Re: East 1-25 Sanitation District— Service Plan
Dear Bruce and Cyndy
As required by Section 1.6 of its Service Plan (the "Service Plan"), the Petition
for Organization (the "Petition") of the East I-25 Sanitation District (the "District")
provided that:
Unless otherwise extended by action of the Weld County Commissioners, if
within twelve (12) months after the date of this Court's Order creating the
District, the "208 boundary" is not amended by the North Front Range
Water Quality Planning Association to follow the boundaries of the District
and to allow for its operation therein, the Board of Directors of the District
shall proceed to dissolve the District, as set forth in the Service Plan of the
District.
In its Order filed June 25, 2007, the Court held that: "This condition is self-
executing in the sense that if the condition is not met within the 12-month period, the
district will be dissolved." The District Court's Findings, Order and Decree Creating the
East 1-25 Sanitation District (the "Court Order") was filed on November 1, 2007. (See

The North Front Range Water Quality Planning Association (the "NFRWQPA")
has amended the 208 Boundary as required by the Service Plan and the Petition. (See
Letter from Ms. Connie O'Neill, Manager of NFRWQPA, to Ms. Stephanie Stewart,
District President, dated August 7, 2008, which is attached hereto.) Because the 208
Boundary amendment was effectuated less than 12 months after the date of the Court
Order, the self-executing condition set forth in the Service Plan and the Petition has been
satisfied and the District thus has no obligation to dissolve itself thereunder.

Dear Ms. Stewart:
The North Front Range Water Quality Planning Association gave final approval to the
2007 Update of the Areawide Water Quality Management Plan at a public hearing held
on March 27, 2008. During that hearing the Association approved several changes to the
plan. Included in those changes was the approval of the East I-25 Sanitation District as a
Wastewater Management / Operating Agency and the approval of a 208 Wastewater
Utility Service Area for the District. A map which identifies the approved 208
Wastewater Utility Service Area for the District has been included with this letter.
In addition to the Association's approval of the Update, the Water Quality Control
Commission also considered the 2007 Update at a recent public hearing held on July 15,
2007 At that hearing the Update was approved by the Commission without conditions.
