'; .k., ,/" tP 2001 --t, . , f RESOLUTION RE: APPROVAL OF SPECIAL USE PERMIT FOR A FUEL ALCOHOL PLANT FOR GASOHOL PRODUCTION FCR LLOYD AND EILEEN LAND, 6509 WELD COUNTY ROAD 51 , KEENESBURG, COLORADO 80643 WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado held a public hearing on the 12th day of November, 1980 at the hour of 7 : 00 o 'clock p.m. in the Chambers of the Board of County Commissioners for the purpose of hearing the application of Lloyd and Eileen Land, 6509 Weld County Road 51 , Keenesburg, Colorado 80643, for a Special Use Permit for a fuel alcohol plant for gasohol production on the following described real estate, to-wit: A tract of land located in the East Half of Section 31 , Township 2 North, Range 64 West of the 6th P.M. , Weld County, Colorado and being more particularly described as follows : Beginning at the Northeast Corner of said Section 31 and considering the East line of said Section 31 to bear South 00°00 ' 00" West and with all other bearings contained herein relative thereto: Thence South 00°00 ' 00" West along the East line of said Section 31 , 1903. 29 feet to the True Point of Beginning: Thence continuing South 00°00 ' 00" West, 849 . 36 feet; Thence North 90°00 ' 00" West, 140 . 00 feet; Thence North 00°00 ' 00" East, 75. 00 feet; Thence North 87°46 ' 30" West, 998 .49 feet; Thence North 00°12 ' 30" East, 735. 60 feet; Thence South 90°00 ' 00" East, 1135. 06 feet to the True Point of Beginning, said tract of land contains 20. 000 Acres . WHEREAS, the petitioners were present, and WHEREAS, evidence was presented in support of the granting of the Special Use Permit for a fuel alcohol plant for gasohol production, and WHEREAS, evidence was presented in opposition to the grant- ing of the Special Use Permit for a fuel alcohol plant for gas- ohol production, and 06 I o WHEREAS, Section 3. 3 (E) (2) of the Weld County Zoning Reso- lution authorizes such a use in an Agricultural District upon approval by the Board of County Commissioners , and WHEREAS, the Board of County Commissioners of Weld County, Colorado heard all of the testimony and statements of those present, has studied the request of the petitioners and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, is satisfied that the request for a Special Use Permit for a fuel alcohol plant for gasohol production on the hereinabove described real estate conforms to the purposes of Section 3. 3 (E) (2) of the Weld County Zoning Resolution and should be approved for the following reasons : 1) The proposed use would be compatible with the surround- ing area and in harmony with the character of the neighborhood and existing agricultural uses in that the fuel alcohol plant will be located in an Agricul- turally Zoned District and is a use related to agricul- ture. 2) There is a need for the proposed use due to the energy producing factor. 3) The Board of County Commissioners feels that with the design and controls proposed in the operation and that compliance with the conditions and development standards contained in the Special Use Permit, any potential ad- verse impacts upon the immediate area and future develop- ment of the area can be mitigated; and the health, safety and welfare of the inhabitants will be adequately pro- tected. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the application of Lloyd and Eileen Land for a Special Use Permit for a fuel alcohol plant for gasohol production on the hereinabove described tract of land be, and hereby is , granted subject to the following: 1. The Development Standards contained in the Special Use Permit. 2. No building or electrical permits shall be issued on the Special Use Permit area until the Development Standards for the Special Use Permit have been placed on the Special Use Permit plat and said plat has been delivered to the office of the Department of Planning Services . 3. The bio-mass boiler system shall be restricted using animal waste as fuel. 4 . Ethanol International, Inc. shall be the sole operator of the system. Items , 3 & 'j4 of the conditions have been taken-care of and no " longer apply. - -- - Steve Munson, President of Ethanol International, Inc., and owner/operation of the proposed facility was present and elaborated on the facility and its operations. Mr. Munson stated that due to problems with the previous facility on this property, Rolanda Feeds, he is willing to begin his operation in two phases to prove Ehat he will esta-)lisp and maintain a good operation. Mr. Sage '_'Murphy, waste treatment specialist, explained in detail the proposed waste treatment system. Mr. Munson submitted a letter to the Board from an area resident, Bill Brooks, in support of this request. Mr. Munson discussed the proposed bio-mass boiler system. Commissioner Steinmark questioned if it would or could burn any type of animal waste. Mr. Munson stated it could but he had no plans to use that type of material for fuel. CHANGE TAPE 80-98 Mr. Munson stated the Lands are the property owners and that he has an option to lease the property. The Lands do not nor will have any financial interest in the proposed facility or its operation. The Lands own the cattle and the small feed lot that is on the property. Some of the cattle will be used for a test on feeding the by-products, which will be purchased by Mr. Land. Several residents were present and voiced their opposition and/or concerns with various items relating to this request. Discussion was held regarding the fact that a SUP runs with the land and can be transfered from one land owner to another as long as the operation remains the same. Mr. Anson stated the Board could make their approval conditional upon Ethanol International being designated as the operator of the facility. If they were no longer the operators an amendment would then have to be made to the SLID. Commissioner Steinma-rk made a motion to approve the SUP with the Planning Commissions' conditions and two additional one; 1) The bio-mass burner be restricted from using any type of animal waste, 2) Ethanol International is designated as the operator of said facility and further included the development standards as proposed by the Planning Commission. There were general questions concerning the land use, runoff to the mobile homes to the west, the access road, and other buildings presently located on this property. MOTION: It was moved by Irma White and seconded by Jerry Kiefer that the Planning Staff's recommendation be accepted by reference and forwarded to the Board of County Commissioners with recommendation for approval . Motion carried unanimously with Kiefer, Halleran, White, Billings , Ehrlich, Wafel and Otis voting for and none against. E' Section 31, T2N, R64W LOCATION! 3 miles east and 11/2 miles north of Hudson APPEARANCE: Steve Monson, President of Technology International and Ethanol International , the two organizations involved in the application. Mr. Monson explained their plans for this gasohol plant. Mr. Monson also explained Phases I and II to ask for a modification from the Staff's recommendations to limit the SUP to a 250,000 gallon per year production level . Mr. Monson presented samples of wet grain and liquid silage taken last February from a still in operation in South Dakota. The Planning Commission then took a nose test of the samples . "1r. Monson stated that the smell will not be that great because of the way in which the plant will be set up. Mr. Honn then read the Department of Planning Services Staff recommendation for approval . Mr. Monson explained that they would like to test storing wet grain in an oxygen fee environment. Mr. Monson suggested adding this to development standard #8. The following surrounding property owners voiced their objections to the request because of the largely populated area , the industrial nature of the use, the strong odor and felt that it could be located at another site where it is not quite so populated: Margaret Eichthaler, George Shaklee, James Bell , Orville Hill , Rose Gratten, tits . Fabian and Elmer Foss. Mr. Shaklee also felt that personalities could not be separated from this issue. Mr. Monson felt that the different plants that these surrounding property owners spoke of are a whole different operation from the plant that is being requested . ' Planning Commission -- utes September 16, 1980 Page 3 There were general questions whether there are any other plants in operation of this size, how much grain would be used, the number of employees, and what type of energy would be used to operate the plant. Ms . Traxler stated that the Staff preferred that the Planning Commission review this application by field inspection to determine whether-it should go to Phase II production rather than the Planning Staff. It was suggested to add to development standard L1 that production capacity of 250,000 gallons of ethanol per year "at a rate no greater than 600 gallons per day" . . . . Ms. Fabian stated she objected to this request because she felt there would be pollution, noise, trucks all night and day and the ugliness of a big plant. Mr. Monson explained that none of the above would occur. MOTION: It was moved by Don Billings and seconded by Wilbur Wafel that the Planning Staff' s recommendation and development standards with the addition to #1 and #8 as stated above be accepted and forwarded to the Board of County Commissioners with recommendation for approval . Motion carried with Kiefer, Halleran, Billings, Ehrlich, Wafel and Otis voting for, none against and White abstaining. Mr. Billings stated that he would like to qualify his vote that he was acting only on a 250,000 gallon plant and not considering phasing at this time. Mr. Otis stated he was sympathetic with the people in the area who have endured some hardship over the past years. Mr. Otis stated he finds no evidence at this point that there will be substantial odor problems . Jerry Kiefer was then excused for the remainder of the meeting. DEVELOPMENT STANDARDS Lloyd and Eileen Land SUP-440:80 :30 1 . Uses permitted on the hereon described parcel shall be a commercial fuel alcohol plant with a production capacity of 250 ,000 gallons of ethanol per year at a rate no greater than 600 gallons per day and all other uses permitted by right in the kTicultural Zone District of the Weld County Zoning Resolution. Structures and facilities shall be as shown on the plat. 2 . The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds . 3. Lagoons for wastewater retention shall be installed as per Rules and Guide- lines for Water Pollution Control at Livestock Confinement Areas issued by the Colorado Department of Health, May 1968. The applicant shall be respon- sible for any additional applicable directives or guidelines issued by the Colorado Department of Health, Water Pollution Control Division. There shall be no discharge of wastes into any streams , other bodies of water, or adjacent drainage systems without obtaining a National Pollution Discharge Elimination System Permit from the Colorado Department of Health. 4. All accesses shall have the approval of the Weld County Engineering Department. All accesses shall be constructed in accordance with the recommendations and/or requirements of the Weld County Engineering Department. 5 . All phases of the operation shall comply with all County, State and Federal Health Standards and Regulations pertaining to air quality, water quality, noise emission, and sanitary disposal system. 6. The applicant shall obtain an Air Emission Permit through the Air Pollution Control Division, Coloraoo Department of Health, 4210 E. 11th Ave. , Denver, Colorado 80220. 7 . Odors from the ethanol manufacturing or lagoon areas must not exceed the 15 :1 dilution to threshold as specified in the Colorado Air Quality Commission's Regulation No.2 . 8. No By-Product Distillers Grain (stillage) shall be stored on the site for longer than 48 hours unless refrigerated or contained in a air tight tank. No By-Product Distillers Grain shall be stock piled, or allowed to decompose or therefore create odor problems or unsanitary conditions . 9. Security fencing shall be in accordance with the Alcohol , Tabacco and Firearms Bureau permit requirements . 10. The owner/operator shall be required to maintain a permit for production of alcohol with the Alcohol , Tobacco and Firearms Bureau of the United States Government. The owner/operator shall be responsible for complying with the conditions and standards fo the Federal permit. 11 . Representatives or members of the Weld County Health Department, Weld County Department of Planning Services Zoning Inspectors and/or Colorado Department of Health shall be granted access to the site at any reasonable time in order to issue the operations carried out on the site comply with all applicable Weld County and State Health Regulations . The Special Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of an amendment to the Special Use Permit by the Planning Commission and the Board of County Commissioners before such changes from the plans and/or Development Standards shall be permitted. Any other changes from the plans and/or Development Standards shall be filed in the office of the Department of Planning Services . 13. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Development Standards. Non- compliance with any of the above Development Standards may be reason for revocation of the Special Use Permit by the Board of County Commissioners. Phase II of the operation will require the approval of an amendment to the Special Use Permit by the Planning Commission and the Board of County Commissioners prior to full-scale operations of the site. This will allow the owner/operator of the site sufficient time to establish an efficient operation and demonstrate that negative impacts will not occur to surrounding property owners. The Hudson Area Fire Protection District has not responded to the referral sent to them August 8, 1980. Land upon which Ethanol International holds a lease with an option to buy. It is the intent of the Company to develop a small commercial scale fuel alcohol demonstration plant at the site to be known as the Rocky Mountain Gasohol Center. The fuel alcohol plant will be operated on a continuous basis and demonstrations of plant operations will be given to interested parties on a scheduled weekly or bi-monthly basis . Company History Technology International, Inc. , is a Delaware corporation founded in 1976 to carry out alternative technology renewable energy projects . The Company began evaluating the technical and economic aspects of fuel alcohol (Gasohol) production about two years ago, initially strictly for the probable development of plants to be designed, owned and operated by the Company. A wholly owned subsidiary, Ethanol International, Inc. , was formed in Colorado last year to further develop the Gasohol business . After evaluation, it was decided to primarily pursue two aspects of the fuel alcohol business , plant operation and turn- key plant sales to the agricultural sector. Since organization, the Company has sold a number of fuel alcohol plants (proprietary data) . There are specific examples of the plant and equipment type we wish to complete at the Land property in operation at other locations . First, let us get into a bit more detail about the project. Weld County Planning Commission July 29, 1980 Page Two The Emerging Gasohol Industry The potential markets for fuel alcohol are simply enor- mous . It is a segmented market relating to the proof of the fuel. For example, in the 100 proof range, the market is as "Diesohol. " For use of this product, a 50/50 mixture of alco- hol and water is directly injected into the diesel airstream and utilized as a replacement for 30 to 40 per cent of diesel consumption. All that is required is a relatively inexpensive and simple air injection conversion kit for diesel engines . In the range of 180 to 190 proof fuel alcohol, the pro- duct can be burned "straight" as a 100 per cent replacement for gasoline. This is the approach being taken in Brazil, where an estimated 300 , 000 new automobiles are being manufac- tured and sold to burn straight alcohol. The conversion is actually a simple one for established manufacturers and includes higher compression ratios of 12 :1 to 13 :1, some carburetion changes and seal changes . Auto producers include Ford Brazil, Fiat, VW and others . This product is less expensive to produce than the anhydrous used in Gasohol and is where the United States should move to, despite oil company protests. Startup problems have been eliminated by several means, including preheating and ether or gasoline pre-injection. The Gasohol market is currently based upon mixing 198+ proof (anhydrous) fuel alcohol with gasoline on a 10 per cent to 90 per cent basis. Brazil has gone to a 20 per cent mixture and virtually all cars can use 20 per cent alcohol with only several initial filter replacements , since the alcohol burns cleaner and actually cleans the engine system of sludge and particles . The potential size of the Gasohol market at a 10 per cent level is 11 Billion Gallons per year. At 20 per cent, it is obviously double that. This is only as a gasoline additive; it does not include the diesel market, aviation fuel or chemical industry feedstock markets. The Gasohol market is with us for awhile, since there are not enough high compression vehicles yet to justify a straight fuel alcohol economy. However, it appears that this market could become regionally important in a relatively short time since Ford, for example, is already building the units in Brazil . Fuel Alcohol Plant - Phase One Exhibit 1 is a picture of our Model 25 distillation module. It is 16 feet tall and has 15-inch columns . All wetted surfaces L ETHANOL INTERNATIONAL, INC. Weld County Planning Commission July 29 , 1980 Page Three are stainless steel and it is fully insulated. This unit is the heart of the system and a unit like this one is in storage in this area, and we are now awaiting go ahead to set it up at the Rocky Mountain Gasohol Center. As you can see, this 25 gallon per hour unit is not very large and will fit nicely into the existing building. It is a much advanced, direct lineal descen- dant of the now famous first generation early prototype unit of our consultant, Dr. Paul Middaugh, of South Dakota State, which unit was run last year on the Washington, D.C. Washington Mall. Exhibit 2 is a simple block diagram of the proposed pro- cess which I will be happy to go over with you varbally now. All portions of the plant, except storage tanks , will go inside the building. There will be additional grain storage, some byproduct feed storage and alcohol storage tanks . A security fence is required by the Alcohol Tobacco and Firearms Bureau (ATF) . The ATF permit has been applied for and bonding require- ments met once use permit is approved. The alcohol storage tanks will be put in place away from the building and in conformance with ATF and county and state code requirements . Basically, the process converts corn starch portion into fuel alcohol and carbon dioxide, and thereby concentrates the protein and other nutrients left into high protein distillers grains animal feed. It really is pretty straight forward. The protein value is , in fact, increased somewhat through the addi- tion of yeast to the process, which increases the protein amount a few per cent into the range of 30 per cent protein. Fuel Alcohol Plant - Phase Two It is quite possible that the project size would be increased to include a 36-inch distillation unit. If this were to be the case, an additional building plus additional storage would be required as depicted in the drawings included with this applica- tion. It is possible that such a plant would need up to an addi- tional 50 gallons per minute of water to be provided by another well to be drilled on the site. The Company does not now plan to put in a larger feedlot operation at the site. No Odors The fuel alcohol plant does not give off noxious odors . It certainly will not be noticeable over the existing feedlot. In fact, the distillation process even "smells good" rather a sweet, rich, silage smell . The plant gives off virtually no vapor, some C02 will be vented from the fermenting vats to the atomo- sphere. When _the anhydrous unit goes in, it will use a benzene separation process. Our process gives off virtually no benzene ETHANOL INTERNATIONAL, INC. Weld County Planning Commission July 29 , 1980 Page Six to pose a hazard to workers, alcohol or feed by product. The process recycles virtually all of the benzene in a special column and meets all applicable EPA requirements . The liquid slops are covered in this document later. Liquid slops are left after the byproduct feed is centrifuged or screened out of the mash after the distillation process . Rocky Mountain Gasohol Center It is our intent to utilize the existing building, live- stock feedlot, sewage lagoon, and grain storage equipment on the property to complete our Rocky Mountain Gasohol Center. This Center will be an ongoing small commercial scale demonstration project. As you can see, most of the buildings and other re- quired infrastructure are already in place. At the Center, we plan to operate the plant, use some of the alcohol on the site, sell some to other agriculturalists in the area, and market the product on a regional basis . You may have read the recent article in the Denver paper, which dis- cussed the start of the Colorado State fleet use of gasohol and mentioned the potential market for 60 Million Gallons of fuel alcohol annually in Colorado. We believe the alcohol product can be marketed here, as Diamond Shamrock and others are begin- ning to do. Byproduct Distillers Grains The Center will, of course, also produce high protein by- product distillers grains, which are an excellent source of concentrated protein animal feed. The 200 head livestock feed- lot on the property will be fenced into several sections and a series of rigorous feed trials will be run, utilizing the wet distillers grains from the process (between 60 and 70 per cent moisture by volume) . A great deal of information is available from other locations concerning the high weight to gain ratio of dried distillers grains from distilling plants all over the nation, but more work needs to be done on precise and recommended wet stillage ratios. Since there is a definite economic benefit to utilizing the wet stillage without expensive and energy intensive drying processes , it is essential that optimum feed rations be developed, using this high protein feed. Enough data is available from the University of Nebraska and others to know that the wet stillage will work very well. It is just not yet clear what amounts will comprise optimum rations . It is also necessary to further evalu- ate just which sort of storage conditions are optimal when the wet stillage is mixed with hay or straw to form a concentrated ensilage for later feeding. Smith Company "Blue Harvestor" Feed Trails The applicant is pleased to state that Dr. Vetter, a well- known animal nutritionist, formerly of the University of Iowa and now with the A. O. Smith Company, will be in charge of our wet stillage feed trials. Their company is also putting in at least one Blue Harvestor tank to evaluate byproduct feed handling and storage characteristics as well as feed ration formulation. Traffic Impacts During phase one, an estimated average 1% semi-loads of grain will be brought to the site and one fuel semi for product will be needed every two weeks. About 20 automobiles could be expected on a weekly or bi-monthly basis. In our experience, roads were passable last winter though some problems were experienced when the very large drilling rigs and very high traffic loading used the entry road when well drilling was being carried out. Plant needs, even in phase two should not reach those levels. Later, in phase two, with additional storage, most grain will be purchased early at harvest and stored for use on site. Employee Shifts and Trailer The plant will initially be run by four full time persons . That could go to seven or eight staff members under phase two. Due to continuous operation, staff will live at the site. During the period of the lease, a trailer house will be moved to the site and the owner will continue to use the house. When the option is exercised in less than 12 months, the trailer will be moved off site if required. The trailer will be hooked up to the existing septic tank system. Liquid Slops Odor Situation Fortunately, if the liquid slops watering program does not work out, the slops can be sent into the large existing aerated settling lagoon located near the buildings and feedlot and later used on the fields as "grey water" fertilizer. The Company plans to evaluate fish growth aquaculture potential in the lagoon system if the salt sealant can be neutralized. The lagoon will not be odiforous , certainly not on the order of the prior use of the site for conversion of chicken manure to animal feed. Since the aerobic treatment lagoon is in place, BOD problems and, therefore, potential odor problems will never happen. In fact, with the existing 200 head feedlot continuing to operate as it now is, no one will be able to tell by the "nose" test that the Rocky Mountain Gasohol Center is operating at the site. Fuel alcohol will benefit farmers and ranchers by providing additional marketing and livestock feeding options, as well as providing fuel during times of increasing constricted supply. It is our opinion that this emerging industry, which is estimated by the Department of Energy to meet 4 .3 per cent of national gasoline supplies next year, offers an unparalleled opportunity to the agricultural sector. Board of County Commissioners September 15, 1980 Page Three Altered Proposal We propose that the special use permit be granted as requested for our 200 , 000 gallon per year commercial scale demonstration gasohol plant. Under the permit we would be allowed to test larger than 15-inch columns at the site as needed, but the output of alcohol and stillage over a 24-hour period could not exceed the 24-hour average rate of our 15-inch column units . However, we would not be allowed to increase the daily output of the facility to the second phase level until your staff or commission approves of our odor situation after a sixty- day trial period as described below under Odor Test Period. Output Levels The 15-inch diameter distillation unit, which you have a picture of, is guaranteed to produce alcohol at the rate of 25 gallons per hour. Over a 24-hour period this is approximately 600 gallons of alcohol per day. We will not exceed this rate under the altered first phase proposal. More particularly, questions have related to possi- ble odor problems from wet stillage grains and liquid stillage as the potential culprits. The stillage output numbers go something like this assuming corn feedstock weight of 56 lb. per bushel at a 12 per cent moisture �ed1V! Board of County Commissioners September 15 , 1980 Page Four Then approximately16 . 51bs of high protein animal feed by- product will be produced, per bushel of corn. An alcohol output of 25 gallons per hour will require 10 bushels per hour of corn. With a 24-hour operation this plant requires 240 bushels per day of corn. Total by-product feed produced would be 240 X 16. 5 lb or approximately 3 , 960 pounds per day of wet stillage grains plus a moisture level at about 64 per cent moisture. This is a little wetter than normal ensilage. Under the altered proposal the first phase would not exceed this production rate for any given 24-hour period. Odor Test Period We hereby propose that our special use permit initial- ly be limited to output rates listed above until a 60 day continuous operation run has been completed and are satis- fied with the "nose test" . I can guarantee you that it will not be identifiable over the small feedlot already at the site where we shall be running the important wet stillage feed trials . At the end of the 60 day test period, we will ask that you and/or your staff approve the second phase of operation as described or we may even formally choose to apply for a S' ETHANOL INTERNATIONAL, INC. Board of County Commissioners September 15, 1980 Page Five larger operation depending on our analysis of local market conditions. Other Comments On Stillage We do not plan to increase the size of the feedlot at the site. Should we ever wish to do so, we would come to you with a fullblown feedlot permit application. This is an extremely unlikely eventuality. We will be doing one of three things with the wet stillage by-product. First, we shall be feeding some of the stillage in the feed trials at the site. Second, we shall be storing some of the by-product in the oxygen free Blue Harvestor tankage being donated and tested by A.O. Smith, at the site. Third, we shall be selling the balance to local feedlot and dairy operators from Hudson to Greeley, depending on market demand requirements . Your staff person correctly pointed out that we had omitted to mention our need to move our estimated one truck per day (or less) over the road to get the ensilage-like feed to feedlot or dairy operator purchasers . We apologize for the ommission, but we simply overlooked this fact in our earlier rather detailed presentation. It should be clear that we will not let this fresh, sweet smelling material sit around for more than a few days , ETHANOL INTERNATIONAL, INC. Board of County Commissioners September 15, 1980 Page Six because it tends to start losing some value once certain breakdown reactions start. However, even then, the en- silage-like odor is not that unpleasant. Simple economics dictate that we handle this stillage quickly and efficiently, and that it not be allowed to sit around exposed to the air. The material must be handled as stated to return its full economic value. As to the liquid portion of the stillage, it will be handled in one of three ways . We shall be evaluating it as an animal feed in lieu of water in a special feed trial area being designed for this . If this proves to be interesting, we shall attempt to sell it to local users as reportedly is being done in the Midwest. That portion of the liquid stillage which is not backset into the cook tank (30 per cent is backset) or used, or sold, will go into the existing aerated waste pond at the site which is about an acre in size with five to six feet of capacity. In addition to the spray aeration system in existence, we plan to add several pond aeration systems as needed as are more commonly used in the aquaculture industry for aerobic treatment. This pond will easily accommodate all liquid stillage from the plant as it will be diluted and f' ETHANOL INTERNATIONAL, INC. Board of County Commissioners September 15, 1980 Page Seven treated with oxygen and algea to breakdown the 3 to 5 percent solids in the liquid. Some of the pond water will be evaporated of course, and the balance can be used at irrigation time with Mr. Land' s irrigatior water. In fact, we may be able to justify selling it to ham. The water will be considerably cleaner than the "grey water" typically put on fields after treatment in municipal sewage plants. Samples and Summary Just to bring the discussion down to the basic level , please give your own "nose test" to these samples taken last February from the 12 inch prototype still in operation at South Dakota State University, which was set up by one of our early consultants , Dr. Paul Middaugh. That still was notably less efficient than our newer models, but it did work. It did not work as well as new models for full by-product recovery. However, these two samples should be instructive since there has been seven months for the material to "breakdown" as our detractors claim. Please smell the ensilage-like wet stillage. Is that so bad? ETHANOL INTERNATIONAL, INC. Board of County Commissioners September 15 , 1980 Page Eight Now as to the liquid stillage portion; the slight- ly pungent smell is caused by the 4 or 5 per cent alcohol which the inefficient early still allowed to run on through into the by-product. Our new models are much im- proved and pull essentially all of the alcohol off as must be done to operate an efficient economic 'operation. The smell is not bad even with the alcohol content and the seven months to degrade. Certainly it does not compare with a feedlot or chicken manure factory, does it? Please bear in mind additionally that the aerated pond will not contain straight liquid stillage as is in this sample. It will be continuously diluted and in the process of being converted into neutral material by algea action in the pond. Therefore, there will be no problem of odor, considerably less by way of example than in a well run treatment plant and certainly not noticeable over the existing small feedlot. Septic system for mobile home trailer which is presently serving the office: We require that the system be enlarged by 300 squard feet if it is to serve both the mobile home and office. Information received by telephone with Ethanol International representatives indicate that the present system is undersized for the proposed service. A repair permit (no charge) is required from our office and a final inspection shall be made before the addition is covered with soil. The mobile home cannot be located on top of the field as drawn in the plans. Our regulations specify that a 20 foot distance must be maintained from the leach area and any structure. If the applicant requests any deviation from this, a variance request must be made to the Weld County Board of Health. 3. Odors from the ethanol manufactoring or lagoon areas must not exceed the 15:1 dilution to threshold as specified in the Colorado Air Quality Commission's Regulation No.2. 4. Any potential discharge to any water of the state, an NPDES permit must be obtained. 5. Noise - must meet the requirements of 25-12-103 CRS 1973. 6. All of these are reasonable possibilities but there is no research or demonstration been done in this state to indicate whether they would be successful or not. If a specific plan of utilization was outlined, then I could make some comments about the feasibility but as it stands now, I don ' t feel that I can say yes or no to the proposal with regard to utilization of the by-products . Dear Weld County Planning Commission Members: This let er is being written to voice our opposition to the issuance of a land use permit to Lloyd Land for the purpose of operating a gasahol plant on land formerly used for the Roland. "DPW" operation. wording to the Keene Valley Sun", Aug. 28, 1980, milo, sugar beets, potato waste and other materials would be used. We are wondering what the 'other° materials might be - possibly chicken manure; The announcement of the proposed gasahol plant came as a complete surprise to area residents, especially since the papers informing us of this plan were delivered to us August 28, the Court House is closed Saturday and Sunday, and Monday is a legal holiday, and letters of opposition were to be received by the Planning Commission before Sept. 2. Also, this announcemant came shortly after the announcement that the former Gates Cyclo egg producing plant near Hudson will soon be doubling it's chicken capacity, whick will vfao mean double the amount of chicken manure. Could this be only coincidence? Anything the ex-Rolanda operators do is suspect by residents of the Keenesburg - Hudson area who were forced to endure the stench of their illegal operation until they were finally closed down. The thought that the ex-Rolanda plant might resume operations under a different name and supposedly a different product i unbearable to us all. This is not a sparsely popula ed area. There are two elementary schools, seven churches, many businesses, and many town and rural private residences which would be affected by this operation. Also, this is to be a demonstration or experimental plant, no one really knowing what the end result might be. We have fought long and hard for clean air without unbearable stench out here, please consider the effect both physically and mentally on us all if this permit is issued. Surely there are many unpopulated o waste lands where these experiments might be carried out. We urge you to deny the permit to Lloyd Land and his associates - none of which, incidentally, are Weld County residents. It seems that lately the rural areas of Weld County are being sought as dumping grounds for metropolitan sewage, trash, and now, experimental plants. The applicants were an intergal part of the Rolando Feed Company who placed expediency above decency toward their neighbors and deliberatly mismanaged the unlawful, stench producing chicken manure dehydrating plant that residents of this area had to endure for what seemed to be an eternity. 2. Mr Steve Munson of the Ethanol International, Inc. who will make the presentation to the Weld County Planning Commission on Sept. 16, 1980 purports to have a 1 year lease and option to buy. In making his presen- tation to the town board of Keenesburg, Colo. on Aug. 25, 1980, Mr. Munson stated that his Company might exercise it' s option. We submit that it is possible the Land' s, together with what appears to be a partner, Mr. Jim Erger of Brighton, have purchased a Fuel Alcohol Plant from the Ethanol Enternational, Inc. people and are using the Ethanol and A.O. Smith names (the Harvestore Company) to decieve the people of S.E. Weld County as well as the Planning Commission and the board of County Commissioners. None ofrh,i people involved in this application live in Weld County. 3. Mr. Land owns and controls land in Adams County. We suggest it would be well to build this demonstration plant there, in a sparcely pop- ulated part of that County. 4. From Mr. Munson' s presentation to the Keenesburg Town Board it was evident that neither he or the Ethanol people were experienced in the opperation of a fuel alcohol plane, being salesmen and manufacturers respectfully. He further stated that if "managed properly" the plant would be oderless but admitted that if it was mismanaged it could create consid- erable odor. 5. We live lz miles down wind from this proposed location, (exper- ience with the Rolanda plant has demonstrated that all adjacent locations are down wind) and have operated a Farm and Ranch there since 1942. Having been delivered from a living hell on or about June 18, 1979 by an act of providence (the pland was destroyed by fire) we feel it woikid be short. sighted and inconsiderate if the zoning bodies of Weld County were to allow the people of South East Weld County to again be subjected to abuse from the same people who flagrantly and contemptously violated the zoning laws of Weld County and the polution Control Regulations of the State of Colorado.
