded the motion and it passed
Request by Powertech to Provide Presentation to Council
President Buczek asked Bruce Barker for his recommendation on having Powertech
present to the Council. Mr. Barker stated there is nothing that prohibits the council from
having the presentation. He gave a word of caution that if one side presents to council,
they need to be open to have the opposition group come and present to the council.
After discussion, the council decided to decline Powertech's request to present at this
time.

Home Rule Charter— Department Audits
Councilman Stille said the Home Rule Charter states the Weld County Council is to
conduct department audits. He would like to be proactive with the audits instead of
reactive. Councilman Kivimaki requested to discuss this at next meeting. Councilman
Mueller requested the council do some research on this topic. Councilman Kivimaki
suggested one department audit per year.
Council Newspaper Subscriptions
Councilman Kivimaki recused himself from the discussion. Councilwoman Teksten
made a motion to continue with current newspaper subscriptions. The motion was
seconded by Councilman Mueller and it passed.
Meetings/Invitations
The council was reminded of the upcoming meetings/invitations:
2/15— Linda Rohn's Retirement, 2/23 — Promises for Children Lunch, 2/28 — Longmont
Chamber Meeting and 2/29 — Elected Officials Annual Leadership Meeting.
Payment of the Bills
Councilman Kivimaki made a motion the bills to be paid as listed:
Mileage for Council President Ginny Buczek $ 62.08
Mileage for Council Vice President John Kivimaki $116.40
Mileage for Councilman Gene Stille $ 36.86
Office Max—Office Supplies $ 20.96
The motion was seconded by Councilman Stille and carried.
