RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST CHRISTOPHER GODFREY FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Christopher Godfrey, ZCV #0800016, is allegedly in violation of the Weld
County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 17th day of June, 2008, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Christopher Godfrey was not present or represented at said hearing, although
all parties were notified of said hearing by Department of Planning Services staff, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until August 17, 2008, to allow adequate time for the property owner to remove the
mobile home to bring the subject property into compliance and for an inspection of the property by
the Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV#0800016 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Christopher Godfrey to remedy the violation of the Weld County
Code, and any other persons occupying the properties, any persons claiming an interest in the
properties, and any persons acting in active concert with the identified parties, with an instruction
for delay of action upon such referral until August 17, 2008, to allow adequate time for the property
owner to remove the mobile home to bring the subject property into compliance.

REMEDY
Since the initial permit for the mobile home was approved due to the presence of a dairy which has since
been removed and is now currently more of a farming operation and change in ownership, the mobile
home will need to be justifed or removed from the property. It has been brought to my attention that staff
has recommended denial of your Zoning Permit for a Mobile Home (ZPMH) as an Accessory to the Farr
application. Since we have not received any information indicating how you wish to proceed the above
hearing has been scheduled.
RECOMMENDATION
The Department of Planning Services recommends this case be forwarded to the County Attorney's
Office, but to delay legal action for 60 days.

01/25/2008 Phone Call I spoke to Chris Godfrey (303-833-4045). He stated that
the RV is not connected nor occupied. He stated that it
is strictly utilized as storage. He also stated that he the
farm help is for his alfalfa/hay operation. He stated that
the dairy went away in approximately 1976. I explained
that I would speak to Wendi Inloes and call him back. He
said okay.
01/25/2008 Phone Call After speaking to Wendi Inloes, I called Chris Godfrey
back again. I explained that it was determined that we did
indeed need a new ZPMH application for the mobile home;
however, Wendi agreed to waive the fees. I explained that
I would assist him in anyway possible to help with the
application. He said okay. I explained that typically my
next letter is for 30 days; however, I would go ahead and
make this one for 60 days. He said thank-you.
02/07/2008 Phone Call Christopher Godfrey called today. He asked how much
time he really had to turn in the ZPMH application. I
explained that my last letter granted until 03/25/08 and
that was the date that I would honor. He stated that he
spoke to the Health Department and they informed him
that he would need to get a Statement of Existing for the
septic on the mobile home. I explained that sounded
correct. He said okay.
06/09/2008 Phone Call Christopher Ernst called to advise me that he had been
retained by Christopher Godfrey as counsel. He indicated
that they agreed to remove the mobile home and have
already made contacts in hopes of arranging someone to
take it. He said he would send me a letter.

Dear Bethany:
Greetings. This is further to our recent conversations about the above-referenced Case.
Thank you for discussing it with me. It is my understanding that the Case will come before the
Weld County Commissioners on Tuesday, June 17, 2008. As you know, I represent Mr. Godfrey.
As you and I discussed, Mr. Godfrey is currently making arrangements to remove the
subject mobile home from his property, in order to cure the claimed violation. Recently, Mr.
Godfrey contacted several companies that may be interested in salvaging the mobile home, in
order to obtain removal estimates. He hopes to secure a reasonably-priced contractor who is
qualified in safe demolition and removal, and who will restore the farm property responsibly.
That process involves site-visits,bidding, negotiations and the work, all of which require time.
Although we hope to secure removal as soon as possible, you and I discussed that Mr.
Godfrey may need additional time in which to contract for and complete the work. We discussed
a 60-day dine frame after next week's hearing (around the middle of August), and you indicated
that your Department would not oppose that amount of time, which we appreciate.
At the same time, Mr. Godfrey is not in a position to accept the first bid that comes along,
and therefore we would respectfully request a reasonable amount of additional time —to the end
of August or early September — so long as we are making good progress and keeping you
regularly updated. You stated that you would discuss this request with your fellow Staff and the
Board, and that our appearance at the hearing is not required under these circumstances.

Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a
representative be in attendance to answer any questions the Board of County Commissioners

RE: ZPMH-2538—Zoning Permit for a Temporary Accessory Farm unit.
Dear Mr. Godfrey:
The Department of Planning staff met on Friday, May 2, 2008,to discuss your request for an
existing mobile home to continue to be used as an accessory to the farm. Staff has denied
this request given that less than 80 acres is not a viable farming operation, and also given
that it is not a full time need.
I understand that you have spoken with Michelle Martin, Planner, and have been given the
option to do a recorded exemption, which would allow for the mobile home to be split off to
become a home on its own lot. You would also have the option to go before the Board of
County Commissioners who would have final determination on the temporary use.
Please let myself or Bethany Salzman know of your decision within 10 days of receipt of this
letter on how you wish to proceed.

Subject: ZPMH-2538 Referral
Upon review of my case files and computer, an active Zoning Violation (ZCV08-00016)was noted. This
violation was initiated due to the presence of 2 (two)dwelling units on 1 (one)parcel. This mobile home
was initially permitted through BOA-552 as an Accessory to the Farm for approximately 120 milking cattle
and 80 head of replacement and calves. After discussing this case with Mr. Godfrey, Michelle Martin,
Planner and myself, it was determined that Mr. Godfrey might not be eligible for this Accessory to the
Farm because he stated his employee primarily works at other places and the dairy has been removed
from this site. Furthermore, Mr. Godfrey indicated that his employees'only compensation was free room
and board. He did say that he occasionally gave his employee$5 or$10 for doing something around the
farm, but generally did not pay any cash in addition to room and board. After he was advised to proceed
with a Recorded Exemption process, he asked Michelle what he had to say in order to get this application
approved. This case has not been presented to the Board of County Commissioners through the Violation
Hearing process.
This application if approved will correct a portion of the violation. If this application is denied,the violation
case will proceed accordingly otherwise the commercial vehicle shall be removed from the property.

Home (ZPMH) was necessary due to the change in use (from a dairy to more of a farming
operation) and change in ownership. As I indicated we were able
to waive the associated fees for this application due to the fact that the mobile home has
been situated on the property for such a long period of time and even though the specific
use changed, the intent has not. Please see the enclosed
application and as I previously indicated if you need any assistance, please do not hesitate
to give me a call.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however, we have no discretion in this matter if you fail to correct this violation. You have until
03/25/2008, to correct this zoning violation. Failure to do so will result in this office scheduling the
violation before the Board of County Commissioners to consider whether to refer the violation to the
County Attorney's Office for legal action.

One (1) original drawing plus (6) six copies. A scaled drawing of the property (1"=50') needs to show the
proposed location of the mobile home. Include distances between the property lot lines and proposed mobile
home and all other existing structures on the property; access to the property (indicate whether it is existing
or proposed) ; County, State, or Federal road rights-of-way; amount of road frontages; location and
measurements of any easements; and any proposed structures to be located on the property.
One (1) Original Weld County Road Access Information Sheet plus one (1) copy. (Page 7)
Two (2)copies of a document showing evidence of adequate water supply(e.g. well permit or letter from water
district). This is not required if applying for temporary storage of a mobile home.
Two (2)copies of a document showing evidence of adequate methods of sewage disposal (e.g. septic permit).
This is not required if applying for temporary storage of a mobile home.
One (1) copy of deed or legal instrument identifying applicant's interest in the property. Copy of recorded
instruments may be obtained from Weld County Clerk and Recorder's Office or a title or abstract company.
One (1)copy of affidavit and certified list of the names, addresses and the corresponding Parcel Identification
Number assigned by the Weld County Assessor of the owners' of property(the surface estate)within 500 feet
of property being considered. This list shall be compiled from the records of the Weld County Assessor, the
Weld County Website, www.co.weld.co.us. or a person qualified to do the task, and shall be current as of a
date no more than thirty (30) days prior to the date the application is submitted to the Department of Planning
Services.
One (1)copy of the completed Application for a Mobile Home Building Permit.
Application fee.
An additional investigation fee shall be added to the cost of the permit application when specific land, uses,
building, manufactured homes, mobile homes, and structures that require a permit by the Weld County Code
are located, moved, operated, or constructed prior to obtaining a permit. The investigation fee shall be 50% of
the fee established by separate action by the Board of County Commissioners for land-use applications. The
payment of such investigation fee shall not relieve any persons from fully complying with the requirements of
the Weld County Code, nor from any other penalties.
One (1) each of the application and scaled drawing shall be collated into six (6) complete application packets
and bound with binder clips or paper clips only. The original copies shall be placed in one packet (includes
additional items below if applicable). Applications bound in any other fashion than binder or paper clip will be
returned to the applicant without review. Additional required information shall be kept separate to be collated
by Planning Staff.The Department of Planning Services may request additional information,application packets
and/or fees that will aid in the review of the Zoning Permit application.

It has come to the attention of the Department of Planning Services staff that the uses on your property may
not be in compliance with the Weld County Code, Chapter 23. The potential noncompliance(s) with the
Weld County Code are as follow:
The Weld County Code does not have provisions for Recreational Vehicles to be utilized as
dwelling units. My records also indicate that the mobile home was permitted to be utilized
in conjunction with a Dairy operation that was occuring back in 1974/1975; however, during
my inspection, a dairy operation was not visible. The mobile home shall be removed or if
applicable permitted accordingly.
