SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL
REVIEW (USR) QUESTIONNAIRE
• The following questions are to be answered and submitted as part of the USR application. If a question does not pertain to your
use, please respond with"not applicable",with an explanation as to why the question is not applicable.
1. Explain, in detail, the proposed use of the property. —The property is currently the owner's home/farm and oil field service
company
2. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 22 (Comprehensive Plan). —
Currently the neighboring properties to the East, South and West have various business ventures associated with the
home farms. This business will be off the main road and out of view from all but the closest neighbor. Vehicle traffic
will be minimal having only 5 trucks and 10-trips/day.
3. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 23 (Zoning)and the zone district in
which it is located.- The existing zoning is Agricultural which allows farm equipment storage and maintenance shops.
The proposed uses would not be significantly different than a farm use, with minimal disruption to the surrounding area.
4.What type of uses surround the site? Explain how the proposed use is consistent and compatible with surrounding land uses. -
East of the property is a business with trucking and storage, west,south and north is undeveloped Agricultural land.
This use is similar to other trucking operations within a mile of this property.
5. Describe, in detail, the following:
a. How many people will use this site?- Maximum of 5 employees and the owner's family.
b. How many employees are proposed to be employed at this site?-5

Larry,
Basically a new access agreement will need to be obtained because it is a change in intensity. I hope
that helps. The access agreement will need to be signed by all parties crossed by the access and
specifically state what the access can be utilized for. I have planned on making the new access
easement agreement a condition of approval that will need to be completed prior to recording the plat.

Got it...l'll provide documentation of notification so we can proceed.
BTW, will the access easement revision hold-up our hearing on December 18? Also, can we revise the existing easement
with commercial access- utilizing the same description or will there need to be a revision on width? As I spoke with Rey
Bonilla, his comment to me was that there was a loss of documentation, so he was not understanding the need to revise the
existing access agreement for commercial access.
Thanks for the new info and if you could clarify further the specifics on the commercial revisions it would be very helpful...

In regards to the access — I have spoken to the County Attorney and provided him with all the
information in the application and he has determined that a new access agreement will need to be
completed and recorded specifically outlining the commercial use of the access. When Mr. Bonilla
submitted the application I spoke briefly to him about getting a new access agreement and he said that
would be a big issue and he would start working on that. I then followed up with our County Attorney fo
a determination and it was decided a new access agreement would be required. I have planned on
making the new access easement agreement a condition of approval that will need to be completed
prior to recording the plat.

Jacqueline, I had not met with Rey Bonilla since he submitted his USR application. Knowing that we
are close to the 30 day minimum timeline for notification of mineral owners I asked Rey for a copy of the
certified list and he said that he submitted the only copy with the application. Could you fax or email me
a copy so I can notify the mineral owners of the upcoming meeting? I need to do this by tomorrow to
meet the Colorado Statutes.
Also, Rey stated that there was a question on the easement for the ditch access. In the packet there
should be copies of the recorded documents - I have included copies of the title and recorded easemen
as attachments to this email.
If there is anything else needed, please let me know...

I am in agreement with you such that the Bonillos need to secure a new
access easement . The reason is partly that the new use will intensify, but
more importantly, because the original FRICO document only granted only an
easement for "Canal and Lateral rights of way or any part thereof" .
