RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST MELINDA SHORT FOR VIOLATION OF THE WELD COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Melinda Short, ZCV #0800116, is allegedly in violation of the Weld County
Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 18th day of November, 2008, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,and
WHEREAS, Melinda Short, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until March 18, 2009,to allow adequate time for the property owner to restore, remove
or screen the noncommercial junkyard from all adjacent properties and public rights-of-way to bring
the subject property into compliance and for an inspection of the property by the Department of
Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV#0800116 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Melinda Short to remedy the violation of the Weld County Code, and
any other persons occupying the properties,any persons claiming an interest in the properties,and
any persons acting in active concert with the identified parties,with an instruction for delay of action
upon such referral until March 18, 2009, to allow adequate time for the property owner to restore,
remove or screen the noncommercial junkyard from all adjacent properties and public rights-of-way
to bring the subject property into compliance.

REMEDY
As we discussed over the phone, the NONCOMMERCIAL JUNKYARD consisting of DERELICT
VEHICLES and miscellaneous debris shall be restored, removed or completely SCREENED from all
adjacent properties and public rights-of-ways. Any household trash shall be completely removed from
the property, as the Weld County Code does not make any exceptions for household trash.
Lastly, as we discussed, if the property is in compliance prior to the above scheduled hearing date, this
violation will be closed and the hearing cancelled. If not, you will need to attend the hearing and
request additional time from the Board of County Commissioners. Please call me if the property is
brought into compliance prior to the above hearing date.
RECOMMENDATION
The Department of Planning Services recommends that this case be referred to the County Attorney's
Office for immediate legal action.

05/02/2008 Property Inspected Upon a visual inspection of the property, the following
items were noted: Derelict Vehicles and miscellaneous
debris. I also noted apparent household trash. No
pictures were taken during this inspection.
06/27/2008 Phone Call Kim Short(720-891-8690) left a message indicating that
he and his wife received my letter. He stated that he is
currently undergoing chemotherapy. He also said that
he and his wife were estranged, but have recently
reconciled. He stated that as a result, the property did
fall into disrepair. He said he needed to talk to me to
figure out exactly what I needed them to do and how
much time I could give them.
06/30/2008 Phone Call I called Kim Short back. I explained exactly what the
violation was in regards too. I asked what he was
looking at as far as a time line. He said if I gave him a
month, he would make tremendous progress. He wrote
down all of my information and said he would work really
hard on getting it done.
08/11/2008 Property Inspected Upon a visual inspection of the property, the following
items were noted: **Substantial Progress" still have
some derelict vehicles, shingles and miscellaneous
debris. No pictures were taken during this inspection.
09/11/2008 Phone Call Kim Short called back. He said he is trying to get the
property into compliance. He said he recently moved
back home (due to some marital dificulties). He said he
is now working on cleaning it as his health and time
allows. He said he is currently on Chemo Therapy,
which ties up like 2 weeks of his time (feeling ucky), then
he"s able to start cleaning again. I asked how long
before he thought he"d be done. He said within a month.
I explained that I would schedule the hearing out until
November. If they finished before the hearing, the
hearing would be cancelled. If it wasn"t finished yet, he
would need to request additional time from the BOCC.
He said that would work.

for immediate legal action.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however, we have no discretion in this matter if you fail to correct this violation. You have until
09/15/2008, to correct this zoning violation. Failure to do so will result in this office scheduling the
violation before the Board of County Commissioners to consider whether to refer the violation to the
County Attorney's Office for legal action.

able to work on the property but the progress is slow due to my husband's health condition and I have a limited

Lastly, as we discussed, if this does not grant enough time to finish bringing the property
into compliance, you MUST call prior to August 8, 2008; otherwise, this case will be
scheduled for a Violation Hearing before the Board of County Commissioners. Once a case
has been scheduled, I do not remove it from the docket.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however, we have no discretion in this matter if you fail to correct this violation. You have until
08/08/2008, to correct this zoning violation. Failure to do so will result in this office scheduling the

COLORADO
While a NONCOMMERCIAL JUNKYARD consisting of DERELICT VEHICLES and
miscellaneous debris is an allowed use in the Agricultural zone district, such as Aristocrat
Ranchettes, it must be completely SCREENED from all adjacent properties and public
rights-of-ways; otherwise, it shall be restored or removed from the property. Any trash shall
be removed from the property, the Weld County Code does not make allowances for the
presence of trash.
DERELICT VEHICLE: A vehicle that is inoperable (unable to move under its own power); is
partially or totally dismantled; has all or portions of its body work missing or is substantially
damaged; does not have valid registration with the State, as required by Section 42-3-103,
42-3-138 or 42-12-102, C.R.S., and/or the number plate assigned to it is not permanently
attached to the vehicle, as required by Section 42-3-123, C.R.S.; or is lacking proper
equipment to the extent that it would be unsafe or illegal to USE on public road
rights-of-way or otherwise not equipped with lamps and other equipment, as required in
Sections 42-4-202 to 42-2-227, C.R.S. This definition shall not include implements of
husbandry, farm tractors or vehicles customarily operated in a FARMING operation.
JUNK: Scrap brass, iron, lead, tin, zinc; all other scrap metals and alloys; bones; rags;
used cloth, rope, rubber, tinfoil, bottles, old or used machinery of any type; used tools;
used appliances; used lumber or crates; building materials; fabrication of any material;
used pipe or pipe fittings; used conduit or conduit fittings; used automobile parts;
DERELICT VEHICLES; used tires and other manufactured goods that are so worn,
deteriorated or obsolete as to make them unusable in their existing condition.
NONCOMMERCIAL JUNKYARD: An area where any waste, junk or used or secondhand
materials are stored or handled, including but not limited to scrap iron and other metals,
paper, rags, rubber tires, building materials and bottles. A NONCOMMERCIAL JUNKYARD
may also include the storage or keeping of DERELICT VEHICLES registered last or
currently registered under the property owner and/or tenant's name.
This definition does not include COMMERCIAL VEHICLES. If the Zone district allows, the
NONCOMMERCIAL JUNKYARD shall be totally ENCLOSED within a BUILDING or
STRUCTURE or visually SCREENED from all ADJACENT properties and public
rights-of-way.
SCREENED: Construction and maintenance of fences, earth berms or the USE of
LANDSCAPING materials or other materials USED with the approval of the Department of
Planning Services to lessen the noise, light, heat or visual impacts of a USE on surrounding
uses. A SCREENING PLAN shall be submitted and approved by the Department of
Planning Services.
