RE : APPROVAL OF SUBDIVISION EXEMPTION NO. 167 - RICHARD HEIN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has reviewed the
request of Richard Hein for an exemption from the definitions of
0 3 "subdivision" and "subdivided land" in Section 30-28-101 (10) (d) ,
* CRS 1973, as amended, and Section 2-1 A. (3) of the Weld County
Subdivision Regulations, and

The owners of the property described above have requested an exemption fran
Section 2-1 of the Weld County Subdivision Regulations adopted August 30, 1972.
The Department of Planning Services staff has reviewed this request and
recommends that the request be approved for the followings reasons:

In 1979 the applicant sold part of a farm and kept the improvements on a 7.13
acre parcel. Because this sale involves a parcel of ground in an agricultural
zone district of less than 35 acres, both parcels are illegal. Approval of
this request would create a .462 acre parcel and the subsequent subdivision
exemption case number 168 would provide a solution to the illegal parcel
problem.

WE ARE NOW ASKING TO SELL THESE BUILDINGS IN TWO SEPARATE
PARCELS . THIS WILL NOT BE CREATING ANY NEW IMPROVEMENTS OR
BUILDING SITES, JUST SEPARATING THE OWNERSHIP OF THE TOTAL
PARCEL WHICH CONTAINS APPROXIMATELY 7 . 13 ACRES .
BECAUSE OF THE WAY THE HOUSES ARE SITUATEDON THE PROPERTY, A
