FOR HEAVY EQUIPMENT ROAD MAINTENANCE PROJECT AND AUTHORIZE CHAIR
TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,the Board has been presented with an Energy and Mineral Impact Assistance
Program Application for the Heavy Equipment Road Maintenance Project from the County of Weld,
State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf
of the Department of Administrative Services, to the Colorado Department of Local Affairs,
commencing upon full execution, with further terms and conditions being as stated in said
application, and
WHEREAS, after review, the Board deems it advisable to approve said application, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Energy and Mineral Impact Assistance Program Application for the
Heavy Equipment Road Maintenance Project from the County of Weld, State of Colorado, by and
through the Board of County Commissioners of Weld County, on behalf of the Department of
Administrative Services, to the Colorado Department of Local Affairs be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to
sign said application.

This request for$1,000,000.00 is for the purchase of major road equipment to be used to repair roadway
damage caused by oil and gas traffic. The equipment is for the Weld County Public Works Department to
maintain existing roadways. Weld County has 674 paved miles, and 2,388 gravel miles for a total of 3,062
maintained miles of roadways. With over 21,000 oil and gas wells to be serviced, and with new drilling or
reworking of over 1,000 wells annually, the direct major impact of the oil and gas industry on Weld County is
ongoing damage and wear on county roads. With the bulk of the drilling taking place in the months between
October and April, due to irrigation, the roads are heavily damaged by energy industry's truck traffic in the wet
winter months. These repairs require road maintenance involving motor graders, equipment to repair the roads,
such as water trucks, compactors, road reclaimers, and trucks to haul in aggregate product, and maintain and
repair the roads.

D. PROJECT INFORMATION
The statutory purpose of the Energy and Mineral Impact Assistance program is to provide financial assistance to
"political subdivisions socially or economically impacted by the development, processing or energy conversion of
minerals and mineral fuels."
1. Social and Economic Impact
a. Describe how the applicant is impacted by the development, production, or conversion of energy and mineral
resources
Weld County has over 20,366 oil and gas wells dispersed throughout the county with over 15,000 of these being
active wells. According to DPT, this represents over fifty (50) percent of all active wells in Colorado. Tangible
impacts created by this production are seen in increases in roadway utilization and intensity of use. Affects to
roadways are clearly evident and perhaps the most tangible impacts to view.
b. To further document impact, cite the type of past, current or proposed energy/mineral impact activities in the
area, the names of the companies involved, the number of employees associated with the activities impacting the
jurisdiction and other relevant, quantitative indicators of energy/mineral impact.
The attached graph delineates the active oil and gas activity in this area.

Between FY 2000-2007, Weld County issued an average of 230 oil and gas permits per year. This trend changed
in 2006 when 618 oil and gas permits were issued in Weld County. The numbers of permits issued has
increased each year. As of October 31, 2008, 942 oil and gas permits have been issued in Weld County.
b. Cite actual usage statistics that document impact and the need for the project. For example, "heavy truck traffic
related to energy development activities is impacting a county road that needs improvement.
Much of the oil and gas activity occurs in the spring and the fall when the roads are muddy, making the existing
roads more vulnerable to heavy equipment impacts and damage. When these roads are left in disrepair
potential safety concerns result.
2. Project Significance
a. Why is the project needed and what are the goals of the project?
The project is needed to allow Weld County Public Works to obtain the necessary equipment to repair roadway
damages caused by oil and gas trucks and equipment. The goals of this project are to ensure that the roadway
system continues to remain functional both in capacity and safety. The impacts are evident where there is
drilling activity. The other long-term impacts of the wells are gradually becoming evident over time due to wear
and tear on roadways within Weld County. Roads within the Wattenburg basin are most critically impacted;
however numerous roadways outside this basis are also impacted. Affording Weld County the appropriate
equipment to repair and maintain these roads is critical to the safety of the traveling public.
b. How will project implementation benefit public health and safety, improve the effectiveness or efficiency of
service delivery systems and/or generally improve the quality of life for residents?
This equipment allows Weld County Public Works the necessary equipment to continue to care for the roadways
in the safest fashion possible. Weld County is currently divided into service maintenance districts. County staff
is working on these roadways everyday to ensure the safety to the traveling public. With the intensity of truck
traffic on many roads, daily maintenance is needed to say within acceptable health and clean air standards as
set by the State of Colorado
c. What are the consequences if the project is not awarded funds?
If this project is not funded Weld County will use the match money to purchase what we can for replacement
equipment, but in some cases, less reliable and efficient equipment will be relied upon to repair roadways,
causing possible delays in repairs
2. Local Commitment
a. Explain the origin of your local cash match. (Note: Local government cash match on a dollar for dollar basis is
encouraged.) General Fund match dollars

County purchasing staff will acquire the needed equipment within three months of receipt of funds from the state.
c. Does the applicant have sufficient financial capability in reserve funds and/or unused debt capacity that can be
used to secure local matching funds? Yes_X_ No Explain: The Weld County Public Works 2009 fund
balance is $14,488,500 dollars. The majority of this money is used for on-going maintenance. In 2008, Weld
County received $421,421.44 dollars in direct distribution from oil and gas severance tax and all of this money
was used in the public works department for roadway projects.
d. Has the applicant's tax rate, user charges or fees been reviewed recently to address funding for the proposed

Explain. Examples of funds and resources include: road and bridge funds, Highway User Trust Fund

allocations, industry assessments or contributions, and property taxes. Weld County also charges an Oil and
Gas Rig/ Move fee of$1,000 and has a transportation impact fee for funding of new strategic roadways.
Property taxes and impact fees are also used to fund capital projects. Weld County assesses a $1,000 per
oil/gas rig move, and administers a transportation impact fee on new development. Weld County also imposes a
Capital Expansion fee for new development to offset the cost of future new county facilities. This money can only
be used for new capital items and not for operational support.
4. Relationship to Community Goals
a. Is the project identified in the applicant's budget, capital improvement plan, equipment replacement plan,
comprehensive plan, utility plan or other local or regional strategic management or planning document?
No, this project has not been identified in the Capital Improvements Plan, but it is reflected as a capital purchase
of equipment in the adopted 2008 Weld County Budget.
b. How did the applicant develop project cost estimates? If applicable, has a preliminary architectural/engineering
study been completed? Yes No X_what additional design work must still be completed? Explain. (Attach
one copy of any preliminary engineering reports, architectural drawings, cost estimates,detailed project budget.)
Included, is the preliminary equipment estimates. Costs were determined by Weld County Public Works
Department based upon recently bid projects.
5. Management Capacity
a. For construction, renovation or equipment acquisition projects, does the applicant maintain reserve funds for
capital improvement, or replacement of equipment items?
Yes, Weld County Government maintains a strong contingency fund consistent with Tabor requirements of a five
percent (5%) allocation.
b. Are taxes, user charges, and fees established at a level that allows the applicant to maintain and operate its
current facilities and the proposed project services on a self-sufficient basis? Yes (see 3e and 3f above).
c. Does the applicant have the technical, financial and managerial capacity to operate and maintain the facilities or
services developed through the project for the entire life cycle? Explain. (If applicable,attach the operational/maintenance
plan for the project.)
Yes. In 2007, Weld County maintained 3,062 miles of roadways.
d. Have a number of implementation options been considered? Can the project be accomplished within budget?
Are contingencies considered within the project budget? Does the project duplicate service capacity already
established? (Has consolidation of services with another provider been considered?)
The project will be completed within budget. The project will start after approval to do so, and it will be completed
by May. Some equipment requires longer lead time to acquire.
e. Has the applicant managed similar projects in the past with success?
Yes, as previously stated, Weld County has the proven expertise and history of managing projects of this
complexity.
